فإن الاشتغال بالفقه من أعظم الأعمال، وخير ما صرفت فيه نفائسُ الأوقاتِ، إذ به يعرفُ الحلالُ والحرام، وتقام الحدود والفرائضُ، ولقد كان وما زال الفقه الإسلامي –بمذاهبه المتعددة- مواكباً لحياة المسلمين في جميع شؤونهم، اجتماعيةً واقتصاديةً وسياسيةً ومعيشيةً، وقد كان الفقهاء والأئمة الأعلامُ مصابيح الدجا، وشمس الظلمات، نشروا دين الله تعالى، وشرحوا عقيدةَ الإسلام، وهؤلاء الأئمة كانوا -ولا يزالون- حملةَ الشرعِ الحنيفِ، عنهُ ذائدون، وبه ناطقون، وبتعاليمه عاملون، وإلى الله تعالى داعون.
ولعلَّ من أيسر ما يمكننا أن نقدمه من خدمة لهذا الإرث العظيم الخالد، هو أن نشمر عن ساعد الجد لدراسة بعض مسائله، وحث الجهود المخلصة لبحث جانب من القضايا التي ترفع الإبهام والإشكال عن بعض مكنونات فقهنا الإسلامي العظيم، عسى أن يَفِيْدَ منها الدارسون، وينتفعَ بها طلابُ المعرفةِ.
ولعل مباحث الفقه الجنائي من المباحث الدقيقة والمهمة في آن واحد؛ إذ أن لها اتصالا مباشراً بالفرد، ولما تتضمنه من ارتباط وثيقٍ بحياته اليومية، وبغية أن أكون ممن نال شرف الإسهام في خدمة هذا الفقه الخالد، فقد آثرت أن أصرف همتي لبحث جانب من جوانب الفقه الجنائي الإسلامي، ليكون موضوعاً اتناوله في هذه الدراسة المتواضعة، فاستوقفني جانب من جوانب العقوبات التعزيرية، ألا وهو التعزير بتقييد حرية الجاني، إذ أن من المعلوم أن التعزير يكون على أنواع، فمنه عقوبات بدنية، ومنه عقوبات مالية، ومنه عقوبات مقيدة للحرية، ومنه عقوبات أخرى متنوعة، فأفردت تقييد حرية الجاني بالدراسة في هذا البحث، بعد أن سبق لي دراسة أنواع العقوبات التعزيرية الأخرى، وغايتي أن أتناول عقوبتين أساسيتين من العقوبات التعزيرية تندرجان تحت مسمى عقوبة مقيدة للحرية، هما عقوبة الحبس وعقوبة التغريب أو النفي، وهما العقوبتان اللتان تناولهما الفقهاء في كتبهم كعقوبة تعزيرية، فاخترت أن يكون عنوان هذه الدراسة:

ثم ارتأيت أن تكون خطة البحث مقسمة على مقدمة وثلاثة مباحث وخاتمة.

ولعل مباحث الفقه الجنائي من المباحث الدقيقة والمهمة في آن واحد؛ إذ أن لها اتصالا مباشراً بالفرد، ولما تتضمنه من ارتباط وثيقٍ بحياته اليومية، وبغية أن أكون ممن نال شرف الإسهام في خدمة هذا الفقه الخالد، فقد آثرت أن أصرف همتي لبحث جانب من جوانب الفقه الجنائي الإسلامي، ليكون موضوعاً اتناوله في هذه الدراسة المتواضعة، فاستوقفني جانب من جوانب العقوبات التعزيرية، ألا وهو التعزير بتقييد حرية الجاني، إذ أن من المعلوم أن التعزير يكون على أنواع، فمنه عقوبات بدنية، ومنه عقوبات مالية، ومنه عقوبات مقيدة للحرية، ومنه عقوبات أخرى متنوعة، فأفردت تقييد حرية الجاني بالدراسة في هذا البحث، بعد أن سبق لي دراسة أنواع العقوبات التعزيرية الأخرى، وغايتي أن أتناول عقوبتين أساسيتين من العقوبات التعزيرية تندرجان تحت مسمى عقوبة مقيدة للحرية، هما عقوبة الحبس وعقوبة التغريب أو النفي، وهما العقوبتان اللتان تناولهما الفقهاء في كتبهم كعقوبة تعزيرية، فاخترت أن يكون عنوان هذه الدراسة:

ثم ارتأيت أن تكون خطة البحث مقسمة على مقدمة وثلاثة مباحث وخاتمة.
فأما المقدمة فهذه، وقد تناولت فيها أهمية دراسة الفقه وسبب اختياري لهذا الموضوع.
وأما المبحث الأول فقد جعلته في تناول مفهوم التعزير والحبس والتاصيل الشرعي لعقوبة تقييد الحرية.
وأما المبحث الثاني فقد جعلته في تناول أحكام الحبس كعقوبة مقيدة للحرية.
وأما المبحث الثالث فقد جعلته في تناول التغريب والإبعاد كعقوبة مقيدة للحرية.
ثم تناولت في الخاتمة أهم ماتوصلت إليه في البحث من نتائج.
هذا وإني آمُلُ أن أجدَ في صدرِ من يُطالِعُ هذا العملَ ما يشفعُ لي إن وجدَ فيه خللاً، وما عساني إلاَّ أن أرددَ قائلاً:
وإنْ تجدْ عيباً فسُدَّ الخلــلا فجلَّ من لا عيبَ فيهِ وعــلا
اللهمَّ هذا جهدُ المقلِّ، وما كان فيه من قصور أو خلَل فإنما هو من نفسي والشيطان، وما كان فيه من تمامٍ وحُسْنٍ فإنما هو بفضلِ الله تعالى وحُسنِ توفيقِهِ، وهو وحدَهُ المسؤولُ أن ينفَعَ به، ويكتُبَ له القبولَ، ويعمِّمَ به الفوائدَ.
وصلى اللهُ وسلَّمَ على سيدنا ونبينا وحبيبنا محمدٍ الصادقِ الأمين، وعلى آلِهِ الطيبين، وصحابَتِهِ الغرِّ الميامين، والتابعين لهم بإحسانٍ إلى يومِ الدينِ، والحمدُ للهِ ربِّ العالمينَ.
