Abstract
In Iraq, for the purpose of keeping pace with changes and compatibility with new legislation and to ensure good performance in the components of the judicial authority, the new Public Prosecution Law No. (49) of 2017 was enacted, which in turn abolished the previous Law No. (159) of 1979, under which the tasks and powers of the Public Prosecution Service were greatly expanded, as the new law gave it a greater oversight role at the expense of other regulatory agencies.
This study showed the importance of the Iraqi Public Prosecution Service and the stages of its development from 1918 until the issuance of Law No. (49) of 2017. This study also showed the important role of the Public Prosecution in representing society and monitoring the proper implementation of laws related to the public interest, and the addition of new tasks and powers to this effective body, such as challenging the constitutionality of laws Related to the public interest, and the new tasks and powers added by New Law No. (49) of 2017 to this effective body, such as challenging the constitutionality of laws and investigating cases of financial and administrative corruption in state departments.
In conclusion, this study showed the most important results that were reached in this regard, as well as the most important recommendations through which the deficiency or defect that plagued the legislation of this law could be avoided.

Abstract
بينت هذه الدراسة اهمية جهاز الادعاء العام العراقي ومراحل تطوره منذ عام 1918 وحتى صدور القانون رقم (49) لسنة 2017،كما بينت هذه الدراسة الدور المهم للادعاء العام في تمثيل المجتمع ومراقبة حسن تطبيق القوانين ذات العلاقة بالصالح العام وما اضافة القانون الجديد رقم (49) لسنة 2017 من مهام وصلاحيات جديدة لهذا الجهاز الفعال كالطعن في دستورية القوانين والتحقيق في قضايا الفساد المالي والاداري في دوائر الدولة .
كما بينت هذه الدراسة اهم اوجه الاختلاف بين القانون القديم رقم (159) لسنة 1979 وبين القانون الجديد رقم 49 لسنة 2017 من حيث تشكيلة هذا الجهاز ام من حيث المهام والصلاحيات.
وفي الختام بينت هذه الدراسة اهم النتائج التي تم التوصل اليها بهذا الصدد كذلك اهم التوصيات التي يمكن من خلالها تلافي النقص او الخلل الذي اعترى تشريع هذا القانون.
