The fundamentalist effort of Sheikh Muhammad Hassan al-Najafi in his book “Jawahir al-Kalam” - commands and prohibitions as a model

Abstract

The science of the fundamentals of jurisprudence is one of the mechanical sciences that the scholar uses to reach the legal ruling, hence our scholars have paid great attention to this science, and among those scholars is Sheikh Muhammad Hassan Al-Najafi (may Allah be pleased with him), who has studied the fundamentalist issues and rules in his book Jawahir al-Kalam, as he did not find a book of his own.
Hence, the researcher tried to explain those fundamentalist structures adopted by Sheikh Muhammad Hassan Al-Najafi in his jurisprudential reasoning, limiting it to the premises of commands and prohibitions in order to understand and explain them well, and the research was organized on an introduction, three topics, a conclusion, and then a list of the most important sources and references adopted in the research.

يعد علم أصول الفقه من العلوم الآلية التي يستخدمها الفيه للوصول إلى الحكم الشرعي , ومن هنا فقد اهتم علماؤنا بهذا العلم اهتماما كبيرا , ومن جملة أولئك العلماء هو الشيخ محمد حسن النجفي (قده) , إذ بحث المسائل والقواعد الأصولية في كتابه جواهر الكلام , إذ لم يعثر على كتاب أصولي خاص به .
ومن هنا , حاول الباحث بيان تلك المباني الأصولية التي اعتمدها الشيخ محمد حسن النجفي في استدلاله الفقهي مقتصرا في ذلك مباني الأوامر والنواهي لاستيعابها وبيانها بشكل جيد , وقد انتظم البحث على مقدمة وثلاثة مباحث وخاتمة ثم قائمة بأهم المصادر والمراجع المعتمدة في البحث .

Abstract

There are many claims of the consensus of the Imamiyyah on the issue of the impermissibility of a man to look at anything except the face and hands of a foreign woman, and the author of "Masalik al-Fahm" stated that it is the subject of consensus among Muslims, and the author of "Jawahir al-Kalam" confirmed that it is necessary for madhhab and religion.
A number of great scholars have relied on this premise, i.e., the consensus that claims or necessity, and they did not bother to inference from the technical jurisprudential inference of the science of ruling, and it may be said that it is nothing less than the proof of peace, even if the ruling is not necessary, but what is learned from the jurisprudential review of this branch is that this ruling is peaceful.

تعددت دعاوي إجماع الإمامية على قضية عدم جواز نظر الرجل إلى ما عدا الوجه والكفين من المرأة الأجنبية , وذكر صاحب (مسالك الافهام) أنه موضع وفاق بين المسلمين , كما اكد صاحب (جواهر الكلام) أنه من ضروري المذهب والدين .
وقد استند على هذا المبنى عدة من الاكابر , اقصد إلى الإجماع المدعي , أو الضرورة , فلم يتجشموا عناء الاستدلال الفقهي الفني علم الحكم , ولعله قد يقال : إنه لا اقل من ثبوت التسالم فحتى لو لم يكن الحكم ضروريا غير أن المستفاد من المراجعة الفقهية لهذا الفرع أن هذا الحكم متسالم فقهيا عليه .

Permissibility in terms of it is a concept that is related to the construction of rules and grammatical principles in terms of regularity, guidance, and explanation, and in terms it is a term that is related to the behavior of the speaker, and comes to expand the options available to him in the use of a combination of structure and meaning, often in the form of expansion of the chosen judgment in a particular use, and required by the rules and grammatical principles.
Permissibility in terms of being a standard judgment – as one of the pillars of grammatical analogy – has two different natures, one of which is a ruling with a fixed and abstract value, which results in structures of equal strength, and Al-Suyuti called it the ruling of the unjust as well.

والجواز من حيث هو حكم قياسي – بوصفه ركنا من أركان القياس النحوي – له ماهيتان مختلفتان , أحدهما : حكم ذو قيمة ثابتة ومجردة , ينتج عنه تراكيب متساوية في القوة , وسماه السيوطي حكم الجائر على السواء.

The research aims to show the role that factors affecting ethical marketing decision-making can play in improving the marketing work ethics of organizations as an important marketing strategy that contributes to enhancing success and excellence in the field of business, and three private hospitals in Najaf Al-Ashraf Governorate have been selected (Al-Ghadir Al-Ahli Hospital, Al-Amir Al-Ahli Hospital, and Ibn Bilal Al-Ahli Hospital) to be a field of research. 65 questionnaire forms were distributed to the employees of these hospitals, of which 25 forms were retrieved that were valid for analysis, and statistical operations were conducted on them for the purpose of reaching the results of the research, and the researchers reached a set of conclusions in the light of the research results and concluded the research with a set of recommendations.

يهدف البحث الى بيان الدور الذي يمكن أن تلعبه العوامل المؤثرة على صنع قرارات التسويق الأخلاقي في تحسين أخلاقيات العمل التسويقي للمنظمات بوصفه استراتيجية تسويقية مهمة تسهم في تعزيز النجاح والتميز في ميدان الأعمال , وتم اختيار ثلاثة مستشفيات أهلية في محافظة النجف الأشرف وهي (مستشفى الغدير الأهلي , مستشفى الأمير الأهلي , ومستشفى ابن بلال الأهلي) لتكون ميدانا للبحث , إذ وزعت 65 استمارة استبيان على موظفي تلك المستشفيات استعيد منها 25 استمارة كانت صالحة للتحليل , وأجريت عليها العلميات الإحصائية لغرض الوصول الى نتائج البحث , وتوصل الباحثان إلى مجموعة من الاستنتاجات في ضوء نتائج البحث وختم البحث بمجموعة من التوصيات .

Sewage waste is one of the most prominent sources of pollution of river water within cities, because it contains harmful chemicals and biological substances and toxic substances that are difficult to decompose, these wastes run through the public sewage networks (heavy and rainy) in the city, which include the waste of water from homes, hotels, hospitals, restaurants, institutions or similar facilities, as well as rainwater and water used in washing roads, public squares and car washes. Most of the products of these wastes consist of toxic substances, heavy metals, chemical and organic compounds, germs and viruses, as well as being rich in salts, especially brown salt, used in washing powders and cleaning materials used in homes.
