Abstract
Everyone knows that marriage is a sacred relationship based on a set of respectable moral principles derived from the religious and societal values that societies have followed.
Marriage represents a sacred religious bond and rejects any idea that comes into it and distorts this bond, as is the case with wife-swapping, this phenomenon that emerged in the West among the dissolute groups that do not have values, principles or ethics to which they adhere, but rather were led astray and succumbed to their desires by establishing deviant sexual relationships that are not accepted by the soul or by morals. It is at least a four-way relationship, or rather group sex, based on the consent of these parties and their agreement to exchange wives for the purpose of sexual enjoyment, and one of them becomes the husband of the other’s wife for a temporary period, and this can be repeated whenever the consent of these parties is available.In fact, it is an idea that is foreign to our society and came as a result of the openness that has recently occurred, whether in Iraq or in the Arab and Islamic countries, perhaps because of the availability of the Internet and the transformation of the world into a small village. لا يغب عن الجميع أن الزواج علاقة مقدسة تقوم على مجموعة من المبادئ الأخلاقية المحترمة المتأتية من القيم الدينية والمجتمعية التي سارت عليها المجتمعات .
أن الزواج يمثل رابطة دينية مقدسة وتنبذ كل فكره طارئة عليها تشوه هذهِ الرابطة كما هو الحال في تبادل الزوجات هذهِ الظاهرة التي برزت في الغرب لدى الفئات المنحلة التي ليست لها قيم أو مبادئ أو أخلاقيات تلتزم بها بل انجرت ورضخت لشهواتها بإقامة علاقات جنسية منحرفة لا تتقبلها النفس ولا تتقبلها الأخلاق ، فهي علاقة رباعية على الأقل او بالأصح جنس جماعي يقوم على أساس الرضا لهذهِ الإطراف وموافقتهم أن يتبادل زوجين لنسائهم بغرض الاستمتاع الجنسي ويصبح احدهما زوجاً لزوجة الآخر لفترة مؤقتة وبالإمكان إعادة ذلك كلما توفر الرضا من هذهِ الإطراف .
في الحقيقة هي فكرة دخيلة على مجتمعنا جاءت نتيجة الانفتاح الذي حصل مؤخراً سواء في العراق أو في الدول العربية والإسلامية ربما بسبب توفر الانترنت وتحول العالم إلى قرية صغيرة بضغطة زر يمكنك التواصل مع كل العالم وهذا الاطلاع غير المدروس من الممكن أن يُوقع البعض بهذهِ الأفعال المشينة كذلك حب التقليد ممكن يساعد في انتشار هذهِ الظاهرة من خلال مشاهدة المواقع الإباحية التي تروج لهذهِ الأفكار المشينة بالتالي تُزرع في عقول من يتابعون ذلك وبالتالي تبرز الرغبة في تطبيقها على ارض الواقع ، ذلك مما جعل القضاء العراقي في أول حالة تصل لعلمه من هذا النوع في حيرةً من أمره لعدم وجود نص قانوني واضح يُعالج هذهِ الحالة في قانون العقوبات العراقي وكذلك في قانون مكافحة البغاء قبل تعديله ، مما أضطره للاجتهاد وتكييفها وفقاً للمادة (٣٨٠) من قانون العقوبات العراقي النافذ
