إن الاستثمار في أسواق الأوراق المالية يتطلب بيئة استثمارية ملائمة وآمنة تحقق رغبة المستثمرين في تلك الأسواق، وهذا لا يتحقق إلا من خلال تحقيق أفضل السبل؛ لتسهيل عملية تداول تلك الأوراق، وزيادة حجم الاستثمارات، وإذا كان الأمر كذلك فقد حظرت القوانين الوضعية بعض الجرائم المتعلقة ببورصة الأوراق المالية والتي من شأنها أن تعرقل مسيرة الاستثمار في تلك الأسواق، ومن هذه الجرائم إفشاء المعلومات الداخلية في بورصة الأوراق المالية، ولذا كان لابد من معالجة هذه القضية، مع ذكر التدابير والاحترازات التي تقلص من هذه الجريمة إن لم تقض عليها نهائياً، ثم ذكر العقوبات المتعلقة بها.
