Abstract
The right of ownership is a sacred right, and it may not be infringed upon except to the extent that the owner transgresses the limits of the social function of ownership. He is free to use, exploit, and dispose of his property within the limits of the law and applicable regulations.
However, the legislature has restricted this right's freedom to dispose of his property, allowing a partner in a jointly held property to seize it by force if he disposes of it to a third party without informing them of his desire to sell. This right is called the "right of preemption."
The Iraqi legislature has significantly limited this right, restricting it to the partner in a jointly owned house or apartment. Thus, it has excluded agricultural lands owned in common, whether they are owned outright or state-owned, and the right to dispose of them is vested in individuals.
It did so based on the premise that preemption is an exceptional right intended to restrict the owner's freedom to dispose of his property. Therefore, it carefully defined its procedures and outlined what the preemptor must do from the time he announces his desire to exercise preemption until a ruling is issued.
Such a ruling is not mandatory, as it may occur by mutual consent between the buyer and the pre-emptor without judicial intervention, unless the buyer refuses to accept, in which case the court shall have the final say.
The Iraqi legislature considers the pre-emption claim to be an urgent claim. Therefore, it sets a specific period within which the pre-emptor must declare his desire to acquire the property by pre-emption after being notified by the seller, buyer, or the Real Estate Registration Department. He must initiate the claim and deposit half the actual price of the property sold in the court's treasury.
The legislature did not make this conditional on the pre-emptor's intention to use the failure to notify him of the sale as a means of choosing the time to initiate his claim. Rather, it set a period for the final expiration of the right of pre-emption after six months from the date of registration of the property with the relevant department, whether the pre-emptor is aware of it or not. This is to protect the legal positions of the buyer and seller from remaining precarious and unstable pending the application for pre-emption.
If the preemption right is exercised by consent or court order, the preemptor replaces the buyer in all rights and obligations toward the seller. If the buyer constructs any new buildings on the property subject to the preemption right before the preemptor notifies the buyer of his intention, the preemptor must pay the buyer their value.

Abstract
حق الملكية حق مقدس ، ولا يجوز المساس به ، الا بالقدر الذي يخرج فيه المالك عن حدود الوظيفة الاجتماعية للملكية ، فهو حر في استعمال ملكه واستغلاله والتصرف فيه في حدود القانون والانظمة المرعية.
ومع هذا ، فأن المشرع قيد حريته في التصرف بملكه ، اذ اجاز للشريك في المال الشائع ان يأخذه جبرا عليه ، اذا ما تصرف فيه الى الغير دون أن يعلمه برغبته في البيع ، ويسمى هذا الحق ب " حق الشفعة".
والمشرع العراقي قلص الى حد كبير هذا الحق ، وقصره على الشريك في دار السكن أو الشقة السكنية الشائعة فحسب ، وبهذا فقد استبعد الاراضي الزراعية المملوكة على الشيوع سواء كانت مملوكة ملكا صرفا ، او اميرية مملوكة للدولة وحق التصرف فيها للأفراد.
وهو فعل ذلك منطلقا من ان الشفعة حق استثنائي ، يراد منه تقييد حرية المالك في التصرف بملكه، لذا حدد اجراءاتها بعناية ، ورسم لما يجب على الشفيع القيام به منذ اعلان رغبته بالأخذ بالشفعة ، ولحين صدور حكم فيها.
وليس لزاماً أن يصدر مثل هذا الحكم ، اذ يجوز حصول ذلك رضاءً بين المشترى والشفيع دون تدخل القضاء ، الا اذا امتنع المشتري عن قبول ذلك ، فيبقى للقضاء القول الفصل.
وعدّ المشرع العراقي دعوى الشفعة من الدعاوى المستعجلة ، لذا حدد للشفيع مدة معينة يجب أن يعلن فيها عن رغبته بأخذ العقار بالشفعة بعد انذاره من البائع
أو المشتري أو دائرة التسجيل العقاري ، وان يبادر الى اقامة الدعوى وايداع نصف الثمن الحقيقي للعقار المبيع في صندوق المحكمة.
ولم يعلق المشرع ذلك على ارادة الشفيع ، من ان يتخذ من عدم انذاره بالبيع وسيلة لاختيار الزمان الذي يحرك فيه دعواه ، وانما حدد مدة لسقوط حق الشفعة نهائيا بمضي (ستة) أشهر على تاريخ تسجيل العقار لدى الدائرة المختصة سواء علم الشفيع بذلك أم يعلم ، حفاظا على المراكز القانونية للمشتري والبائع من أن تبقى قلقة غير مستقرة انتظار لطلب الشفعة.
واذا ما اخذ بالشفعة رضاء أو قضاء ، فأن الشفيع يحل محل المشتري في جميع الحقوق والالتزامات بمواجهة البائع ، واذا ما احدث المشتري مشيدات في العقار المشفوع به قبل اعلان الشفيع لرغبته ، فيتعين على الشفيع تأدية قيمتها للمشتري.
