The jurisprudential role of the provisions of the Court of Cassation occupies a distinct role in the formulation of the legal base, thanks to the role exercised by this court in adapting the civil law in light of the continued changing conditions of society with the survival of the rigidity that characterizes the legal base, so that the legislator, no matter how accurate and perfect in his work in drafting the legal base, he cannot surround everything and develop the necessary solutions to all new issues that appear in society, so the courts are keen through jurisprudence.

The lease contract is one of the widely used consensual contracts that individuals have dealt with in all times and ages. It imposes reciprocal obligations on both parties to the contract, in terms of the possibility of the lessor exploiting his property and obtaining the financial return in exchange for maintaining his ownership of the rented property, regardless of the duration of the lease contract, in exchange for the tenant benefiting from and settling in the rented property throughout the term of the contract, in exchange for paying the agreed upon rent. However, this mutual benefit for both parties includes specific and specific legal terms and conditions in the event that the tenant, during his use of the rented property, proceeds to establish new constructions, plantings, or any other additions, whether with the landlord’s explicit or implicit consent or without his explicit consent and objection to establishing these new constructions. The provisions of the legal texts differed in dealing with these issues, whether in the Iraqi Civil Law or the Egyptian Civil Law, as well as the Lebanese Obligations Law in addition to the French Civil Law. The terms used by the judicial courts also differed in determining the nature of these new constructions and their types. This is due to the differences in the disputes presented to it, and what is required by the mechanism of filing the lawsuit and continuing its procedures until the implementation of the judicial ruling to claim the value of what was created by the tenant against the landlord. The ruling may be issued in favor of the tenant when he obtains appropriate compensation for the losses he incurred for establishing these innovations or in favor of the landlord through his ownership of these innovations at their value due for removal or other rulings.

Artificial intelligence is one of the most important results of technological development that is being implemented for the benefit of various societies. It contributes to economic development, saving time and effort, and accelerating production on the one hand, but on the other hand, it has produced many different solutions that are rising. The most prominent of these information was evident through its negative impact on intellectual property rights of its four types, which include patents, trademarks, copyrights, and trade secrets, as intelligence discovered many legal prohibitions that include copyrights and authorship, which developed questions about how to protect these optional rights. This is what generally defends countries in general and those concerned in particular to work on finding appropriate and purposeful solutions to establish artificial intelligence on intellectual property rights, and the most prominent of these solutions that were evident in the legal aspect through laws to protect personality and not to use or steal it by an unauthorized council, which includes artificial intelligence

The Constitution is the highest legal hierarchy in the country, and the laws issued must be compatible with it, otherwise they will be considered unconstitutional and provisions and articles that conflict with it must be repealed.
The Federal Supreme Court was established in Iraq after 2003. It passed through two stages, the first of which was through the Iraqi State Administration Law for the Transitional Period of 2004, and the second was with the issuance of the Constitution of the Republic of Iraq of 2005, in accordance with the amended Federal Supreme Court Law No. (30) of 2005. By Law No. (25) Of 2021. To be the highest court in the Iraqi judicial system and to assume the task of ensuring respect for the provisions of the Constitution and work to establish the principle of the rule of law through its constitutional oversight of laws and interpretation of its provisions in addition to other powers held for it in accordance with its own law.
As a comparative study with Iranian law, the Supreme Court in the Islamic Republic of Iran, we find that this court is the highest judicial authority in the country as well, and it was formed based on the text of Article (161) of the amended Iranian Constitution of the year (1979) (The Supreme Court is formed for the purpose of supervising... The correct implementation of laws in the courts, ensuring the unity of judicial procedures, and performing any other responsibilities assigned to it under the law, in accordance with regulations established by the head of the judicial authority), and among its overall basic tasks is to monitor the correct implementation of laws in the courts, achieve unity of judicial procedures, and carry out the responsibilities assigned to it.

The change of the insured's domicile has implications for legislative jurisdiction, as the latter can move from one law to another and can remain within the framework of one law, which raises a very important issue in the legal system due to the overlap of more than one legal system and the disparity of provisions between them, which raises challenges and difficulties in determining the applicable law in insurance contracts, and this issue takes on dimensions within the framework of Iraqi, Egyptian and Iranian law, as each of these countries differs in its interpretation and application of the laws concerned with the change of domicile. In Iraq, the change of the domicile of the insured is dealt with under the umbrella of civil and commercial laws that involve the overlap of procedural aspects with the objective and the procedural rules with the procedural. As for Egypt, the civil law provides a detailed framework that addresses how to deal with such cases, with a special focus on protecting the rights of the insured and others. As for Iran, religious and civil laws are combined to form a legal fabric that deals with insurance issues and change of domicile in complex and unique ways, as this topic will be researched to clarify how these three countries address the issue of the change of the domicile of the insured and its impact on the applicable law, by analyzing the legislative frameworks And the relevant judicial, the research will also include a comparison between these legal systems to understand the approaches to overlap and disparity in the methods of dealing with this issue that poses fundamental challenges for insured persons, companies and regulatory authorities alike.
