Abstract

The current study seeks to show the importance of spatial data, and its effective role
in the sustainability of the projects managed by organizations, the study also aims to
identify the extent of the impact and effectiveness of their use in data management
and decision-making and how to deal with it. The study is trying to answer the
following questions
1-Is it possible to apply and the sustainability of the Geographic Information System
(GIS) in decision-making by applying cloud computing process?
To answer the questions have been relying on previous studies in improving the
performance of the (SDSS) and increase the security of information and the
possibility of access to information with ease, and reached the study to the group's
conclusions, including: is the subject of the GIS of the important systems in the
sustainability of the projects, especially after linking Management System leading to
increase the efficiency and effectiveness of the implementation of these projects and
sustainability on the other hand by taking administrative decisions related to
geographical indications for this system.

تسعى الدارسة الحالية إلى بيان أهمية البيانات المكانية ودورها الفاعل في استدامة إدارة المشاريع من قبل ،(spatial data)
المنظمات، كما تهدف الدارسة إلى التعرف على مدى فاعلية وتأثير استخدامها في إدارة البيانات واتخاذ القرارات وكيفية التعامل
معها. وتحاول الدارسة الإجابة على التساؤلات الآتية :
في عملية Geographic Information System (GIS) -5 هل بالإمكان تطبيق وضمان استدامةنظام المعلومات الجغ ا رفي
اتخاذ الق ا رر من خلال توظيف الحوسبة السحابية ؟
(SDSS) Spatial وللإجابة عن التساؤلات تم الاعتماد على الد ا رسات السابقة في تحسين اداء نظام دعم الق ا ر ا رت المكانية
وزيادة امنية المعلومات وامكانية الولوج الى المعلومات بكل سهولة ، وتوصلت الدارسة إلى Decision Support System
مجموعة استنتاجات أهمها : يعد موضوع نظام المعلومات الجغ ا رفي من الانظمة المهمة في استدامة المشاريع خصوصا بعد
ربطه بالانظمة الادارية مما يؤدي الى زيادة كفاءة وفاعلية تنفيذ هذه المشاريع واستدامتها من جهة اخرى من خلال اتخاذ الق ا ر ا رت
الادارية المرتبطة بالبيانات الجغ ا رفية لهذا النظام .

Abstract

Micro-projects add value to the economy of the country by creating jobs,
enhancing purchasing power and reducing costs. It is a tool for planning the
participation of individuals in the economic environment. Islamic banks play a
major role in promoting these projects through financing.
The research aims to identify the determinants of the relationship between
Islamic banks and micro-projects, and the role of these banks in the sustainable
development of micro-projects.
This research provides readings of the theoretical background of the concept of
financing micro-projects and means of application in the Iraqi market in
coordination with Islamic banks to achieve sustainable development.
The researchers rely on the descriptive approach in comparing the benefits of
the relationship between Islamic banks and micro-project and their role in achieving
sustainable development, and developing new financing methods.
The researchers conclude several results, the most important one is that the
relationship between Islamic banks and micro-projects can make a positive
difference for the beneficiaries by increasing the per capita income, in addition to
increase the individual's sense of belonging to the surrounding environment.
On the other hand, the profits of Islamic banks can be increased by reducing
the risk of financing by fragmentation and thus reducing the expected losses and
increasing the opportunities for financial investment and entering financial returns
to the Iraqi economy, which suffers from a deficit due to lower oil prices
internationally, and encouraging citizens in Iraq to invest their funds inside Iraq.
Micro-projects provide a bright image of social responsibility that can be
provided by Islamic banks in Iraq.

إن الهدف من هذا البحث هو التعرف على محددات العلاقة بين المصارف الإسلامية و المشاريع المتناهية في الصغر و
دور تلك المصارف في التنمية المستدامة للمشروعات متناهية الصغر.
يقدم البحث ق ا رءات للخلفية النظرية لمفهوم تمويل المشاريع المتناهية في الصغر ووسائل تطبيقها في السوق الع ا رقي
بالتنسيق مع المصارف الإسلامية لتحقيق التنمية المستدامة، حيث إعتمد الباحثان على المنهج الوصفي في مقارنة فوائد العلاقة
بين المصارف الإسلامية و المشاريع المتناهية في الصغر ودورهما في تحقيق التنمية المستدامة ، وكيف يمكن تطوير أساليب
تمويلية جديدة.
توصل الباحثان الى عدة نتائج أهمها أن العلاقة بين المصارف الإسلامية و المشاريع المتناهية في الصغر يمكن أن
تحدث تغيي ا رً إيجابياً للمستفيدين مالياً من خلال زيادة دخل الفرد، بالإضافة الى زيادة إحساس الفرد بإنتمائه الى البيئة المحيطة
به، ومن ناحية أخرى يمكن زيادة أرباح المصارف الإسلامية من خلال تقليل مخاطر التمويل وذلك بتجزئته وبالتالي تقليل
الخسائر المتوقعة وزيادة فرص الإستثمار التمويلي وادخال عوائد مالية للإقتصاد الع ا رقي الذي يعاني من عجز نتيجة إنخفاض
أسعار النفط دولي اً، وتشجيع المواطنين في الع ا رق على إستثمار أموالهم داخل الع ا رق، كما أن تشجيع المشاريع المتناهية في
الصغر يقدم صورة مشرقة للمسؤولية الإجتماعية التي يمكن أن تقدمها المصارف الإسلامية في الع ا رق.

field of E-Judiciary. Therefore, by using electronic certification, the data will be more secure and
accurate than the old way (traditional way). Moreover, electronic certification reduces the

الالكترونية العامة مجال ليس من السهولة تحديده. والقضاء الالكتروني وبشكل خاص التصديق الالكتروني احد اهم الخدمات
التي يجب توافرها ودعمها في المجتمعات الذكية سواء في الدول المتطورة او النامية على حد سواء. والقضاء الالكتروني واحد
من اهم المجالات الحديثة في مجال الخدمات الالكترونية المعاصرة. والتصديق الالكتروني واحد من ام هذه التطبيقات الحديثة
في مجال القضاء الالكتروني. لذلك فإن باستخدام التصديق الالكتروني فان البيانات تكون أكثر أمنا ودقة من الحالة القديمة
)العادية(. حيث ان التصديق الالكتروني يقلل الوقت والمجهود والتكلفة من جهة ومحاولة تطوير الخدمات المقدمة في ظل التقدم

abilities, The project owner obtains sufficient material returns to enable her to become

الى تنمية مها ا رت وقد ا رت الم أ رة وتمكينها اقتصاديا من خلال مشاريع نسائية صغيرة تضمن لصاحبة المشروع الحصول على
عوائد مادية كافية تمكنها من الاستقلال اقتصاديا، فضلا عن ان هذه المشاريع تمكن مالكاتها من تنظيم وادارة العمل بشكل
شخصي مباشر وبأسلوب يضمن عدم التعارض مع مسؤولياتهن الأسرية، وقد توصل البحث الى عدد من الاستنتاجات التي

Abstract

Iraq is characterized by a unilateral economic system that relies on oil revenues. Oil is the main
source of finance for the state's treasury. More than 97% of revenues are oil revenues and almost
negligible non-oil revenues. This may be the main reason behind the financial crisis in Iraq today ,
Since the collapse of oil prices since mid-2014 through 2015 and 2016 until mid-2017 led to this
financial crisis, in addition to other factors helped to grow the crisis, including financial corruption
and lack of rationalization of spending.
Which led the state to reconsider its fiscal policy and followed the reform policy to eliminate
or at least alleviate the impact of the financial crisis. However, the reforms introduced by the
government were temporary, and most importantly, contrary to constitutional and legal rules. ,
Which has led many to seriously reflect on the search for ways to deal with this crisis and to reach
long-term radical solutions. The most effective solution may be to develop revenue sources,
eliminate financial corruption.

يمتاز الع ا رق بنظام اقتصادي أحادي الجانب، يعتمد على العوائد النفطية، إذ يمثل النفط المصدر الأساسي لتمويل الخزينة
العامة للدولة ، فاكثر من 97 % من الإي ا ردات هي إي ا ردات نفطية وتكاد لا تذكر الإي ا ردات غير النفطية، وقد يكون هذا السبب
الرئيسي و ا رء الأزمة المالية التي يعيشها الع ا رق اليوم ، إذ إن انهيار أسعار النفط منذ منتصف عام 5154 مرو ا رً بعام 5152 و
عام 5156 وصولاً إلى منتصف عام 5157 قاد إلى هذه الأزمة المالية ، بالإضافة إلى عوامل أخرى ساعدت على تنامي تلك
الأزمة منها الفساد المالي وعدم ترشيد الإنفاق .
الأمر الذي دفع الدولة إلى إعادة النظر في سياستها المالية وقد انتهجت في ذلك سياسة الإصلاح؛ وذلك للتخلص أو على اقل
تقدير تخفيف وطأة الأزمة المالية، إلا إن الإصلاحات التي جاءت بها الحكومة كانت حلول ترقيعيه مؤقتة والاهم من كل ذلك
الكثير منها كان مخالف للقواعد الدستورية والقانونية ، الأمر الذي دفع الكثيرين للتفكير بشكل جدي للبحث عن سبل مواجهة تلك
الأزمة ، والوصول إلى حلول حقيقة جذرية طويلة الأمد ، وقد تتمثل انجع الحلول ب ) تطوير مصادر الإي ا ردات ، والقضاء على
الفساد المالي ، وترشيد الإنفاق .

Abstract

The study dealt with the analysis of the reality of the cultural values of human capital and
technology factor, and to know the reality of the future of the banking industry in the Kurdistan
Region.
The banks in Kurdistan Region today face a great challenge. They work in a complex, volatile and
rapidly changing economic, political and social environment. This environment is characterized by
strong competition, openness, rapid developments, globalization, free market economies and the
emergence of competitive advantage based on the effective administrative model. The basic theme
that characterizes the environment today is the stability of one variable, variation. If banks want to
live in such an environment, they must to have the basic fundamentals that enable them to grow,
continue, and survive from the fact that banks do not live in a vacuum, but that they form an
integral whole with their human capital and affect each other. Because of the resulting changes in the contemporary banking environment, which are essentially based on the human capital
component that represents their infrastructure. The banks should move to increase the dependence
on individuals working in the first place.
The population of this study consists of administrators and employees in the governorates of Erbil
and Dohuk governorates. The number of sample members is estimated at (90) individuals. The
questionnaire was distributed on this sample and it was retrieved. The number of valid forms of
statistical analysis was (65) Analyzed by using the appropriate statistical tools. The sample was
characterized according to the data provided by its members by answering the questionnaire.

تواجه المصارف في اقليم كوردستان اليوم تحديا كبي ا رً، اذ تعمل في بيئة عمل معقدة متقلبة وسريعة التغيير اقتصادياً وسياسيا
واجتماعياً، وتتسم هذه البيئة بالمنافسة القوية والانفتاح والتطو ا رت المتسارعة والعولمة واقتصاديات السوق الحر وبروز الميزة
التنافسية المرتكزة أساساً على النموذج الإداري الفعال، فالسمة الأساسية التي تميز بيئة اليوم هو ثبات متغير واحد هو التغيير
وان المصارف إذا ما أ ا ردت العيش في هكذا بيئة فإن عليها أن تمتلك المقومات الأساسية التي تمكنها من النمو والاستم ا ررية
والبقاء انطلاقاً من حقيقة مفادها أن المصارف لا تعيش في ف ا رغ بل إنها تشكل مع بيئتها كلاً متكاملاً، ويؤثر أ رس مالها البشري
جميع العاملين ويتأثر به. بسبب التغيي ا رت الناتجة التي تحصل في بيئة المصارف المعاصرة، والتي تستند في جوهرها على
عنصر أ رس المال البشري الذي يمثل البنى التحتية لها . فإن على المصارف أن تتجه إلى زيادة الاعتماد على الاف ا رد العاملين
بالدرجة الاولى .
يتكون مجتمع هذه الد ا رسة من الإداريين و العاملين في مصارف محافظة أربيل ومحافظة دهوك ، ويقدّر عدد أف ا رد العينة
بحوالي ) 90 ( فردا ، ووزعت استما ا رت استبانه الد ا رسة على هذه العينة، وجرى استرجاعها، وقد تبين أن عدد الاستما ا رت
الصالحة للتحليل الإحصائي ) 65 ( استمارة، وجرى تحليلها باستخدام الأدوات الإحصائية المناسبة واتسمت العينة وفقا للبيانات
التى قدمها اف ا ردها من خلال الاجابة على استمارة الاستبيان .

Abstract

The issue of the global financial crisis that hit the world economy since August 2007 was one of
the worst economic crises after the Great Depression of 1929. This crisis was not the result of the
moment, but the most important of which is the negative impact of the Asian financial crisis in
1997 and the crisis of the information technology sector in 2000, This crisis has caused the rest of
the world due to interdependence. The recurrence of financial crises in developing countries is a
worrying phenomenon that has threatened the economic and political stability of the countries
concerned. The global economy is currently facing a real financial crisis that has hit the economies
of developed and developing countries alike, starting in 2008 and emerging in 2008.
The American financial crisis reflected on most of the economies of the world so that it became
implicated in the global financial crisis. As the Arab countries are part of the global economic
system, they will be negatively affected by this crisis. It is certain that the degree of their influence varies among the Arab countries according to their degree of integration and integration into the
global economy. Therefore, stepping out of them requires the intensification of the international
efforts to review the international monetary system, giving all countries the full economic and
political freedom to choose to link their currencies to an internationally agreed basket of
currencies .
The researcher tried here to explain how the global financial crisis has an impact on the economies
of developing countries. The research section is divided into three sections. The first topic dealt
with the global financial crisis in terms of concept, definition, characteristics and what types. The
second topic dealt with the causes of the financial crisis and what are the positive and negative
effects And the third topic dealt with the effects of the global financial crisis in the economies of
developing countries, and concluded the research with a set of conclusions and recommendations

يعد موضوع الأزمة المالية العالمية التي عصفت بالاقتصاد العالمي منذ أغسطس عام 5117 من اعنف الأزمات الاقتصادية
بعد أزمة الكساد الكبير عام 5959 ، وهذه الأزمة لم تكن وليدة اللحظة ، وانما لها جذور أهمها التأثير السلبي للازمة المالية
الأسيوية عام 5997 وأزمة قطاع تكنولوجيا المعلومات عام 5111 ، وامتدت أثار هذه الأزمة الى باقي أنحاء العالم بفعل الت ا ربط
. وافرز تك ا رر الأزمات المالية في الدول النامية ظاهرة مثيرة للقلق والاهتمام هددت الاستق ا رر الاقتصادي والسياسي للدول المعنية
. ويواجه الاقتصاد العالمي في الوقت ال ا رهن أزمة مالية حقيقية عصفت باقتصاديات الدول المتقدمة والنامية على حد سواء ،
. حيث بدأت بوادرها في سنة 5118 وبرزت أكثر سنة 5118
وانعكست الأزمة المالية الأمريكية على معظم اقتصاديات دول العالم حتى أنها أصبحت تلقب بالأزمة المالية العالمية ، وبما أن
الدول العربية جزء من منظومة الاقتصاد العالمي فإنها سوف تتأثر سلبا بهذه الأزمة . ومن المؤكد إن درجة تأثيرها تختلف بين
الدول العربية على حسب درجة ارتباطها واندماجها في الاقتصاد العالمي ، لذلك فإن الخروج منها يتطلب تكاثف الجهود الدولية
لإعادة النظر في النظام النقدي الدولي بما يعطي جميع الدول الحرية الاقتصادية والسياسية الكاملة في اختيار ربط عملاتها بسلة
عملات يتم الاتفاق عليها دوليا .
حاولت الباحثة هنا بيان كيف أن الأزمة المالية العالمية لها اثر على اقتصاديات الدول النامية ، فقد قسم البحث الى ثلاثة
مباحث ، حيث تناول المبحث الأول الأزمة المالية العالمية من حيث المفهوم والتعريف والخصائص وما هي أنواعها ، وتناول
المبحث الثاني أسباب الأزمة المالية وما هي الآثار الايجابية والسلبية لها وكيفية علاجها ، أما المبحث الثالث فقد تناول أثار

Abstract

The study explores the study of the economic reform paths in Iraq after 2003, in which many
options and various methods of economic reform were presented. The Iraqi government adopted
some of them in the hope of facing the challenges of the Iraqi economy, but these methods and
options have traditional. so the problem of research is based on two main points:
1. The multiplicity of economic reform options led to the dispersion of the visions and efforts of
economic decision makers.
2. Joining the global economy requires adopting a new economic philosophy that is compatible
with what exists in the outside world.
The research found that the multiplicity and divergence of the proposed economic reform
policies put economic decision makers in front of difficult choices due to the lack of a clear
development program with its time limits for the advancement of economic sectors. However, the
adoption of the knowledge economy approach has become a strategic necessity for comprehensive
economic reform in Iraq because of its interest in intellectual capital Which is the basis of the comprehensive reform process. Therefore, it is proposed to explore the possibility of
implementing the knowledge economy approach as one of the basic and strategic options for the

يتناول البحث بالتحليل د ا رسة مسا ا رت الاصلاح الاقتصادي في الع ا رق بعد عام 5113 ، والذي قدمت فيه العديد من الخيا ا رت
والاساليب المتنوعة للإصلاح الاقتصادي وتبنت الحكومة الع ا رقية بعضاً منها املا في مواجهة تحديات الاقتصاد الع ا رقي الا ان
هذه الاساليب والخيا ا رت غدت تقليدية وهذا ما نعبر عنه اليوم )مأزق الاصلاح الاقتصادي القديم( ، لذلك فأن اشكالية البحث
تقوم على نقطتين اساسيين هما :
5. ان تعدد خيا ا رت الاصلاح الاقتصادي ادت إلى تشتيت رؤى وجهود متخذي الق ا رر الاقتصادي.
5. ان الالتحاق بركب الاقتصاد العالمي يتطلب تبني فلسفة اقتصادية جديدة تتلاءم مع ما موجود بالعالم الخارجي .
توصل البحث إلى ان تعدد واختلاف السياسات الاقتصادية الاصلاحية المقترحة تضع متخذي الق ا رر الاقتصادي امام
خيا ا رت صعبة نتيجة لعدم اختيار برنامج تنموي واضح المعالم له سقوفه الزمنية للنهوض بالقطاعات الاقتصادية ، الا ان اتباع
منهج الاقتصاد المعرفي اصبح ضرورة است ا رتيجية للإصلاح الاقتصادي الشامل في الع ا رق وذلك لاهتمامه ب أ رس المال الفكري
والذي يعتبر اساس عملية الاصلاح الشامل. وعليه يقترح البحث امكانية تنفيذ منهج الاقتصاد المعرفي كأحد الخيا ا رت الاساسية
والاست ا رتيجية لعملية الاصلاح الاقتصادي الشامل.

Abstract

Deficit in the state budget is a problem facing developed countries before the developing ones.
It affects the economy in general and directly through their impact on macroeconomic variables.
The aspects of this effect are depending on the method of financing the deficit, so many
economists say that falling into the deficit stage is regarded as a major risk that must be avoided
and addressed. Most countries resort to adopting the traditional methods of dealing with this
problem like internal and external borrowing; issuing cash; withdrawing from reserves; Etc., as the use of traditional tools is easy to practice and has local effects but can be accompained by the
effects of the whole and is not a successful solution, but is to push the problem forward with
negative effects. While Islamic alternative is to finance the deficit using the mechanisms of the
Islamic economic system (Islamic instruments with its various and various forms like Murabaha,
partnership, Mudaraba and leasing, etc.
It is possible to find solutions to the budget deficit by the multiple aspects of Islamic financing
modes, which can be adapted to the need and requirements of the modern era. This research is
exposed to the tools of Islamic financing, their advantages which the researchers believes that it
outperforms the traditional counterparts.The research refer to the case of Iraq dificit and how to
use Islamic financial tools to manage it.The research also included some conclusions and
recommendations.

العجز في الموازنة العامة للدولة مشكلة تواجهها البلدان المتقدمة قبل النامية ،فتؤثر على الاقتصاد بشكل عام ومباشر من
خلال تأثيرها على المتغي ا رت الاقتصادية الكلية، وتتعدد أشكال هذا التأثير بحسب طريقة تمويل العجز ، لذا يعتبر كثير من
الاقتصاديين إن الوقوع في مرحلة العجز خطأ كبير يجب تجنبه ومعالجته فتلجأ معظم الدول إلى اعتماد الطرق التقليدية لمعالجة
هذه ألمشكلة وهي )الاقت ا رض الداخلي والخارجي ،السحب من الاحتياطي ،الإصدار النقدي ....الخ ( إذ يعد استخدام الوسائل
التقليدية اسهل عمليآ وله أثار محلية وآثار كلية ولا يعد حلآ ناجحآ بل هو دفع المشكلة إلى الأمام.
ان البديل الإسلامي لتمويل العجز يتم باستخدام آليات النظام الاقتصادي الإسلامي )الصكوك الإسلامية( بصيغها المختلفة
والمتعددة )الم ا ربحة ،المشاركة ،المضاربة ،الإجارة ،.....الخ ( إذ يمكن إيجاد الحلول لعجز الموازنة بتعدد صيغ التمويل
الإسلامي والتي يمكن تكييفها مع الحاجة ومتطلبات العصر الحديث ،وان هذا البحث يحاول التعرف على ‘طبيعة أدوات التمويل
الإسلامي وبيان م ا زياها التي يرى الباحثان أنها تتفوق على نظيرتها التقليدية وتتلافى سلبياتها.كما تضمن البحث التطرق الى
حالة العجز في الع ا رق وكيفية استخدام ادوات التمويل الاسلامي لمعالجتها .
وتضمن البحث بعض الاستنتاجات والتوصيات .

Abstract

The notion of jus cogens in international law encompasses the notion of peremptory norms in
international law. In this regard, a view has been formed that certain overriding principles of
international law exist which form “a body of jus cogens ”.These principles are those from which
it is accepted that no State may derogate by way of treaty.As a result they are generally interpreted
as restricting the freedom of States to contract while ‘voiding’ treaties treaties whose object
conflicts with norms which have been identified as peremptory.
Not only are the rules of the United Nations Charter contained, but they are also enshrined in
other international conventions and covenants whose purposes are the rule of international legality
and the implementation of the fundamental human rights and political and economic rights
guaranteed by the 1966 International Covenant on Civil and Political Rights, And the Convention
against Torture, as well as the provisions and advisory opinions of the international judiciary,
which confirmed the existence of rules of origin from their customary and customary sources.

يعني مفهوم القواعد الآمرة ،القواعد القطعية التي تشكلت بالاستناد إلى المبادئ الأساسية للقانون الدولي والتي لا يجوز
اغفالها عند إب ا رمها معاهدة دولية. ونتيجة لذلك ، تفسر عموماً بأنها تقيد حرية الدول في التعاقد، إذ يتم إبطال المعاهدات التي
يتعارض جوه رها مع القواعد التي تم وصفها كقواعد آمرة. إن نطاق ومضمون مفهوم القاعدة الآمرة كان قد خضع طويلاً لحو ا رت
، فقهية داخل المجتمع القانوني، وقد تم التوصل إلى توافق في الآ ا رء بشأن التعريف خلال مؤتمر فينا الذي عقد في عام 5969
وتم تدوينه في المادة ) 23 ( من اتفاقية فينا لقانون المعاهدات.
يكتسي هذا الموضوع أهمية لدى الدول بهدف توضيح مفهوم القواعد الآمرة في قواعد ، ومن ثم توضيح بعض الجوانب
القانونية للقواعد الآمرة التي من شأنها أن تيسر التوصل إلى تسوية الن ا زعات الدولية ، وبشكل يمنع انتهاك حقوق الإنسان .
ولم يقتصر ورود القواعد الأمرة في ميثاق الأمم المتحدة، وأنما تضمنته اتفاقيات وعهود دولية أخرى كانت مقاصدها سيادة
الشرعية الدولية ، وضمان تطبيق حقوق الإنسان الأساسية والسياسية والاقتصادية التي تضمنها كل من العهد الدولي الخاص
للحقوق المدنية السياسية لعام 5966 ، والعهد الدولي الخاص للحقوق الاقتصادية لعام 5966 ، واتفاقية مناهضة التعذيب ،
فضلاً عما أكدته أحكام وفتاوى القضاء الدولي عن وجود القواعد الأمرة من مصدريها الاتفاقي والعرفي .

Abstract

The child is the bud of life and the right of life in this life is a fundamental right, from which
several rights are protected and surrounded by safety until he reaches the age that makes him
physically, mentally and psychologically qualified to take over his duties and his duties towards his
society and the direction of others.
The rights of the child to protection have been little or significant since the inception of the
first human being. However, the need for development and the protection of the human race that
human senses have begun to create different rights for the child do not in themselves constitute real
protection for them . Until it culminated in the era of Islamic light, which embodied the highest
forms of protection for this sensitive vulnerable group in society.
Voices from around the world called on States to actively intervene through criminal texts to
ensure the child's right to be protected from ill-treatment, especially after the international
community has issued numerous international instruments and declarations dealing with the rights
of the child. The most important of these are the 1989 Convention on the Rights of the Child, On
the life and development of the child as well as the preservation of his identity and his right to
education, health and comfort and to have a standard of living adequate for its growth as well as
protect it from exploitation and all kinds of violence.
Sexual violence against children involving a child under the age of 18 years, rape or exploitation
of sexual activity is not fully understood and can not be granted. The conduct of the offender is
contrary to the laws, customs, traditions and customs of the community. The child's physical and
mental health, mental, psychological and social well-being are seriously jeopardized. The child is
characterized by weak physical strength and poor mental abilities. Therefore, the international
system should have called upon the ratifying States to protect the rights that have been adopted in
favor of the child With special criminal provisions to protect him from crimes of sexual violence.

يعد الطفل برعم الحياة وغدا حقه في هذه الحياة حقا أساسيا تتفرع منه عدة حقوق تحميه وتحيطه بالأمان حتى يبلغ السن التي
تجعله مؤهلا جسديا وعقليا ونفسيا لتولي أموره والتعرف على واجباته اتجاه مجتمعه واتجاه الآخرين.
ولم تكن حقوق الطفل في الحماية شيئا يذكر أو يشكل أهمية منذ نشأة الإنسان الأولى، إلا أن الحاجة إلى التطور وحماية
الجنس البشري التي استشعرها الإنسان بدأت تنشئ حقوقا متفاوتة للطفل لا تشكل في حد ذاتها حماية حقيقية له واستمرت هذه
الحقوق بالتطور والتنامي كلما تقدمت الحضارة وتقدم الفكر الإنساني، حتى بلغ ذروته في عصر النور الإسلامي الذي جسد
أسمى صور الحماية لهذه الفئة الضعيفة الحساسة في المجتمع.
فتصاعدت الأصوات من مختلف أنحاء العالم تدعو الدول إلى التدخل بشكل فاعل من خلال النصوص الجنائية لكفالة حق
الطفل في الحماية من سوء المعاملة خاصة بعد إصدار النظام الدولي للعديد من المواثيق والإعلانات الدولية التي تعنى بحقوق
الطفل ومن أهمها اتفاقية حقوق الطفل لسنة 5989 التي دعت الدول إلى الحفاظ على حياة الطفل ونموه وكذا الحفاظ على
هويته وحقه في التربية والتعليم والصحة وال ا رحة وأن يحظى بمستوى معيشي ملائم لنموه وكذا حمايته من أي استغلال ومن
جميع أنواع العنف.
وان ارتكاب العنف الجنسي ضد الاطفال الذي لم يبلغ من العمر ثمانية عشرة سنة واغتصابه او استغلاله في نشاط جنسي لا
يستوعبه استيعابا كاملا ولا يستطيع اعطاء الموافقة عليه ، اذ يكون التصرف الصادر من الجاني ضده مخالفا لقوانين او
عادات وتقاليد واع ا رف المجتمع . يعرض سلامة وصحة الطفل البدنية والعقلية والنفسية والإجتماعية للخطر، فإنها تنطوي
على مساس خطير بالحقوق السالفة الذكر خاصة ، وأن الطفل يتميز بضعف قوته البدنية وضعف مقدو ا رته الذهنية ، كما
يشكل العنف الجنسي ضد الاطفال انتهاكا جسيما لحقوق الطفل ، فهي تمثل واقعا عالميا في جميع دول العالم ، لكن اصبحت
ظاهرة حقيقية تثير القلق وخاصة في الآونة الاخيرة وفي بعض الدول كالع ا رق وسوريا وليبيا غيرها من الدول الاخرى التي
اصبحت ظاهرة للعيان نتيجة الحروب والتهجير القسري والنزوح والفقر وغيرها من الاسباب الاخرى ، وهذا تستدعي العلاج
الفوري من خلال تدخل المشرع الجنائي في اغلب دول العالم ومنها القانون الع ا رقي والسوري موضوع بحثنا هذا، على تجريم
هذه الافعال حماية مجموعة من الحقوق والمصالح أهمها: حماية الحق في الحرية الجنسية للأنثى، فالجاني في هذه الج ا رئم
يُكره المجني عليها او عليه على سلوك جنسي لم تتجه إليه إ ا ردتها فيصادر بذلك حريتها الجنسية، وحماية الحق في سلامة الجسد والصحة النفسية والعقلية للضحية ، وحماية كيان الأسرة م الأخلاقي، وتحصين المجتمع من الأم ا رض الجنسية
والتناسلية على المست ن الانهيار وحماية النسل من الاختلاط وحماية الكيان الاجتماعي من آفة الفساد ويين الوطني والدولي
، وتجريم كل نشاط يأخذ صورة الاغتصاب واللواط او التحرش الجنسي او الاستغلال الجنسي في الدعارة او المواد الاباحية ،
ولما كان القانون الجنائي من الأدوات الأكثر توظيفا من ط رف الدولة وذلك لحماية الم ا ركز القانونية للأشخاص وحماية حقوق
الإنسان من الاعتداءات المحتملة وايمانا من المشرع الع ا رقي والسوري بأهمية الزجر والعقاب في حماية الأط ا رف الضعيفة داخل
المجتمع كالطفل مثلا، فقد تضمنت تشريعاتهم مقتضيات زجرية هامة تجرم كل فعل أو امتناع قد يترتب عنه شكل من أشكال
العنف الجنسي ضد الاطفال. ومن هذا المنطلق إذن ومن خلال استق ا رء نصوص القانون الجنائي لكل من الع ا رق وسوريا وكذا
بعض النصوص الزجرية الواردة في قوانين أخرى أو بصفة مستقلة تركزت بحثنا المعنون ب ) العنف الجنسي
ضد الاطفال( " د ا رسة مقارنة " وارتأينا تقسيم بحثنا هذا الى مبحثين ، اذ تطرقنا في الاول منها الى ماهية العنف الجنسي ضد
الاطفال وقسمناها الى مطلبين ففي الاول بحثنا في مفهوم العنف الجنسي ضد الاطفال وفي الثاني بينا الاسباب المؤدية لهذه
الجريمة ، اما في المبحث الثاني بحثنا انواع الج ا رئم العنف الجنسي وفي ثلاثة مطالب بحثنا في الاول جريمة اغتصاب
الاطفال وفي الثاني هتك عرض الطفل وفي الثالث الاستغلال الجنسي للأطفال . وختمنا بحثنا بأد ا رج اهم الاستنتاجات
والتوصيات التي توصلنا اليه.

Abstract

Developing countries have established promising e-Government initiatives with the
objectives of enhancing the accessibility of government services and information for
their citizens.
Purpose: This research attempts to explore and investigate the key challenges and
Issues that facing e-government adoption and the factors influencing citizen in Iraq.
Methodology: The research depended on qualitative approach, the participants
comprised undergraduate and postgraduate students at Baghdad university because
university students are amongst the adult population for whom the Internet has
become part of their daily routine. population of 369, Potential participants for the
focus groups were identified from the questionnaire survey.
Finding: The findings show that Trust and Awareness significant and direct
relationship with adoption of e-government in Iraq. Corruption was found to have
significant and negative relationship with the adoption of e- government.
