Abstract: Knowledge is like light،weghtless and textureless،and easy to move across oceans and nations،to illuminate the live of peoples ،the stock of Knowledge may be much more important than the stock of wealth in countries to advance their reality.
In order to achieve the principle of ensuring public and private rights based on transparency, integrity and justice, and as a result of the tendency of countries suffering from the scourge of corruption to find various solutions and reforms to improve the performance of government institutions in various fields through means characterized by integrity, transparency and accountability, and by focusing on modernization and administrative reform programs in various sectors, they had no choice but to seek to focus on the public service as it is the basic nucleus for the spread of corruption in its various forms. This endeavor was manifested by emphasizing the adoption of transparency procedures in the field of public service by limiting appointment, reappointment, promotion and promotion, etc.
As an independent body that exercises powers in accordance with the aforementioned principles, the legislator granted the Federal Public Service Council the authority to appoint and reappoint in state institutions by stating the Council’s work strategy in the areas of public service with the tasks assigned to it in an effort to achieve the principle of equality in assuming public office and adopting multiple methods for selecting employees.

Abstract: The study aimed at clarifying the legal provisions for dropping the penalty and the special provisions that it entails, whether in its substantive or procedural aspect, as special texts were devoted to it within the framework of the Iraqi Traffic Law No. (8) of 2019, different from those texts that came in the Penal Code The amended Iraqi No. (111) of 1969, which reflected the pattern of modern trends in dealing with traffic accidents, In addition, the study aimed to clarify the specificity of traffic crimes in their procedural aspect, which embodied the specificity of criminal reconciliation in light of these incidents, and the special provisions involved in it, different from the provisions stated in the Iraqi Code of Criminal Procedure No. (23) of 1971, as amended, In addition, the study showed the limits of the judiciary’s discretion to drop the penalty by extrapolating and analyzing judicial rulings. The researcher reached a number of conclusions and recommendations, the most important of which was that the application of the provisions of dropping the penalty that deprives of freedom should not be limited to the deadly trampling crimes, but rather the necessity of including the provisions of Article (35) with that, and not limiting the application until the end of the investigation and trial and the issuance of the judgment, but rather the need to expand this system to include The stage of investigation and trial in order for the courts and the parties to the case not to work with lengthy procedures, and then the result is the ruling to drop the freedom-depriving penalty.

It is known that a legal person is either a human being or a legal entity consisting of a group of individuals or funds seeking to achieve a specific goal and possessing the legal personality necessary to achieve this goal. The party cannot carry out the functions and tasks assigned to it unless it is treated like natural persons, with the difference. Therefore, states intend to grant the political party a legal legal personality in order for it to carry out the duties assigned to it and in order for it to enjoy the rights granted to it in accordance with the law.
The legal personality granted to the political party has its own specific framework in accordance with the law, and the party cannot exceed this framework. The law has defined the boundaries of this personality from its establishment until its termination.

Abstract: The effectiveness of the rules of international law still does not rise to the level of effectiveness of the rules of national laws, due to the existence of an executive authority capable of obligating citizens to implement the law, as well as the existence of a legislative body that enacts the laws, and this is not found in international law, and therefore international law remains unable to influence and apply it, especially in recent events, as the world was surprised after Russia took military action against Ukraine on 2/24/2022 and after President Putin\'s speech, and entered its territory from more than one side, although this event was preceded by several threats from the Russian side against Ukraine, and this event has roots in the existence of previous differences between Russia and Ukraine, as Ukraine was one of the countries of the former Soviet Union in addition to Russia, and after the dissolution of the Soviet Union in 1990, Russia and Ukraine became independent countries with Sovereignty and contiguous, and Russia sees itself as the bearer of the legacy of the former Soviet Union, and the formation of the state of Ukraine resulted in a government loyal to Russia, and the situation continued until several demonstrations took place in Ukrainian cities denouncing the government’s loyalty to Russia and its failure to shift its orientation to the West, i.e. to the countries of Europe. These demonstrations and popular orientation resulted in the victory of parties and figures seeking a European orientation in the 2014 elections and distancing themselves from Russia, and this is what disturbed Russia and differences began to surface in Russian-Ukrainian relations, especially since the new government that emerged after the elections had a European orientation, this led to the escalation of the dispute and resulted in Russia’s occupation of the Crimean Peninsula in 2014 and holding a referendum for the purpose of annexing it to Russia despite the international community’s protest, which increased tension and hostility between Russia and Ukraine, which prompted the Ukrainian government to expedite the file of Ukraine’s accession to NATO, which represents a threat to Russia and the beginning of the war that is still ongoing until this research was written, and the victims that resulted from this war And great human and material losses, as well as its impact on the international community and casting its shadow on the effectiveness of international organizations, especially the United Nations, and its inability to find any effective solution, and even international justice has become helpless, so that the rules of international law have become useless, and even in deviating from international legitimacy.

Abstract: When applying applicable foreign law, the national judge will face the problem of ambiguity, lack of text or confusion in its meaning, which in this case requires the judge's interpretation. s mental process for determining the meaning of the rule of law, The jurisprudence differs in the role of the national judge in interpreting the competent foreign law, whether it is interpreted in accordance with the law or in accordance with the law of the foreign State. and one of the means of interpretation that can be used by a judge is internal means of interpretation from within the legal text, or externalities, such as travaux préparatoires, t orical sources, customs and customs The role of the Supreme Court in controlling the interpretation of the competent foreign law, after interpretation of foreign law and judgement, Is it acceptable to censor a national judge's judgement that misinterpreted foreign law or not? and whether there were certain exceptions in the latter case or wh ether the refusal to censor was general and absolute.

Abstract: The world is in continuous development as the wheel of life turns very quickly, so we notice from time to time the emergence of different explorations or inventions, casting their shadows on various areas of life, and technological development has become an inevitable matter imposed by the necessities of contemporary life, as the progress of countries is measured by the extent of their technological development, and the strength of countries is measured by economic strength and what they possess of hard currencies and gold reserves, and recently what is known as cryptocurrencies appeared in the monetary arena, as a result of the technological development that has affected the world, which has become aimed at converting everything electronic, and cryptocurrencies were first shown according to studies to an American mathematician, but the most prominent appearance was at the hands of a computer programmer named (Satoshi Nakamoto) and then it had a wide echo and was addressed by research and studies, and it became acceptable as a means of exchange as a currency, and by referring to the different doctrines, we find that the socialist doctrine did not accept it because it does not conform to its ideas and theories, while in the individual doctrine you find its basis because it calls for freedom and getting rid of the dominance of the state and central banks in the monetary and financial fields From a legislative perspective, we find that most legislations have not yet regulated it and have taken the path of criminalization, as is the case with the Iraqi legislator, and he explicitly indicated this when the Central Bank issued a law criminalizing dealing with it and considering it a form of money laundering.

Abstract: There is no legal state except with effective and real judicial oversight over the administration’s work that evaluates it and compensates for the damages resulting from its work. The administration cannot be left without restrictions or controls that operate within the frameworks drawn for it; Because giving it the right to be free in its actions may lead to a violation of the principle of legality and the foundations upon which the state is based, as well as flagrant violations of the rights of individuals. Since the plaintiff hopes to obtain the judgment, he hopes to implement it and arrange the legal consequences resulting from it and the scientific results that follow, so the judgments have no value unless they are implemented. Since the administration has sufficient means that enable it to implement judicial rulings, the failure to implement on its part raises its responsibility on the basis of the proven error in the refusal. Its responsibility is raised on the basis of responsibility without error in the case that if the abstention is outside the capacity of the administration because of a public burden imposed on everyone, then it is justice to compensate and compensate the damages that affect individuals because of this accident on the basis of equality before the public burdens, there is no escape from the responsibility of the administration to refrain, whether on the basis of The basis of error and without error, and many countries have guaranteed the administration’s responsibility for abstaining, but the matter is not related to the inclusion of the texts only, but rather to their effectiveness and the actual application of the provisions that determine the administration’s responsibility, because they are considered reparation for the damages resulting from the refrain and are not a sufficient guarantee for the implementation of the judicial ruling.

Then he found legislation and jurisprudence. There is a great necessity to establish something that guarantees the individual and protects him from the risks that he encounters in his life, and this is what is called the insurance contract, as the insurance contract is considered one of the very important contracts, and from the moment of its conclusion, this contract has legal effects for its parties, creating corresponding obligations that must be fulfilled and implemented, and if it is possible The insured shall carry out his obligations To be able to face the risks of life, the insurance company must also cover the risks that fall within the limits of the scope of the thing insured, otherwise the party violating these obligations will bear the legally prescribed compensation for this violation. The insured must also disclose the information that surrounds the risks of the contract, and sometimes circumstances change. The insured is negative and the insured does not inform the insured and this is what constitutes A major risk that threatens the insured with a huge loss, that is, if the insured had not known it, he would have been able to avoid that risk since it reached it, without it reaching its high level of risk. This is what prompted us to divide this study into two sections, in the first of which we explained the nature of the insured and the second was devoted to studying the change The insured’s situation after concluding the contract, then we reached a conclusion that included results and recommendations

Abstract: The view of countries has evolved regarding the right of foreigners to resort to the national judiciary in the country in which they reside. In the past, foreigners were not allowed to resort to the judiciary at all, considering that the judiciary\'s mission was to resolve disputes between nationals only. The importance of the right to litigation lies in the rules of international law, which found their appreciation and interest in it as a right at an early time in the sources and branches of international law, and perhaps preceded many of the internal laws of countries in giving importance to this important human right, so that it became in many cases the pioneer and model for internal laws in this field, as countries followed the steps of the rules of international law, either by choice and imitation or by obligation and implementation. This principle (judicial independence) has received and continues to receive international attention due to the importance of the judiciary and its decisive role in upholding the word of law and protecting human rights. The principle of judicial independence means protecting the judiciary from interference, and at the same time this principle does not mean the complete separation of the judiciary or absolute freedom from the rest of the authorities, which portends a possible tyranny of the judiciary or what is known as the emergence of a government of judges. Independence is a means to achieve other goals, most notably the rule of law, the protection of rights and freedoms, and the independence of the judiciary in this description does not exceed the limits of non-interference in its affairs by the rest of the authorities without reaching separation or isolation.

Abstract: Security is deemed a basic need of human society, and a positive indicator of its stability, prosperity and progress; human security means that individuals in their societies live in a state of stability that distances them from hunger, fear and deprivation, as well as from all forms of extremist and deviant intellectual social and ideological threats and behaviors that may disturb their lives that negatively affect their continuation of their lives and conduct their daily work safely without exposing them to what may stand in the way of their continuation in a simple and sound manner, such as deviant practices. With the steady scientific and technical development at the level of human societies, which has made matters worse, these extremist groups have taken advantage of this electronic development to spread their deviant behaviors and ideas, and even reached the level of threat, which in turn embodies what is called electronic intellectual terrorism. This study illustrates the concept of intellectual human security and its weaknesses and clarifies the concept of electronic terrorism and the role of the state and some international efforts in combating it. This study has reached a number of logical conclusions in this field and also produced some proposals that may enhance intellectual human security at the level of all societies.

Abstract: Artificial Intelligence (AI) is bringing about rapid and amazing changes in the way we live and work, through innovative applications in various fields such as health care, finance, transportation, education, and others. Despite the many advantages, it presents in return many legal and ethical challenges, the most prominent of which is the issue of legal liability for the harmful actions they cause “Artificial intelligence” systems.
This study is concerned with the topic of the legal basis for civil and criminal liability for acts of artificial intelligence, as it will attempt to explore the legal and ethical issues surrounding civil liability for artificial intelligence in general, including the applicable legal rules and principles, and the challenges involved in defining and attributing liability. Ultimately, the goal is to provide a comprehensive overview of the overall legal landscape and highlight the key issues that need to be addressed to ensure that AI is used in a liable and ethical manner.

Abstract : The process of employing expatriate workers is either directly with the worker's agreement with the employer directly, or it is indirectly so that one or both of them resort to an intermediary whose work ends with the conclusion of the work contract, and from here the indirect method of employment has been resorted to as a fait accompli. Employment in Iraq requires several legal operations, which made labor recruitment agencies enjoy great importance in the Iraqi labor market, especially after the state’s role in carrying out the task of mediating and employing the unemployed after it had monopolized this task due to the economic, social and political changes that it had A major role in this regression, and in light of recent international trends to organize the work of these agencies, we find that the Iraqi legislator has made an effort to work to develop its legislation in line with these trends, and in this context, the Iraqi legislator issued instructions for establishing private employment offices without referring to a mechanism. The work of these offices, but those who follow the Iraqi system of legislation will notice that there is no law or system for bringing foreign workers to Iraq, similar to what is in place in Arab countries.

Abstract: Hence, it appears to us that procedural honesty is of great importance when practicing civil procedures. Therefore, we have the need to organize the rules of procedural honesty to draw for us the procedures that litigants must follow when using the right to resort to the judiciary. That approach is governed by the rules of the Civil Procedure Law for all litigants. the judge who hears The case and the disputing litigants prevent the abuse of the former against him and guarantee the right of defense to the latter in order to reach legitimate goals, which is to give each person his right to achieve justice and the stability of the disputed legal positions.

Abstract: The fine is one of the most important types of financial penalties that can be part of public revenues, meaning that the fine can be a source of revenues, but some jurists believe that it is difficult to rely on it as a source of public revenues; Therefore, because its outcome is linked to the existence of the violation or its absence, the more it achieves its deterrent goals, the fewer violations it produces, and consequently its revenues decrease, and vice versa, as the revenues generated from it increase the more it fails to achieve the deterrent goal, and therefore it is difficult to know the amount of its revenues because it is linked to the existence or absence of violating the legal rule, and there are several fines, including administrative fines and criminal fines. In principle, the fine is a monetary amount imposed on any person who violates the legal rule, but the goal of this obligation differs in jurisprudence, as there is a side of jurisprudence that sees the fine as a punishment whose goal is to deter violators of the legal rule, and in addition to that we find another opinion that considers the fine a punishment whose goal is to deter violators of the legal rule, but in addition to that it achieves financial revenues that support the state’s public treasury. The first side believes that the fine is a purely criminal penalty whose sole purpose is to deter violators of the legal rule and prevent them from committing violations again, because the financial penalty in general is not accustomed to the violator of the legal rule no matter how many times it is imposed on him. The fine does not aim to achieve financial gains for the legal institution, but rather is a type of pressure operation on violators and outlaws. In addition to the first opinion, we find another opinion that considers the fine a penalty whose purpose is to deter violators of the legal rule, but in addition to that, it achieves financial revenues that support the state treasury. In addition to the jurisprudence’s recognition of the financial purpose of the fine, the legislator also recognized the financial purpose of the fine in some texts by explicitly stating the revenues of the fine, despite the lack of explicit text in the texts of the State Financial Administration Law and the General Budget Laws.

Abstract The system of individualizing punishment in general, and disciplinary in particular, is one of the topics that the regulations governing the behavior of state employees’ discipline began to take up, as it is one of the requirements of justice that is supposed to be available when imposing penalties on violators, in a way that takes into account the circumstances of the circumstances surrounding or accompanying the employee when he committed it The act requiring the penalty, which may differ from other persons or employees who committed the same act, whether by tightening the penalty on it, or reducing it, according to those circumstances, by granting the authority competent to impose the penalty, or the competent judicial authority, to take these issues into consideration, and to single out each Punishment according to that case, or those circumstances.

This research addresses the fundamental basis of a judge\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\'s civil liability for errors committed during the performance of their duties. The importance of this liability lies in protecting the rights of individuals affected by erroneous judgments or improper judicial decisions. The legal basis for such liability is rooted in the existence of gross negligence or significant misconduct by the judge while carrying out their duties, resulting in harm to one of the parties involved.
The study focuses on analyzing the factors that render a judge liable, such as negligence or abuse of judicial authority, and examines the legal frameworks governing this liability in various legislations. Furthermore, the research explores the challenges associated with defining the limits of this liability and its impact on the independence of the judiciary.

Abstract: In professional contracts, in which one of the parties is a professional, i.e. accustomed to practicing a job with the acquisition of experience, knowledge and excellence in this work, such as a doctor or a lawyer, and the debtor in these contracts is obligated as a principle to personally implement his obligation, since the personality of this professional in these contracts is a matter of consideration. However, as a result of the rapid progress that we witness in all aspects of life, it has become possible for one person to replace another person in implementing the obligation, noting that this person who replaces him to implement the obligation is also a professional, meaning knowledgeable in the principles and art of the profession. Therefore, his responsibility can be carried out in his capacity as a follower of the original debtor - the original professional. Despite the importance of these contracts in general and the subject of solutions in them, we see that the Iraqi and Egyptian civil legislators have dealt with solutions from a narrow angle in the chapter on the expiration of the obligation and have not organized personal solutions as a general theory in the professional contract. The solutions in our research only apply to the legal relationship that is always sourced from the professional contract, unlike the solutions Personal solutions in the chapter on the expiration of the obligation, as they can apply to any legal relationship between a creditor and a debtor, whatever the source of this relationship - contract, unilateral will, tort liability, unjust enrichment, text of the law - noting that the personal solution in the professional contract is always consensual. Also, the personal solution in the professional contract applies to work and remuneration. Also in the issue of civil liability, the debtor\'s liability is raised towards the payer in the case of personal solution as a way to expiry of the obligation, but in the solutions in the professional contract, the liability is between the one who carried out the solution - the original professional - and the one to whom it was assigned - the new professional - the work, as the latter has recourse to the former.© 2023 TUJR, College of Law, Tikrit University

Abstract: Information crimes, including crimes against honor, consideration and information threats, are among the new crimes that the penal legislation has not yet kept pace with the criminalization of such crimes, such as the Iraqi legislation and the Qatari legislation, which have been studied in this research. A treatment of it in its traditional form, taking into account the failure of these legislations to address what was developed of these crimes by committing them by means of social media and the Internet, as well as the interpretation and measurement in criminal legal articles inconsistent with the principle of penal legitimacy, this matter made research on this subject a necessity It is imperative to remedy this legislative deficiency and to know the position of the comparative laws that were chosen as models for this study.

Abstract: The draft of the judicial ruling in the civil suit is a means to achieve the desired justice, which is considered the final stage of issuing the ruling, and the draft of the ruling is an essential summary of the judicial ruling in the suit. In this research, we identified the draft of the judicial ruling, its importance and purpose as the final stage of concluding the pleading in the civil suit, and pronouncing the ruling publicly, and trying to identify the features of the legislative shortcomings of the draft of the judicial ruling and its provisions and organizational rules. In our research, we relied on the comparative analytical approach within the scope of the Civil Procedure Law and some comparative laws under study and some judicial applications, through which we reached a set of results and recommendations, the most prominent of which is obligating all Iraqi courts to keep records that are specific to drafts, and in which the content of the draft of the issued ruling is recorded, due to its importance in the judicial work, which may lead to the momentum of work to lose the draft, and thus it is possible to refer to those records whenever necessary. In today’s technological landscape, electronic or digital fingerprinting is a well-established method for enhancing security. This technology is increasingly adopted by various institutions, including government agencies, to address and prevent illegal activities. Prior to the integration and application of this technology, it is essential to understand its foundational aspects. This includes the evolution of electronic fingerprinting and the associated legislation, both on a global scale and within specific national contexts.
The market for fingerprint sensors is expanding rapidly, with projections suggesting a growth from USD 3.5 billion to USD 7.1 billion by the end of 2024. This growth indicates a rising acceptance of electronic fingerprints across various sectors, including public institutions. Consequently, a thorough understanding of the foundational principles of this technology is crucial before its widespread implementation (Rusinek et al., 2019).
This paper explores the scientific, legal, and practical foundations of electronic fingerprinting. The term "foundation" is used here in its legal sense, referring to "evidence." The research focuses on evaluating the evidence related to electronic or digital fingerprints from multiple perspectives. It aims to investigate the scientific, criminal, and practical underpinnings of electronic fingerprinting, while also discussing the relevant legal frameworks. The primary objective of this study is to provide a comprehensive discussion on the foundation of electronic fingerprinting, encompassing scientific, legal, and practical viewpoints (Rusinek et al., 2019). Additionally, the paper will address various legal aspects associated with electronic or digital fingerprints, particularly those targeting illegal activities related to this technology.

Abstract. :Judicial work in the field of criminal courts is culminated in the criminal judgement and this provision must be drafted by the Court and its necessary elements, In addition to its characteristics, the fact that the criminal judgement is not handed down at once but goes through several stages qualifies the competent court to pronounce it and declare it to be decisive for the proceedings before the courts on the one hand, In order to be free from imbalances and shortcomings and as a result it cannot be overruled by the authority responsible for monitoring his health and therefore this provision must have its own self-evidenced in this study.

Abstract: The basic principle in compensation for damages caused by crime is that the criminal, as the cause of the loss, is responsible for compensating the damages. But in some crimes, including terrorist crimes, for reasons such as the lack of identification of terrorist groups, the lack of sufficient evidence, the inability to attribute the crime and many other reasons, and for this reason the government put forward the idea of compensation to support these victims. And since the government is committed to maintaining order and protecting the rights of members of society, and on the other hand, the occurrence of terrorist crimes is evidence of the inefficiency of the security tools of society, and as a result, the allocation of a large area of budget resources to cover the damages caused to these victims by the government is a measure to restore lost rights With regard to the idea of the government's commitment to compensation for terrorist crimes, we see that the Iraqi legislator approved it only in the Compensation for Terrorist Acts Law No. 10 of 2004 and in the Law of Compensation for Those Affected by War Operations, Military Mistakes and Terrorist Operations No. 20 of 2009 and its amendments, and compensation was determined on the basis of social responsibility . In view of the social and precautionary nature of the government's obligation to compensate, the Compensation Law stipulates a number of conditions related to the crime, the damage caused and the person entitled to compensation.

Abstract: In this research titled "Model Criminal Policy Towards Crimes Violating Family Sanctity: A Study of Challenges and Principles," we investigate the criminal policy for addressing crimes that violate family sanctity. The main issue of this research is to identify the challenges and principles that criminal policy should follow to protect the family and confront crimes against it. The importance of this topic is evident in that the family, being the fundamental nucleus of society, deserves special support and protection from the legal and judicial system. The existing problems in this field include lack of laws, improper implementation, and cultural and social challenges. The main objective of this research is to provide a thorough analysis of these challenges and present practical strategies based on the principles of model criminal policy. The research methodology in this work is descriptive-analytical, utilizing library sources and field studies to analyze laws and regulations, judicial procedures, and experiences in different countries. The results show that strengthening and updating laws supporting the family and addressing crimes against it plays a significant role in reducing these crimes. Adopting a preventive approach and early interventions in cases that may involve a risk of crime against the family has shown positive results. The findings also indicate that improving the efficiency of the judicial system and expediting the processing of cases related to family crimes has a positive impact on reducing these crimes. Establishing effective support systems for victims of family crimes, including psychological counseling and legal support, has contributed to mitigating the negative effects of these crimes.

Abstract: Security agencies in all countries of the world seek to achieve a basic and primary goal, which is to prevent and control crime by all possible and legitimate means and methods. In this way, they cannot remain far from scientific development in combating crime. The issue of the outcomes of modern technology and its effectiveness in achieving security and the conviction of the criminal judge of it may remain one of the main determinants in shaping legal systems, especially with the increasing use of surveillance cameras on public roads and in front of shops and the increasing role of their role in proof. The issue of the validity of surveillance cameras in criminal evidence is not a form of legal luxury, but rather rules and contents. The most important of these contents is the extent of their validity in proof before the criminal judge and what is meant by filming using surveillance cameras. The study aimed to identify the nature of filming using surveillance cameras and to identify the position of jurisprudence and law on filming. We relied in the study on the analytical approach, the deductive approach and the comparative approach. The study included three sections. The first section included the importance of visual filming using surveillance cameras and its importance in criminal evidence. The second section included the legal position on the use of surveillance cameras. The third section dealt with the validity of surveillance cameras in criminal evidence.
