The role of climate diplomacy in achieving carbon neutrality

Abstract

In this era, the world suffers from many problems that are difficult to deal with. These problems range from the fields of life, the environment, industry, wars, the problem of hunger and food security, waves of illegal immigration during which dozens die during smuggling at sea, and many other problems that are difficult to enumerate, but There are always problems that are a priority in studying and trying to find solutions. It should be noted that carbon neutrality comes as one of the most prominent solutions and initiatives that seek to mitigate climate change. Carbon neutrality refers to achieving a balance between the emission of carbon dioxide and its absorption from the atmosphere in carbon sinks. It represents a situation in which net carbon emissions are zero, meaning that any human-caused carbon dioxide emissions are offset by similar removal efforts. This study attempts to investigate the hypothesized relationship between climate diplomacy and carbon neutrality, by answering the research question: How Climate diplomacy contributes to carbon achievement? The descriptive analytical method will be adopted in this study.

يعاني العالم في هذا العصر من العديد من المشكلات التي يصعب التعامل معها، وتتنوع هذه المشكلات بين مجالات الحياة والبيئة والصناعة والحروب ومشكلة الجوع والأمن الغذائي، وموجات الهجرة غير الشرعية التي يموت خلالها العشرات أثناء التهريب في البحار، والكثير من المشاكل الأُخرى التي يصعب حصرها، لكن هناك دائماً مشاكل تحتل الأولوية في الدراسة ومحاولة إيجاد الحلول وتجدر الإشارة إلى أن الحياد الكربوني يأتي كأحد أبرز الحلول والمبادرات التي تسعـي للتخفيف من التغير المناخي، ويشير الحياد الكربوني إلى تحقيق التوازن بين انبعاث ثاني أكسيد الكربون وامتصاصه من الغلاف الجوي في مصارف الكربون. وهو يمثل حالة يكون فيها صافي انبعاثات الكربون صفراً، مما يعني أن أي انبعاثات ثاني أكسيد الكربون التي يسببها الإنسان يتم تعويضها عن طريق جهود إزالة مماثلة, تحاول هذه الدراسة البحث عن العلاقة المفترضة بين دبلوماسية المناخ والحياد الكربوني، من خلال الإجابة عن السؤال البحثي: كيف تساهم دبلوماسية المناخ في تحقيق الكربوني؟ وسيعتمد المنهج الوصفي التحليلي في هذه الدراسة.

Abstract

Christian Zionism is the most prominent supporter of Jewish Zionist sovereignty over ALQuds. This position taken by Christian Zionism is based on a set of beliefs, the centerpiece of which is the belief in the second return of Christ and his establishment of a happy kingdom that would last for a thousand years. Concern for the future of the Jewish people has become one of the basic pillars of the beliefs of Christian fundamentalists, especially Zionism. Christianity. The literal interpretation of the Bible led them to believe that the return of the Jews to the Holy Land was the key to fulfilling biblical prophecies. What the religious reform movement brought about paved the way for rapprochement with Jewish Zionism, especially in the necessity of the return of the Jews to Zion within its borders mentioned in the Jewish holy books and the imposition of their sovereignty. On its land, for a kind of organic connection to arise between Jewish Zionism, especially religious Zionism, and Christian Zionism, and for their visions to converge, especially with regard to political and religious sovereignty over ALQuds.
- The importance of the research: The importance of the research comes from the fact that it examines one of the most sensitive issues of contemporary conflict, which is the issue of Christian fundamentalism’s support for Jewish Zionism in imposing its sovereignty over ALQuds.
-The research problem: The research revolves around a central question: What is the nature of the place occupied by ALQuds in the political thought of contemporary Christian Zionism? A group of secondary questions emerge from this question, the most prominent of which is: What is Christian Zionism? How did it arise? What are its intellectual foundations?
- Research hypothesis: The research is based on the hypothesis that: Christian Zionism supports Jewish Zionism to extend its political and religious sovereignty over ALQuds to achieve the conditions for the second return of Christ.
- Research methodology: The research adopts the historical method to demonstrate the nature of the historical justifications and arguments upon which Christian Zionism relies in proving the right of the Jews to sovereignty over ALQuds. The research also adopts the descriptive and analytical method, which enables the researcher to come up with logical conclusions about the research topic. The research also uses the comparative method whenever Scientific necessity necessitated this.
- Research structure: The research is divided into an introduction and two sections followed by a conclusion containing the most prominent conclusions. The first section came under the title Christian Zionism: Concept, Origins and Intellectual Foundations, while the second section came under the title Sovereignty over ALQuds in the political thought of contemporary Christian Zionism.

تعد الصهيونية المسيحية الداعم الأبرز للسيادة الصهيونية اليهودية على القدس, ويستند هذا الموقف الذي تتخذه الصهيونية المسيحية الى مجموعة من المعتقدات التي يشكل الاعتقاد بالعودة الثانية للمسيح وتأسيسه لمملكة سعيدة تدوم لألف عام محورها, ليصبح الاهتمام بمستقبل الشعب اليهودي احد الاركان الاساسية لمعتقدات الاصوليون المسيحيون لا سيما الصهيونية المسيحية, فالتفسير الحرفي للكتاب المقدس قادهم إلى اعتقاد مفاده إن عودة اليهود إلى الأرض المقدسة مفتاح تحقق النبوءات التوراتية, فما جاءت به حركة الاصلاح الديني قد مهد الطريق للتقارب مع الصهيونية اليهودية لا سيما في وجوب عودة اليهود إلى صهيون بحدودها الواردة في كتب اليهود المقدسة وفرض سيادتهم على أرضها, لينشأ نوع من الارتباط العضوي بين الصهيونية اليهودية لا سيما الدينية والصهيونية المسيحية, ولتتقارب رؤاها خصوصاً فيما يتعلق بالسيادة السياسية والدينية على القدس.

Abstract

The topic (structural parts of civil judgment according to logical reasoning) is considered one of the most important topics because it is considered a logical process in the hands of the civil judge through which he aims to reach a fair ruling in the case brought to him and embody it in the ruling. One of the reasons that led us to choose this topic is that logical reasoning is without it. There is difficulty in the legal solution and this leads to negative repercussions on the judicial process in issuing civil judgments, as logical reasoning is the most important mental, scientific and logical process that the judge resorts to when constructing the judicial ruling, and one of the most important questions that arose in the research is how the judge can construct the ruling. Civil through logical reasoning The necessity of knowing the logical unity between the premises and the results reached within the scope of the research. To conclude the case with a sound judicial ruling that is consistent with what reason and logic dictate, and is immune from being overturned by the courts. In view of the importance of the principle of logical reasoning, as it works to extend justice as much as possible in judicial rulings, there is a need to study the possibility of including logical reasoning methods within the school curricula in the specialized studies of judges and members of the public prosecution due to their utmost importance in the issue of building civil rule.

Abstract

يعد موضوع (الاجزاء البنيوية للحكم المدني وفقاً للاستدلال المنطقي) من اهم الموضوعات كونه يعد عملية منطقية بيد القاضي المدني يهدف من خلاله الوصول إلى الحكم العادل في الدعوى المرفوعة إليه وتجسيده في الحكم, ومن الاسباب التي دعتنا الى اختيار هذا الموضوع , ان الاستدلال المنطقي من دونه يكون هناك صعوبة في الحل القانوني ويؤدي هذا إلى انعكاسات سلبية على العملية القضائية في اصدار الاحكام المدنية, اذ يعد الاستدلال المنطقي أهم العمليات العقلية والعلمية والمنطقية التي يلجأ إليها القاضي عند بناء الحكم القضائي ، ومن اهم التساؤلات التي طرأت بالبحث كيف يمكن للقاضي ان يقوم ببناء الحكم المدني من خلال الاستدلال المنطقي ؟ وضرورة معرفه الوحدة المنطقية بين المقدمات والنتائج التي توصل إليها في نطاق البحث ؛ ليختتم الدعوى بحكم صحيح يتوافق مع العقل والمنطق ، ويكون بمنأى عن النقض من المحاكم . وبالنظر إلى أهمية مبدأ الاستدلال المنطقي ، كونه يعمل على بسط العدالة قـدر الإمكان في الأحكام القضائية ، ضرورة دراسة امكانية درج مناهج الاستدلال المنطقي ضمن المناهج الدراسية في الدراسات المتخصصة للقضاة وأعضاء الادعاء العام لأهميتها القصوى في مسألة بناء الحكم المدني .

Abstract

(Providing an advice, by insurer and insurance intermmidators to a costumer, is an obligation finds its base in the principle of good faith that is requiring from them to pay cooperation with a costumer, enlightening and directing his/her will to the sounder choice of that an insurance product that is much more conforms with his/her needs and demands. The European Directive No. (97/2016) has accurately drawn the content of the obligation, the conditions of its fulfillment and the guarantees of the good performance of the obligation. Correspondingly, the Iraqi insurance legislation lack a comparable regulation of this obligation, which is constitute a serious legislative-hole diminishing the optimal protection of consumer interests . These matters will be highlighted in this article, and a proposal for reforming the realities of the Iraqi insurance legislation will be suggested therein)

(الالتزام بالنصيحة هو التزام قانوني متميز يجد اساسه في مبدأ حسن النية التي يفرض على شركة التأمين ووسطاء التأمين التعاون مع المستهلك بغية تنوير ارادته وتوجيهها الوجهة التي تخدم رغباته واحتياجاته، رسم ابعاد هذا الالتزام بدقة التوجيه الاوربي رقم (97/2016) فاوضح مدلوله وشروط تنفيذه وضمانات حسن الوفاء به. وفي المقابل، لم ينظم قانون حماية المستهلك العراقي رقم (1) لسنة 2010 ولا تشريعات التأمين العراقية هذا الالتزام بنصوص قانونية مقاربة لما عليه الحال في التشريع الاوربي سالف الذكر. وسيعمد الباحث في هذا البحث الى تسليط الضوء على ملامح هذا الالتزام موضحاً اوجه القصور الذي شاب تشريعات التأمين العراقية في هذا الصدد مقترحاً صياغته في تشريعات التأمين العراقية.

The adoption of traditional means of establishing evidence to prove or deny the crime by judicial authorities has become insufficient at present as a result of scientific and technological development that has led to the development of the means of committing the crime by the perpetrator, which, on the other hand, necessitated the use of modern scientific methods and devices in the field of criminal proof, including specifically in the subject of our research, infrared radiation ,What is meant is one of the types of electromagnetic rays that are part of the solar spectrum and that are not visible to the naked eye but can be sensed as heat through objects reflecting on them , Infrared radiation is used in several areas, including in the field of criminal evidence, specifically at the crime scene for physical evidence that cannot be seen with the naked eye, which has helped the judicial authorities to get very close to the truth and then determine the identity of the perpetrator , Among the topics of our research is determining the real cause of death resulting from the use of a firearm at the crime scene. Is it accidental, suicide, or criminal, knowing that a firearm means: every hand-held weapon, such as a pistol and a rifle, is intended for throwing fiery projectiles that emerge through the force resulting from the ignition of gunpowder or explosive materials, leaving behind three types of traces at the crime scene, some of which are visible to the naked eye, including the bullet, the bush, and others are not visible to the naked eye, including traces of gunpowder, which depend on x-rays Infrared radiation detector Despite the criminal importance of infrared rays in the field of criminal evidence in terms of their detection of scientific material evidence, represented by traces of gunpowder, they nevertheless remain subject to the discretionary conviction of the judge, and this is what will become clear to us in the following research pages.

إن اعتماد الوسائل التقليدية في إقامة الدليل لإثبات او نفي الجريمة من قبل الجهات القضائية اصبح في الوقت الحاضر غير كافي نتيجة التطور العلمي والتكنولوجي الذي أدى الى تطور وسائل ارتكاب الجريمة من قبل الجاني مما استلزم بالمقابل الاستعانة بالوسائل والأجهزة العلمية الحديثة في مجال الاثبات الجزائي ومنها تحديدا في موضوع بحثنا الاشعة تحت الحمراء والتي تمثل احد أنواع الاشعة الكهرومغناطيسية حيث تشكل جزءا من اشعة الطيف الشمسي والتي لا ترى بالعين المجردة ولكن يمكن الاستشعار بها كحرارة من خلال الأجسام المنعكسة عليها، هذا وتستخدم الاشعة تحت الحمراء في عدة مجالات منها في مجال الاثبات الجزائي وتحديدا في مسرح الجريمة بالنسبة للأدلة المادية التي لا ترى بالعين المجردة مما ساعد الجهات القضائية في الاقتراب بشكل كبير من الحقيقة ومن ثم التوصل في تحديد هوية مرتكبها ومنه في موضوع بحثنا تحديد سبب الوفاة الحقيقي الناجم عن استخدام السلاح الناري في مسرح الجريمة هل هو عرضي او انتحار او جنائي حيث يمثل السلاح الناري كل سلاح محمول يدويا كالمسدس والبندقية مخصص لرمي المقذوفات النارية والتي تخرج من خلال القوة الناتجة من اشتعال البارود او المواد المتفجرة تاركا خلفه ثلاث أنواع من الآثار في مسرح الجريمة بعضها يرى بالعين المجردة والمتضمنة الطلقة والظرف والأخرى لا ترى بالعين المجردة والمتضمنة آثار البارود والتي تعتمد على الاشعة تحت الحمراء للكشف عنها، هذا وعلى الرغم من الأهمية الجنائية للأشعة تحت الحمراء في مجل الاثبات الجزائي من حيث كشفها عن دليل مادي علمي والمتمثل بآثار البارود فإنها مع ذلك تبقى خاضعة الى قناعة القاضي التقديرية وهذا ما سيتضح لنا بشكل جلي في ثنايا صفحات البحث القادمة.

Abstract

In numerous nations, the population is diversified, comprising a blend of various ethnicities, races, and beliefs, living together within a defined geographic boundary bound by a shared sense of citizenship or residency. Despite their differences, they are all subject to the governing laws of the state. Given the intricacies of human interactions, conflicts may arise, and it is agreed upon that these disputes will be resolved through arbitration, providing a fair and impartial means of addressing disagreements. An agreeable and harmonious way to settle disagreements without relying on national courts is through arbitration, which offers various benefits and safeguards. This approach allows both parties to choose their arbitrator, applicable law, and procedural methods. This study revolves around arbitration and its validity in Islamic law. Additionally, it delves into the guidelines for giving testimony, particularly the necessity of being a Muslim witness, as per the viewpoints of Islamic jurists and specific legal systems governing the use of testimony in civil procedures, evidence, and arbitration. Moreover, this research scrutinizes the regulations of various arbitration institutions and whether they mandate religious affiliation as a prerequisite for validating witness testimony in arbitration disputes, as well as the stance of the arbitral tribunal on this matter. Finally, this research discusses the position of the arbitration ruling issued based on the testimony of a non-Muslim against a Muslim and the extent of the possibility of its implementation based on the Islamic jurisprudential position and the position of some international legal systems, centers, and arbitration rules.

Abstract

في كثير من البلدان يعتبر الشعب خليط أجناس وأعراق ومعتقدات متباينة يجتمعون في رقعة جغرافية محددة وتجمعهم المواطنة أو الإقامة في نواحيها ويخضعون لقانون هذا البلد. ونظرا لتشعب أمور الحياة فالتعاملات اليومية قد تفرز خلافات يتم التوافق لإخضاعها للتحكيم في عملية فض منازعاتها. والتحكيم من الوسائل التوافقية السلمية لإنهاء النزاعات والتي تقي الحاجة للجوء للمحاكم الوطنية نظر لما تتضمنه من ضمانات تقاضي ومميزات منها اختيار طرفي النزاع وفق إرادتيهما للمحكم والقانون واجب التطبيق والإجراءات المتبعة بما فيها إجراءات الإثبات. ويناقش هذا البحث مفهوم التحكيم ومشروعيته في الفقه الإسلامي؛ كما أن هذا البحث يركز على موضوع الشهادة وشروطها ومنها شرط الإسلام في الشاهد ضمن أراء فقهاء الفقه الإسلامي وفي بعض الأنظمة القانونية الخاصة بالإثبات عبر الشهادة في قوانين المرافعات والإثبات والتحكيم؛ كما يتعرض هذا البحث للنظر في قواعد بعض المراكز التحكيمية الدولية ومدى تطلبها أو عدم تطلبها لشرط الدين والمعتقد عند الإثبات لشهادة الشاهد في النزاع التحكيمي وموقف الهيئة التحكيمية من ذلك. وأخيرا يناقش هذا البحث موقف الحكم التحكيمي الصادر بناء على شهادة غير المسلم على المسلم ومدى إمكانية تنفيذه بناء على الموقف الفقهي الإسلامي وموقف بعض الأنظمة القانونية والمراكز والقواعد التحكيمية الدولية.

Abstract

Businesses vary in countries and differ according to the policy of the legislator in this regard. A census of businesses may be drawn up and certain jurisprudential criteria included being determined exclusively. for business texts mentioned.
In light of the various legislative developments, commercial and economic openness, the emergence of innovative and highly developed innovations and commercial businesses at the world level, and the desire of the legislator to employ them within the various businesses and develop their own legal system to give them a commercial work standard and adopt them in commercial legislation, we find the adoption of modern legislation as in the law of transactions UAE Commercial No. 50 of 2022, which was implemented on January 2, 2023, adding many modern commercial businesses. This legislation is the first of its kind among Arab trade legislation in this regard, as in virtual assets, website transactions, artificial intelligence, and others.
And from the observation of the Iraqi commercial legislation in force No. 30 of 1984, it is noted that there are no texts for modern business and its delay in keeping pace with them, so the will of the legislator in this regard must appear by keeping pace with the most important legislative developments at the level of regional countries to expand the concept of business and for the law and its legislator to be in line with progress It reflects the realistic and practical picture in the field of emerging business, and the development of its legal provisions, which also affect the commercial and investment field.

تتنوع الأعمال التجارية في الدول وتختلف وفقا لسياسة المشرع بهذا الشأن فقد يتم وضع تعداد للأعمال التجارية وادراج معايير فقهية معينة ليتم تحديدها على سبيل الحصر وقد ينتهج المشرع سياسة المثال بهذا الخصوص من خلال سرد لعدد من الاعمال التجارية المختلفة وترك المجال للقياس بما يستجد من اعمال جديدة وفقا لنصوص الاعمال التجارية المذكورة.
وفي ظل التطورات التشريعية المختلفة والانفتاح التجاري والاقتصادي وظهور ابتكارات واعمال تجارية مستحدثة ومتطورة بشكل كبير على مستوى العالم ورغبة المشرع في توظيفها ضمن الأعمال التجارية المختلفة ووضع النظام القانوني الخاص بها لإضفاء معيار العمل التجاري عليها واعتمادها في التشريع التجاري، نجد اعتماد التشريعات الحديثة كما في قانون المعاملات التجارية الإماراتي رقم 50 لسنة 2022 والذي نفذ في 2 كانون الثاني 2023 بإضافته للعديد من الاعمال التجارية الحديثة ويمثل هذا التشريع هو الاول من نوعه بين تشريعات التجارة العربية بهذا الشأن كما في الاصول الافتراضية وتعاملات المواقع الالكترونية واعمال الذكاء الاصطناعي وغيرها.
ومن ملاحظة التشريع العراقي التجاري النافذ رقم 30 لسنة 1984 يلاحظ عدم وضع نصوص للأعمال التجارية الحديثة وتأخره عن مواكبتها، لذلك لابد ان تظهر إرادة المشرع بهذا الشأن من خلال مواكبته لاهم التطورات التشريعية على مستوى الدول الإقليمية لتوسيع مفهوم الأعمال التجارية ولكي يكون القانون ومشرعه متوازيا مع التقدم العلمي والتكنولوجي الحديث ويعكس الصورة الواقعية العملية في مجال الأعمال التجارية المستجدة، ووضع الاحكام القانونية الخاصة بها والتي لها مساس ايضا في المجال التجاري والاستثماري.

Abstract

The rapid development of international trade relations, which resulted in an increase in the volume of exchange of goods and services, has led to the emergence of some damaging practices in international trade, such as subsidies and an unjustified increase in imports Which is pursued by foreign producers or exporters and results in damage to local producers in the importing country who produce products similar to or competing with their products. In order to combat these practices and protect national products and local producers, the Support and Compensatory Measures Agreement, the Prevention Agreement, and the laws being compared to a set of preventive and protective procedures and measures to stop the damage resulting from these practices If it is achieved or prevented from occurring in the future. However, the texts of the aforementioned agreements and the laws in question are devoid of any reference to compensation for local producers harmed as a result of these practices. Although there is no text preventing affected local producers from claiming compensation, which means leaving this matter to the general rules of tort liability, however, referring to the general rules does not provide sufficient and necessary protection for the local producer damaged by the practice of subsidies, nor does it help the local producer damaged by the unjustified increase. of imports in a claim for compensation, For the purpose of strengthening the protection of local producers, we made a recommendation to the Kurdistan legislator to adopt the theory of liability as the most appropriate basis for tort liability arising from an unjustified increase in imports, in order to enable the local producer damaged by the unjustified increase in imports to obtain compensation for the serious damages he suffers as a result of this practice. We also proposed to the legislator to assume solidarity among the various officials who contribute to the growing process of selling subsidized products

إن التطور السريع للعلاقات التجارية الدولية، الذي نتَج عنه رفع حجم تبادل السلع والخدمات قد أدى إلى ظهور بعض الممارسات الضارة في التجارة الدولية كالدعم والزيادة غير المبررة من الواردات، والتي ينتهجها المُنتِجون الأجانب أو المصدّرون ويترتب عليها إلحاق الضرر بالمُنتِجين المحليين في الدولة المستوردة، ممَّنْ ينتجون مُنتَجات مشابهة أو منافسة لمُنتَجاتهم. ومن أجل مكافحة تلك الممارسات وحماية المُنتَجات الوطنية والمُنتِجين المحليين جاءت الاتفاقيات الخاصة بالدعم والتدابير التعويضية واتفاقية الوقاية والقوانين ذات الصلة بمجموعة من الإجراءات والتدابير الوقائية الحمائية لوقف الضرر الناشىء عن تلك الممارسات في حالة تحققه، أو منع وقوعه بالنسبة للمستقبل. إلا أن نصوص الاتفاقيات المذكورة والتشريعات محل المقارنة خالية من أية اشارة إلى تعويض المُنتِجين المحليين المتضررين من جراء تلك الممارسات، إلا انها مع ذلك لم تمنع المُنتِجين المحليين المتضررين من المطالبة بالتعويض، مما يعني ترك هذا الأمر إلى القواعد العامة للمسؤولية التقصيرية، ولكن الرجوع إلى القواعد العامة لا يوفر الحماية الكافية والضرورية للمُنتِج المحلي المتضرر من جراء ممارسة الدعم، كما لا يسعف المُنتِج المحلي المتضرر من الزيادة غير المبررة من الواردات في المطالبة بالتعويض، ولغرض تقوية حماية المُنتِجين المحليين قدمنا توصية للمشرع الكوردستاني بالأخذ بنظرية تحمل التبعة كالأساس الأكثر ملاءمة للمسؤولية التقصيرية الناشئة عن ممارسة الزيادة غير المبررة من الواردات؛ لتمكين المُنتِج المحلي المتضرر من الحصول على التعويض عن الأضرار الجسيمة التي تصيبه نتيجة هذه الممارسة، كما اوصينا بافتراض التضامن ما بين المسؤولين الذين يساهمون في عملية بيع المُنتَجات المدعومة والمتزايدة.

الزينة حق عيني يخول صاحبه ملكية البناء الذي شيده على نفقته على أرض الغير، ولا يتم الا بالتسجيل، ويمكن لصاحب حق الزينة أن يفوت البناء الذي أحدثه وأن يرهنه ويرتب له أو عليه حقوق ارتفاق في الحدود التي يجوز له فيها مباشرة هذا الحق، ويجب أن يبين العقد المنشئ لحق الزينة نوع البناء ومواصفاته وأبعاده ويحدد حقوق والتزامات صاحب هذا الحق، ويجب أن لا تزيد مدة حق الزينة عن أربعين سنة، فإذا نص العقد على مدة أطول أو سكت عن تحديد المدة فإن المدة المعتبرة هي أربعون سنة، وينقضي حق الزينة بانتهاء مدته، وبالتنازل عنه صراحة، وباجتماع صفتي صاحب حق الزينة ومالك الرقبة في شخص واحد، وبهلاك البناء هالكا كليا، وبعدم تسديد الأجرة، فضلا عن ذلك ينتهي باتفاق الطرفين.

The theory of natural rights occupies a prominent place among political theories, due to its importance in analyzing how political society emerges. The concept of natural rights is also closely linked to natural law, such that man, living in a state of nature under natural law, possesses natural rights, which is the philosophical basis for human rights. Although philosophers and thinkers did not agree on a unified concept of natural rights and their nature, they agree on the existence of a natural state that precedes political society, whereby humans live by their natural rights.
John Locke, a representative of English empiricism and one of the pioneers of liberalism, is considered one of the most prominent people who delved deeply into the theory of natural rights. As for Thomas Jefferson, who was inspired by many ideas from Locke, perhaps the most prominent of which are natural rights, he not only delved deeply into the theory of natural rights in its theoretical aspect, but worked to embody it in the Declaration of Independence. And applicable laws. When comparing the views of thinkers on what natural rights are, we find that Locke considered (life), (liberty), and (property) to be among the basic natural rights of man, while Jefferson made it clear that (property) is a necessity and a means of comfort for humanity in its pursuit of happiness. ويعد جون لوك ممثل التجريبية الإنكليزية ومن رواد الليبرالية من أبرز من تعمق في نظرية الحقوق الطبيعية، أما توماس جفرسون الذي استلهم أفكاراً كثيرة من لوك لعل الحقوق الطبيعية من أبرزها، فلم يتعمق في نظرية الحقوق الطبيعية في جانبها النظري فحسب بل عمل على تجسيده في وثيقة الاستقلال وقوانين نافذة. وعند المقارنة بين وجهات نظر المفكرين في ماهية الحقوق الطبيعية، نجد أن لوك أعتبر كل من (الحياة) و(الحرية) و(المُلكية) من الحقوق الطبيعية الأساسية للإنسان، أما جفرسون فقد اوضح أن (المُلكية) ضرورة ووسيلة لراحة البشرية لسعيها نحو السعادة، عليه فإن الحقوق الطبيعية عنده هي(الحياة) و(الحرية) و(السعي نحو السعادة).

If that deviation occurs, it certainly constitutes an arbitrary crime that exists in itself, different from abuse. من هنا أنبثق اهتمامنا بدراسة موضوع التعسف في استعمال الحق بالدعوى الجزائية وأقتصر على احدى مراحلها وهي مرحلة المحاكمة لبيان حالاته والمسؤولية الناجمة عنه وجزاءاته بهدف إبراز جوانب الاستعمال المشروع للحق والتعسف فيه، فإذا ما حصل ذلك الانحراف فأنه بكل تأكيد يشكل جريمة تعسفية قائمة بذاتها تختلف عن تجاوز الحق أو المسؤولية التقصيرية التي تقوم على فكرة الخطأ والضرر والعلاقة السببية لأن القائم بها يستعمل حقاً مشروعاً لهُ وفق القانون لكن يحيد عن غايته بالشكل الذي يلحق ضرراً بالفرد أو المجتمع، وعند أمعان النظر بنصوص قانون أصول المحاكمات الجزائية نجدها لم تقدم حلولاً لمشاكل التعسف بالشكل الذي يخدم العدالة لأن النصوص تتناهى والوقائع لا تنتهي، كما أن المجال التطبيقي أثبت عجز السلطة التقديرية للقضاء أمام حالات ومجالات التعسف المتعددة والمتكررة وفي نهاية المطاف تباطؤ أحقاق الحق، حيث أن لثقافة القاضي ومدى المامهُ بالقوانين الموضوعية والإجرائية دور بارز في الحد من ظاهرة التعسف، فالقاضي الذي يدقق الدعوى بعد قيدها من شأنه أن يسد الكثير من الثغرات التعسفية وخاصة المتعلقة بالنظام العام .

Abstract

This research paper attempts to address the legal basis upon which the establishment of sovereign wealth funds in Iraq is based, and to move away as much as possible from the economic and financial aspect of these funds, as a result of what the current situation requires of a global trend to establish such funds, to address the financial crises that may occur, as is the case. In the financial crisis that followed in 2008, this research paper relies on explaining the restrictions that could affect the establishment of such funds in Iraq.
Through a statement and analysis of the texts contained in the effective Iraqi Constitution of 2005 or in the Iraqi laws, as financing these funds is not an easy matter, especially since these funds depend to a fundamental degree on excess oil revenues, which are among the most important issues that concern the Iraqi government and public opinion. Equally, as a result of the fluctuations witnessed in oil prices, whether in the short or long term, which obligates the state to employ the financial surplus achieved during the period of high oil prices and to establish such funds for purposes, whether investment or savings.

تحاول هذه الورقة البحثية معالجة الأساس القانوني الذي يبنى عليه أنشاء صناديق الثروة السيادية في العراق، والابتعاد قدر الإمكان عن الجانب الاقتصادي والمالي لهذه الصناديق، نتيجة ما يتطلب الوضع الحالي من توجه عالمي لإنشاء مثل هذه الصناديق، لمعالجة الازمات المالية التي ممكن أن تحدث كما هو الحال في الأزمة المالية التي أعقبت عام 2008، وتعتمد هذه الورقة البحثية على بيان القيود التي ممكن أن تؤثر على أنشاء مثل هذه الصناديق في العراق، من خلال بيان وتحليل النصوص التي وردت في صلب الدستور العراقي النافذ لسنة 2005 أو في القوانين العراقية، إذ أن تمويل هذه الصناديق ليس بالأمر اليسير خاصاً وأن هذه الصناديق تعتمد وبدرجة أساس على العوائد النفطية الفائضة والتي تعد من أهم القضايا التي تشغل بال الحكومة العراقية والرأي العام على حد سواء، نتيجة التقلبات التي تشهدها أسعار النفط سواء على المدى القريب أم البعيد، الأمر الذي يلزم الدولة بتوظيف الفائض المالي المتحقق في فترة ارتفاع أسعار النفط وإنشاء مثل هذه الصناديق لأغراض سواء كانت استثمارية أم ادخارية.

Abstract

The attribute private international legal relationships according to the conflict of laws approach and the defects resulting from applying that approach that known as the “conflict of laws crisis”, which seriously caused the need to develop a new approach that overcomes the obstacles surrounding of working with the traditional approach based on attributing private international legal relations in accordance with certain standards previously Prepared regardless of the nature of the relationship.
This necessitated the initiate of a new approach named as the objective rules approach, which has been required since its appliance to determine the legal rule that will apply to relationship without any need to involve the rules of attribution. This application was soon expanded and extended by two sources, the first one , which are those rules adopted by the national legislator. even the second one manifested in rules of international origin. However, these special conditions, no matter how important they are, do not completely change the requirements of attribution and the traditional approach.

ان اسناد عقود التجارة الدولية على وفق منهج تنازع القوانين الى قانون ما استتبع ذلك بعض من الاخفاقات والمساوئ عرفت فيما بعد بأزمة تنازع القوانين التي استدعت جدية التفكير باستحداث منهج جديد يتخطى العقبات التي تكتنف سبيل العمل بالمنهج التقليدي القائم على اسناد العلاقات القانونية الدولية الخاصة بناء على مجموعة ضوابط معدة سلفا من قبل المشرع الوطني وبغض النظر عن طبيعة تلك العلاقة . وتبعا لذلك تم استحداث منهج جديد يدعى بمنهج القواعد المادية الذي يطرح منذ تبنيه النص القانوني الذي يحكم العلاقة دون الاضطرار الى المرور بقاعدة الاسناد ، وما لبث هذا المنهج ان توسع ليتم تغذيته برافدين من القواعد المادية الاولى هي تلك القواعد المتبناة من قبل المشرع الوطني والثانية تتجلى بالقواعد ذات المصدر الدولي الناتجة عن مجموعة اتفاقات دولية ،غير ان هذه القواعد المادية ومهما كانت اهميتها فإنها لا تلغي تماما قواعد الاسناد والمنهج التقليدي .

Abstract

This study aims to demonstrate the interrogation procedures and methods used by the interrogator when writing down the statements of the employee present before the investigation, whether before the investigative committees formed for this purpose in the department to which he belongs or before the judicial investigative authorities after the violating employee has been referred to them, as well as identifying Correlation factors between these procedures by indicating the extent of the impact of the investigation conducted by the administration and its findings and recommendations on the merits of the decision issued by the competent criminal court, especially if the employee committed an act in which he violated the provisions of the career system and at the same time this act constitutes a crime according to the Penal Code. This is in order to reach a decision-making that achieves justice in a way that would provide a real guarantee for the administration and the public right on the one hand, and a guarantee for the employee’s rights from another side.

أن تطوّر التقنيات الذكية جلب تحوّلًا في نظرة البشر للتفاعل بينهم وبين الآلات، إذ تم استحدث الوكيل الذكي الاصطناعي كأنموذجًا جديدًا لهذا التفاعل، إذ أصبحت قدراته تتجاوز التفاعل المباشر وتقترب من مفهوم الوكيل الفعّال بدرجة كبيرة، ويلعب الوكيل الذكي الاصطناعي دورًا مؤثرًا في حياة الإنسان، حيث يستطيع تحليل معلومات المستخدم وتلبية احتياجاته بفعالية كبيرة ومتقدمة جدًا.
لذا فأن هذا التحول في التفاعل أعاد تعريف مفهوم العقد، حيث أصبح بإمكان البشر إبرام عقود مع الوكلاء الذكيين الاصطناعيين، لذا فقد تنشأ من هنا تحديات قانونية جديدة لم تكن معروفة سابقًا، مثل تحديد مواعيد تكوين العقد في سياق التفاعل مع الوكيل الذكي الاصطناعي وإمكانية منحه الشخصية القانونية.
يبرز هذا البحث أهمية فهم تأثير الوكلاء الذكيين الاصطناعيين على العلاقات التعاقدية والتحديات القانونية التي يمكن أن تطرأ في ظل هذا التحول الرقمي، وبالتالي يلزم التحفظ والتفكير العميق لتكوين إطار قانوني مناسب يحقق التوازن بين التطور التكنولوجي والحماية القانونية، ومن هنا جاءت فكرة البحث للوصول الى تنظيم قانوني يُعنى بالوكيل الذكي الاصطناعي.

يكتسب نظام النفقات اهمية كبيرة ينبثق من كونه يمثل مرتكزا اساسيا في تكوين عوائل قوية واسر متماسكة يتكافل اعضائها تكافلا طوعيا فطريا في السراء والضراء من خلال ما يتضمنه هذا النظام .

Some federal constitutions, in their distribution of competencies between the federal authority and the authorities of the regions, on specific topics, adopt the method of joint competencies, so that the two parties to the subscription exercise them together, without either of them being alone in them, drawing up public health policy. For the development and prosperity in the world, especially in the field of trade and investment , olso the large number of cases before the courts, which has become one of the reasons for the delay in resolving and wasting time and other problems created in this field, which prompted people to search for another way to resolve disputes between them, and this means is arbitration taken as a means of settling disputes between persons and taken by peoples since time immemorial, which is the auxiliary judiciary of the official judiciary. The arbitration award is the judgment issued by the arbitrator or arbitral tribunals, and it may be national or foreign. There is a relationship between the arbitration and the national judiciary in several aspects, including taking temporary measures and precautionary measures, and implementing the arbitration award and the selection of arbitrators, arbitration agreement and arbitral procedures, and the type of this relationship that has become the subject of controversy and dispute, some jurisprudences' considered it a dependent relationship and there are those who acknowledge it as an, except independent relationship through researching and studying all the justifications it appeared to us that relationship between the arbitral award and the national judiciary is a complimentary relationship complements each other.

بالنظر إلى التغيرات التي حدثت في العالم وخصوصاً في مجال التجارة والاستثمار، وكذلك كثرة القضايا أمام المحاكم والتي أصبحت سببا من أسباب التأخر في حسم الدعاوى، و إهدار الوقت و إشكاليات أخرى ظهرت في هذا المجال، مما دفع الأشخاص إلى البحث عن وسيلة أخرى لحل المنازعات الواقعة بينهم، وهذه الوسيلة هي التحكيم الذي أتخذ كطريقة لفض المنازعات بين الأشخاص و المتخذ من قبل الشعوب منذ القدم وهو القضاء الرديف للقضاء العادي. وحكم التحكيم هو الحكم الصادر من قبل المحكم أو الهيئات التحكيمية وقد يكون وطنياً أو أجنبياً، وهناك علاقة بين التحكيم والقضاء الوطني من عدة جوانب، ومنها اتخاذ التدابير الوقتية والإجراءات التحفظية و تنفيذ حكم التحكيم و اختيار المحكمين و اتفاق التحكيم و الإجراءات التحكيمية، و نوع هذه العلاقة هي التي أصبحت محل جدل و خلاف، من الفقه من أعتبرها تبعية و هناك من أقر بها كعلاقة مستقلة، إلا انه من خلال بيان ودراسة جميع المبررات تبين لنا أنها تختلف لكونها ذات علاقة تكاملية بحيث تكمل بعضها بعضا.

Abstract

The legal (mechanical) rules that are included in the civil law are considered as general rules directed to every understanding of a specific legal text, such as the rule (it is undeniable that the terms change with the change of time), or as rules of interpretation of the text, whether for contracts, or any linguistic text, such as the rule (what matters are the purposes and meanings, not the words and buildings), so they are rules. It falls within the scope of (understanding and applying the legal rule), most of which emanate from the legal mechanistic sciences, such as the science of the principles of jurisprudence, logic, and linguistics. These sciences are termed the mechanistic sciences, because they are sciences that serve others. This is what we notice in the rules of interpretation, as they are distinguished from the substantive and procedural rules contained in the texts. Legislation changes with time and place in its content, ruling, and function.

Abstract

God Almighty has blessed His servants with a law whose primary purpose is based on bringing interests to them and perfecting them, and warding off and minimizing evils, leading to an integrated system of life. Therefore, no one is left with a need that he does not fulfill in what is best for him and for the good of society. Therefore, financial transactions in Islam are legislated to achieve those interests without injustice or transgression. Or unfairness, and certainly for all causes of harm, conflict, and dispute. Therefore, the legislation of contracts for these financial transactions was to provide an ideal model for organizing people’s lives and facilitating them according to a legitimate approach in which interests are achieved and harms and hardships are averted. Any action or dealing that does not achieve this is considered waste, corruption, and a restriction of rights. Here, laxity emerged as a measure in facilitating contracts for the contractor and giving him a period of deliberation and thought so that his haste does not lead to him being subjected to fraud and deception. And then he incurs huge losses with undesirable consequences. Therefore, laxity was one of the means developed to protect the satisfaction of the contractor who was exposed to him as a result of injustice and unfairness, and to achieve a contractual balance between the contracting parties, and this is by protecting performance according to the will of the contractor. Then the balance is based on the qualitative performance of the contractor However, we find that it was not stipulated by the Iraqi legislator because he was satisfied with the rule that the contract is the law of the contracting parties, unlike the French and Yemeni legislators.

لقد انعم الله سبحانه وتعالى على عباده بشريعة مقصدها الأساسي تقوم على جلب المصالح لهم وتكميلها، ودرء المفاسد وتقليلها وصولا الى نظام متكامل للحياة بالتالي لم يترك للمرء حاجة الا قضاها بما يصلحه ويصلح المجتمع، لذلك شرعت المعاملات المالية في الإسلام لتحقيق تلك المصالح دون ظلم او تعد او اجحاف ، وقطعا لكل أسباب الضرر والنزاع والخصام لذلك كان تشريع العقود الخاصة بهذه المعاملات المالية لتقديم نموذج امثل في تنظيم حياة الناس والتيسير عليهم وفق منهج شرعي تتحقق معه المصالح وتدرا به المفاسد والمشاق فان أي تصرف او تعامل لا يحقق ذلك يعتبر اهدار وافساد وتضييق للحقوق ومن هنا برز التراخي كإجراء في تيسير العقود على المتعاقد ومنحه مهلة من التروي والتفكير لكي لا يؤدي تسرعه الى وقوعه تحت طائلة الغش والخداع ؛ ومن ثم تكبده خسائر جسيمة لا يحمد عقباه لذلك كان التراخي وسيلة من الوسائل التي وضعت لحماية رضا المتعاقد الذي يتعرض له نتيجة الحيف والجور، وتحقيق توازن عقدي بين المتعاقدين وهذا يكون عن طريق حماية الأداء وفق إرادة المتعاقد ؛ من ثم يقوم توازن على الأداء الكيفي للمتعاقد ، الا اننا نجد بالرغم من ذلك عدم النص عليه من قبل المشرع العراقي لكونه مكتفي بقاعدة ان العقد شريعة المتعاقدين بعكس المشرع الفرنسي واليمني .

Abstract

Public employment laws sought to create a kind of balance between the obligations and rights of both the public administration and the public employee during the period of the employment relationship, starting from appointment and ending with disengagement from the job by regular or exceptional means. The public employee enjoys a set of guarantees, which provides the employee with the full opportunity to prove his innocence and ward off any behavior directed at him, whether in word or deed, that constitutes a violation of the laws and regulations regarding the employee. The disciplinary system is an integral part of the functional system, and these systems are divided into three: The administrative system in discipline: in which the disciplinary process is undertaken by the administration alone, without the participation of external parties. The quasi-judicial system of discipline, in which the disciplinary process is undertaken by the administration, along with another party outside it. The judicial system in disciplinary matters: in which the judicial authority or an entity outside the administration undertakes the entire disciplinary process. At the end of the study, we concluded that the administrative system of discipline is valid in job legislation in which the job is occupied temporarily, and is not valid in legislation that adopts the corps system or permanent job employment. In the quasi-judicial system, the distribution of jurisdiction between the two parties is based on referring the external party to take measures.
And all the penalties. We concluded that the judicial system provides the greatest amount of guarantees for the employee.

Abstract

سعت قوانين الوظيفة العامة إلى خلق نوع من التوازن بين التزامات كل من الإدارة العامة والموظف العام وحقوقها خلال فترة العلاقة الوظيفية ابتداءً من التعيين وانتهاء بفك الارتباط الوظيفي بالوسائل العادية أو الاستثنائية.
يتمتع الموظف العام بمجموعة من الضمانات ما يهيئ الفرصة الكاملة للموظف في إثبات براءته ودرء كل ما يوجه إليه من تصرف سواء كان قولاً أم فعلاً يشكل مخالفة للقوانين والأنظمة هذا فيما يخص الموظف.
ان النظام الانضباطي جزء لا يتجزأ من النظام الوظيفي وتنقسم تلك النظم الى ثلاثة هي:
النظام الاداري في التأديب: وفيه تتولـّى عمليه التأديب جهة الادارة وحدها دون ان تشاركما جهات خارجية.
النظام شبه القضائي في التأديب: وفيه تتولـّى عملية التأديب جهة الادارة, بجانب جهة أخرى خارجها.
النظام القضائي في التأديب: وفيه تتولـّى الجهة القضائية أو جهة خارجه عن الادارة عملية التأديب بأكملها.
في نهاية الدراسة انتهينا الى ان النظام الاداري في التأديب يصلح في التشريعات الوظيفية التي تشتغل فيها الوظيفة بطريقه مؤقتة ولا يصلح في التشريعات التي تأخذ بنظام السلك أو دائمه التشغيل الوظيفي.
اما في النظام شبه القضائي فان توزيع الاختصاص بين الجهتين يتم على اساس تحويل الجهة الخارجية اتخاذ الاجراءات والعقوبات جميعها.
خلصنا القول بان النظام القضائي يرتب اكبر قدر من الضمانات للموظف.

Abstract

The customs and traditions of religious rituals have their sanctity in every sect or school of jurisprudence. Rather, it criminalizes anyone who works to detract from those rituals, especially since they have no meaning in countries with multiple sects. Therefore, it became necessary to work in constitutions to give freedom of religion and work. To respect every religion, and not to distinguish or prefer one religion over another, but rather to impose punishment against any person who incites or denounces any sect or religion, Therefore, the international community has worked to shed light on it, by working on the necessity of legislation criminalizing these opposition groups that refuse to criminalize any action or behavior that affects the feelings and freedom of religions, and to educate people about this phenomenon. Therefore, most internal legislation has made it clear to direct punishment against any person who disparages any sect. Anyone who violates its religious rituals or calls for strife and sectarian strife will be punished by imprisonment and a fine.

ان الاعراف والتقاليد للشعائر الدينية لها قدسيتها لدى كل طائفة او مذهب فقهي, بل يعمل على تجريم اي شخص يعمل على الانتقاص من تلك الشعائر, خاص كونها تأخذ غير معنى في الدول ذات المذاهب المتعددة, لذا اضحت الضرورة الى العمل في الدساتير الى اعطاء حرية الاديان والعمل على احترام كل دين, وعدم تميز او تفضيل دين عن الاخر, بل اوجب العقاب ضد اي شخص يقوم بالتحريض او الانتقاص ضد اي مذهب او دين, لذا فقد عمل المجتمع الدولي في تسليط الضوء عليها, بالعمل وجوب تشريع يجرم تلك المناهضات الرافضة تجريم اي عمل او تصرف يمس شعور الاديان وحريتها, وتثقيف الشعوب عن تلك الظاهرة, لذا فقد اوضحت اغلب التشريعات الداخلية على توجيه العقوبة ضد اي شخص يقوم بالانتقاص من اي طائفة والمساس بشعائرها الدينية او يدعوا الى الفتن والنعرات الطائفة, يكون عقوبتها السجن والغرامة.

Abstract

The issue of climate change has occupied the attention of the international community for a period of time, and international conferences were held for it and various issues were discussed. It has become a specter threatening the international community, which must confront it, which prompted the former Secretary-General of the United Nations (Ban Ki-moon) to say, “The danger of climate change to humanity is similar to the danger of climate change.” Wars, climate change is something that cannot be ignored, environmental deterioration at the global level has not been stopped, and we are exploiting natural resources in a way that causes great harm.”
The global nature of the climate change phenomenon has made it the primary concern of the international community, which has worked to include it on the international policy agenda and make it a priority on the list of concerns of countries and organizations by emphasizing the necessity of cooperation on the part of all countries and their participation in an effective international response to confront this phenomenon.

Abstract

In the last three years using the governance term became more popular in many fields like economic and social ones.
So, it became necessary for many countries especially the developing ones to adopt the governance as a part of their working law and since the governance is a system and each system needs mechanisms to be actually applied. These mechanisms work together in a harmonious active frame for creating a safe working environment that prevails justice, discipline, credibility and achieving the balance by protecting the weak member which represents the worker and also restricting the authories of employer, and achieving benefits of other members by approving behaviour control inside the project, especially the employer's behaviour which should be away of the utilitarian behaviour or using his power in arbitrary way, and preventing the exit from established protective rules which decided in the labor legislation، all that can be done through four mechanisms with different goals.

Abstract

Legislative councils around the world have settled on the use of electronic voting within parliament, to ensure the secrecy of voting and to ensure the freedom of a member of the legislative council to vote with whatever opinions he wants without being affected or falling under any political pressure from the party to which he belongs in the event that secrecy of voting is approved. It also enables During electronic voting at other times, knowing the directions of the general parliamentary blocs regarding the decisions and draft laws presented in the Legislative Council, in the event that public electronic voting is approved. But the matter is different in the Iraqi Council of Representatives, the federal legislative authority, as this council still resorts to the method of public manual voting by raising Hands in all cases of voting on decisions and laws within the dome of Parliament, as the bylaws of this Council do not stipulate the use of electronic voting. Rather, Article (36/First) of the bylaws of the Council specifies the tasks of the rapporteurs of the House of Representatives to monitor the process of counting and sorting the votes after the vote. This text clearly indicates, albeit implicitly, the use of public manual voting.

المجالس التشريعية في العالم قد استقرت على استخدام التصويت الالكتروني في داخل قبة البرلمان ، لضمـان سرية التصويت وضمان حرية عضو المجلس التشريعي في التصويت بما يشاء من اراء دون التأثر والوقوع تحت اي ضغط سياسي من الحزب الذي ينتمي اليه في حال اقرار سرية التصويت ، كما يمكن من خلال التصـويت الالكتروني في اوقات اخرى معرفة توجهات الكتل النيابية العامة حول القرارات ومشروعات القوانين التي تطرح في المجلس التشريعي ، في حال اقرار التصويت الالكتروني العلني ، لكن الامر يختلف في مجلس النواب العراقي ، السلطة التشريعية الاتحادية ، اذ ما يزال هذا المجلس يلجأ الى طريقة التصويت اليدوي العلني برفع الايادي في كافة حالات التصويت على القرارات والقوانين داخل قبة البرلمان ، اذ لم ينص النظام الداخلي لهذا المجلس على استخدام التصـويت الالكـتروني ، بل ان المادة (36/اولاً) من النظام الداخلي للمجلس قــد حددت مهـام مقررا مجلس النواب بمراقبة عملية عد وفرز الاصوات بعد التصويت ، وهذا النص يشير بشكل واضح وان كان ضمنياً لاتباع التصويت اليدوي العلني

Abstract

Natural resources pose many problems in countries that adopt a federal system, due to the high income that comes from them. Oil and gas wealth is considered one of the most important resources that contribute fundamentally to supporting the economy in countries. There is no doubt that examining the issue of the system of ownership and management of oil and gas wealth is one of the most important resources that contribute fundamentally to supporting the economy in countries. Important topics related to Iraqi affairs from all political, economic, and social aspects, as it is the main source of national income, and the income of this resource, as stipulated in the Constitution of the Republic of Iraq for the year 2005 in Article (111) thereof, returns to the party that has supreme sovereignty, provided that it is The federal government has the administration of it with the governments of the regions and governorates, according to what is stated in Article (112) of the Constitution. However, these texts regulating the ownership and management of oil and gas are fraught with ambiguity, as Article (112) of the Constitution has caused many problems between the federal government and the regions as well as the governorates in the process of Extracting oil and gas, as the government in the region interpreted the extraction of oil present in its lands as its jurisdiction. As for the federal government, it demanded that the region hand over the oil produced to the government in accordance with what was stipulated in the constitution. Therefore, the issue of ownership and management of oil and gas is considered one of the most serious controversial issues in Iraq due to its concentration in areas Iraq's northeastern and southern regions lack it, while the central and western regions lack it, which gave credit to the judicial body represented by the Federal Supreme Court, as the faithful protector of the people's rights, to solve the problem of interpreting the ownership and management of oil. It also addressed the issue of the unfair distribution of natural resources, due to the deficiency and ambiguity in the texts regulating it. By highlighting its role in protecting the rights of the Iraqi people stipulated in the Constitution as the guarantor of those rights

تشغل المصادر الطبيعية العديد من الإشكالات في الدول التي تتبنى النظام الاتحادي، ذلك بسبب الدخل المرتفع الذي يأتي منها ، وتعد ثروة النفط والغاز من اهم الثروات التي تساهم بشكل أساسي في دعم الاقتصاد في الدول، ولاريب إن بحث موضوع نظام ملكية وإدارة ثروة النفط والغاز يعد من المواضيع المهمة التي تتعلق بالشأن العراقي من جميع النواحي السياسية، والاقتصادية ، والاجتماعية، حيث يعد المصدر الرئيسي للدخل الوطني، ودخل هذا المورد حسب ما نص علية دستور جمهورية العراق لسنة 2005 في المادة (111) منه يعود إلى الجهة مالكة السيادة العليا، على أن تكون للحكومة الاتحادية الإدارة فيه مع حكومات الأقاليم والمحافظات حسب ما جاء في المادة (112) من الدستور، بيد انه ينتاب تلك النصوص الناظمة لملكية وإدارة النفط والغاز الغموض، إذ تسببت المادة (112) من الدستور العديد من المشكلات بين الحكومة الاتحادية والأقاليم فضلا عن المحافظات بصدد استخراج النفط والغاز, حيث فسرت الحكومة في الإقليم استخراج النفط الموجود في أراضيها هو من اختصاصها, أما الحكومة الاتحادية فقد طالبت الإقليم بتسليم النفط المنتج للحكومة وفقا لما نص علية الدستور، لذا تعد مسالة ملكية وإدارة النفط والغاز من اخطر القضايا الجدلية في العراق لتركزه في مناطق العراق الشمالية الشرقية والمناطق الجنوبية منه، بينما تفتقر مناطق الوسط والغرب له, مما عزا بالهيئة القضائية المتمثلة بالمحكمة الاتحادية العليا بوصفها الحامي الأمين لحقوق الشعب بحل مشكلة تفسير ملكية وإدارة النفط ، كما عالجت موضوع عدم عدالة التوزيع للثروات الطبيعية، بسبب النقص والغموض في النصوص الناظمة لها من خلال إبراز دورها في حماية حقوق الشعب العراقي المنصوص عليها في الدستور بوصفها الضامن لتلك الحقوق .

Regulatory Framework for the Use of Cyber Mercenaries under International Law

Abstract

The emergence of a new type of mercenary, represented by cyber mercenaries, especially with the subject's lack of international regulation, has led many States to use and purchase their services for the range of advantages offered by such use, since attacks by cyber mercenaries pose a challenge to the concept of direct participation in hostilities provided for in the article. (47) of Additional Protocol I to the Geneva Conventions, since the port of the cyberattack may be far from confrontational, yet it does harm directly and significantly to the other party. The use of cybercrime mercenaries is a real challenge to accountability and punishment, for the difficulty of identifying the mercenary and establishing the link between him and the user.
We have adopted the analytical curriculum in our study of the research topic and have concluded a number of results, the most important of which is, International conventions dealing with mercenaries, such as Additional Protocol I to the 1977 Geneva Conventions, The 1977 OAU Convention on the Elimination of Mercenarism in Africa, The 1989 International Convention against the Recruitment, Use, Financing and Training of Mercenaries was all incomplete and inadequate in defining the concept of mercenary because it did not cover all forms of mercenarism, especially modern ones, and because it took the traditional approach established under the article. Abstract

ان ظهور نوع جديد من المرتزقة متمثلا بالمرتزقة السيبرانيين , خاصة مع افتقار الموضوع للتنظيم على الصعيد الدولي , دفع العديد من الدول الى استخدامهم وشراء خدماتهم لمجموعة المزايا التي يوفرها ذلك الاستخدام , حيث ان الهجمات التي يقوم بها المرتزقة السيبرانين تشكل تحديا لمفهوم المشاركة المباشرة في الاعمال العدائية الوارد النص عليه في المادة ( 47 ) من البروتوكول الاضافي الاول لاتفاقيات جنيف , اذ من الممكن ان يكون منفذ الهجوم السيبراني بعيد كل البعد عن حظ المواجهة ومع ذلك يقوم بالحاق الضرر بشكل مباشر وكبير بالطرف الاخر و يمثل استخدام المرتزقة السيبرانيين تحدياً حقيقياً للمسائلة والعقاب , لصعوبة تحديد المرتزق واثبات الصلة بينه وبين الجهة التي استخدمته .
وقد اعتمدنا المنهج التحليلي عند دراستنا لموضوع البحث وانتهينا الى عدد من النتائج يتمثل اهمها في , ان الاتفاقيات الدولية التي تناولت موضوع المرتزقة كالبروتوكول الإضافي الأول لاتفاقيات جنيف الصادر عام 1977 , و اتفاقية منظمة الوحدة الافريقية للقضاء على الارتزاق في افريقيا لعام 1977 , والاتفاقية الدولية لمناهضة تجنيد المرتزقة واستخدامهم وتمويلهم وتدريبهم لعام 1989 اتسمت جميعها بالنقص والقصور عند تحديدها لمفهوم المرتزق وذلك لكونها لم تشمل كل صور الارتزاق وخاصة الحديث منها ولكونها اخذت بالنهج التقليدي الذي أُسس بموجب المادة (47) من البرتوكول الإضافي الأول , و ان من الصعب تحقق اسناد المسؤولية الدولية الى الدولة في الوقت الحاضر و يتوقف تحقق ذلك على تطور التقنيات التي تجعل اثبات علاقة الدولة بالمرتزقة السيبرانيين امر لا لبس فيه و بأدلة رقمية لا يمكن دحضها .

Abstract

The aim of this research is to study the Employing Technological Variable in Managing the US-China Conflict. This research depends on the inductive approach, which means starting from the specific towards the generalization, as it focuses on studying one variable, the technological variable, to create a preliminary perception of the state of conflict between the United States and China, and then it can be generalized later on the nature of the conflict between the two parties in general as a suitable model for measurement. This study hypothesized that technology plays a pivotal role in the framework of the conflict management process between the United States and China, as it is employed at the heart of conflict management processes at all levels, especially in the field of supporting military, economic and media capabilities, and in the field of enhancing soft and smart power, based on its paramount importance in promoting different elements of strength. This study found that there is a difference between hard and soft power, as hard power depends on the military and direct use of force, in contrast to soft power that relies on attractive and legitimate sources such as work in international, cultural and popular institutions and public diplomacy.

تنشأ منازعات الحدود النهرية عندما تكون هناك خلافات بين دولتين أو أكثر حول تحديد الحدود النهرية بينهما، إذ تؤدي الموارد المائية الحيوية والاقتصادية دورا هاماً في هذه المنازعات، فالأهمية المتزايدة للأنهار وخاصة مع تطور وسائل استخدام واستحداث الطاقة ، جعلت منها مصدراً ضرورياً لاقتصاد الدولة فضلاً عن أهميتها في جوانب عديدة للدولة، وهذا ما قد يدفع بعض الدول الى الطمع في استغلال اكبر قدر من مياه الأنهاء حتى وأن كانت خارج حدودها، مما ينتج عن ذلك حدوث نزاع مع الدولة الأخرى التي يتم الاعتداء على حصتها من النهر المشترك مع الدولة المعتدية. ولا تنحصر منازعات الحدود النهرية بهذا المظهر فقط ، بل تتعدد نتيجة لتعدد الدوافع والأسباب لحدوث هذه المنازعات وهذا الأمر يجعل من طبيعة هذا المنازعات متغيرة وفق المسببات التي كانت وراء حدوثها. ويقابل حدوث أي نزاع حدودي وجود طرق تسوية تتناسب مع طبيته حيث تتعدد طرق تسوية المنازعات الحدودية وتنقسم الى صنفين وهما طرق التسوية القضائية وغير القضائية، وبكل الأحوال قد تعجز طرق التسوية عن حل النزاع مما ينتج ذلك تفاقم الأزمة وحدوث توترات بين الدول محل النزاع الحدود لتصل أحياناً الى حدوث حرب بينهم .

(Artificial Intelligence) will sweep away the legislative rules that are not compatible with it, if not most of it. From that, and since; “It is not denied that rulings change with the change of time.” There is no choice but for our legislator to accept and exploit the idea of the existence of (robots), as they are imposed on him as a reality, even if they have been a little slow in entering our lives in Iraq due to the slowdown in its scientific and productive development.
It is likely soon that within a few years there will be human robots with artificial intelligence, equipped with the ability to discriminate, and with the free will to make and implement decisions. The robot, although it is clear that it may not acquire the status of a natural person, as it has a nature different from the nature of a human being, nevertheless, these generations of intelligent and (similar) humanoid robots will pose a legal problem represented by their legal definition. We cannot define them as an asset or merely... Machines, which may not be properly defined as a human being, a natural person, or even a legal entity. This requires creating a new legal definition or concept, and empowering it with the appropriate and necessary qualifications for the actions and legal damages it will cause in its shared life with humans.

لا بد ان الوقائع (الالكترونيَّة) التي بدأت (العلوم) بفرضها على مستقبلنا بـ(ذكاء اصطناعي) ستغير المشهد (القانوني) الإنساني بحتمية باتت مؤكدة، الأمر الذي يستدعي بدء المشرع بوضع مهمة (التغَيّر) في الفكر (القاعدي) القانوني موضع التنفيذ. فـ(الذكاء الاصطناعي) سيجرف ما لم يتواءم معه من قواعد التشريع، إن لم نقل جُل سواندها كذلك. ومن ذاك، وحيث إنه؛ "لا ينكر تغير الاحكام بتغير الازمان"، فلا محيص لمشرعنا من قبول، واستثمار فكرة وجود (الروبوتات)، فهي مفروضة واقعاً عليه وإن تأنت قليلاً في دخولها حياتنا في العراق بفعل تباطئ تطوره العلمي والإنتاجي.
فمن المحتمل القريب أن تتوفر في غضون سنوات قليلة روبوتات بشرية ذات ذكاء اصطناعي، ومجهزة بالقدرة على التمييز، بالإرادة الحرة على اتخاذ القرار وتنفيذه. فالروبوت، وإن كان من الواضح أنه قد لا يكتسب مكانة الشخص الطبيعي، اذ أنه يمتلك طبيعة مختلفة عن طبيعة الإنسان، إلا أن تلك الأجيال من الروبوتات الذكية و(الشبيهة) بالبشر ستطرح مشكلة قانونية تتمثل في تعريفها القانوني، فلا يمكننا تعريفها كأحد الأصول أو مجرد آلات، وقد لا يصلح تعريفها، كالإنسان، شخص طبيعي، ولا حتى اعتباري. الأمر الذي يستلزم خلق تعريف أو مفهوم قانوني جديد، وتمكينها من الأهلية المناسبة واللازمة لما ستأتيه من أفعال وأضرار قانونية في حياتها المشتركة مع البشر.

تمتاز الدعوى الانضباطية بميزات خاصة تميزها عن الدعوى المدنية حيث انها لا تخضع للمبدأ العام في الاثبات الذي يقضي بان تكون الحجة على المدعي ابتداءً ثم ينتقل تقديم هذا العبء بين اطراف الدعوى , وان هذا التميز ناتج عن طبيعة هذه الدعوى التي يكون محل الاثبات فيها عمل قانوني صادر عن الجهة الإدارية تجاه الافراد, وان عبء اثبات هذا المحل ينتقل من الفرد بعده المدعي والطرف الاضعف في الدعوى إلى الجهة الإدارية بعدها المدعى عليه والتي تحوز أو تحتكر كافة المستندات وغالبا ما يكلفها القضاء بتقديم محل الاثبات الذي يكون بحوزتها والذي يجب إن يكون تصرفا قانونيا منتجا في حسم النزاع موضوع الدعوى الانضباطية للوصول إلى التوازن بين اطراف الدعوى ولتحقيق العدالة المنشودة .

In the current era, technology (electronic automation) is one of the most important tools that are used in all fields, it raises the level of performance and contributes to facilitating work, organizing and mastering it, thus reducing the effort required for its performance and providing the time required for its completion, and it is no secret to the reader that the legislative institution is based on democracy in the process of enacting laws regulating the lives of peoples, and this process because of its complexity, requires members of the house of representatives to make a great effort to complete it quickly and with high quality, and therefore the legislative institution needs supportive means that raise the level of its members and increase their effectiveness, and the applications of electronic automation are one of the most important modern technological means that play a major role in developing the work of the legislative authority and increasing its effectiveness by developing the performance of parliamentarians and workers in the legislative institution by mixing the automated element with the human element, and mechanizing legislative work, so that the administrative departments within the legislative institution as well as parliamentary and technical cadres rely on electronic means in completing the stages of the legislative process such as the discussion and voting stages, for example.

في العصر الحالي تُعتبر التكنولوجيا (الأتمتة الإلكترونية) من أهم الأدوات التي تُستخدم في جميع المجالات، فهي ترفع من مستوى الأداء وتُسهم في تسهيل الأعمال وتنظيمها واتقانها، وبالتالي تخفيض الجهد المطلوب لأدائها وتوفير الوقت اللازم لإنجازها، ومما لا يخفى على القارئ أن المؤسسة التشريعية تقوم على أساس الديمقراطية في عملية سن القوانين المُنظمة لحياة الشعوب، وهذه العملية لما فيها من تعقيد، تتطلب من أعضاء مجلس النواب بذل جهد كبير في إنجازها بسرعة وجودة عالية، وبالتالي فالمؤسسة التشريعية بحاجة الى وسائل داعمة تعمل على رفع مستوى اعضائها وزيادة فاعليتهم، وتُعد تطبيقات الأتمتة الإلكترونية من أهم الوسائل التكنولوجية الحديثة التي تلعب دورا ً كبيرا ً في تطوير عمل السلطة التشريعية وزيادة فاعليتها عن طريق تطوير أداء البرلمانيين والعاملين في المؤسسة التشريعية من خلال مزج العنصر الآلي مع العنصر البشري، وميكنة العمل التشريعي، بحيث تُصبح الأقسام الإدارية داخل المؤسسة التشريعية وكذلك الكوادر النيابية والفنية معتمدة على الوسائل الإلكترونية في إنجاز مراحل العملية التشريعية كمرحلتي المناقشة والتصويت مثلاً.

Abstract

Guarantees of human rights and basic freedoms are considered important to ensure the actual existence of these rights and freedoms. This is because what is important is not the texts that include human rights and basic freedoms as much as it is important to respect them and ensure their protection if they are not respected through guarantees that include principles and mechanisms. These guarantees may be a set of legal principles and rules included in the legal system in the state, and they are usually called legal guarantees. They may be represented by a group of organizations and bodies concerned with defending human rights and basic freedoms and seeking to promote them, which is the goal of their establishment. This research deals with human rights and basic freedoms by providing the necessary guarantees for them that allow individuals to enjoy the rights and freedoms recognized by the constitutions without obstacles, and without distinguishing them between one individual and another. All of these are guarantees that prevent attacks on the rights and freedoms of individuals. The most prominent of these guarantees are (constitutional, judicial, and legal guarantees). In addition to political and social guarantees, these guarantees have a major role in the principles and values of human rights, raising generations, introducing them, respecting them, adhering to them, and demanding them. The research problem has been identified by the existence of violations of human rights and freedoms in many countries, especially developing countries, where the existence of laws and constitutions that may They are merely theoretical texts that have no value on the ground, as there must be guarantees to protect these rights and freedoms and prevent attacks on them, whether by public authorities in the state or by some individuals and groups. This research will focus on highlighting the guarantees that will make individuals enjoy all Their basic rights and freedoms and ensures that they are not violated.

تُعد ضمانات حقوق الانسان وحرياته الأساسية مهمه لكفالة الوجود الفعلي لهذه الحقوق والحريات ، وذلك أنه ليس المهم نصوص متضمنة لحقوق الانسان وحرياته الأساسية بقدر ما يهم احترامها وكفالة حمايتها إذا لم تحترم عبر ضمانات تكون وفق مبادئ واليات . وهذه الضمانات قد تكون مجموعة المبادئ والقواعد القانونية التي يتضمنها النظام القانوني في الدولة ، ويطلق عليها عادة الضمانات القانونية ، وقد تتمثل في مجموعة المنظمات والهيئات التي تعني بالدفاع عن حقوق الانسان وحرياته الأساسية والسعي إلى ترقيتها ، وهو الهدف من انشائها . ويتناول هذا البحث حقوق الانسان وحرياته الأساسية من خلال توفير الضمانات اللازمة لها والتي تتيح للأفراد التمتع بالحقوق والحريات التي اقرتها الدساتير دون عوائق ، ودون تفرقه بين فرد واخر ، وكلها ضمانات تحول دون الاعتداء مع حقوق الافراد وحرياتهم ومن ابرز هذه الضمانات ( الضمانات الدستورية والقضائية والقانونية ) ، فضلاً عن الضمانات السياسية والاجتماعية ، وهذه الضمانات لها دور كبير في مبادئ وقيم حقوق الانسان وتربية الأجيال والتعريف بها واحترامها والتمسك والمطالبة بها ، وقد حددت مشكلة البحث بوجود انتهاكات لحقوق الانسان وحرياته في كثير من الدول وخاصة الدول النامية حيث لا يكفي وجود القوانين والدساتير التي قد تكون مجرد نصوص نظرية لا قيمه لها على ارض الواقع ، اذ لابد من وجود ضمانات لحماية تلك الحقوق والحريات وتمنع الاعتداء عليها سواء من السلطات العامة في الدولة أو من قبل بعض الافراد والجماعات ، وهذا البحث سوف يتركز على ابراز الضمانات التي من شانها أن تجعل الافراد يتمتعون بكافة حقوقهم وحرياتهم الأساسية وتضمن عدم انتهاكاتها .

Abstract

The Constitution was established with the aim of verifying the extent to which laws and regulations approved by the legislative or executive authority are compatible with the Constitution in accordance with the principle of the sovereignty of the Constitution over all other laws and judicial rulings. The Constitution is the highest and most sublime rule in legal institutions, and perhaps the aim of the rulings issued as unconstitutional is to stop the issuance process if the law or legislation has not been issued, or in order to take procedures to abolish or refrain from implementing them if those laws have already been issued, and accordingly The effects of rulings issued as unconstitutional are nothing but a means by which the framers of the country’s constitution ensure full respect for all its provisions and rules, whether by the legislative, executive, or judicial authority alike in Iraq. The research problem was expressed in answering the main question: What are the rulings issued as unconstitutional? Constitutional? Through the comparative descriptive and analytical research method, it was found that the ruling violating the constitution must be issued by a court affiliated with the supreme judicial authority in accordance with the regulating law. Given the non-compliance with the constitution and the law in some rulings and procedures, the judge completes his task by issuing a ruling of unconstitutionality. Therefore, the Iraqi legislator must develop special texts about the effects of The invalid procedure on previous and subsequent procedures and how to adhere to them is considered a special chapter, as well as the necessity of expanding the correction of invalid rulings that violate the Constitution and approving them in the changed laws in Iraq.

Abstract

أنشئ الرقابة على الاحكام والقوانيين بهدف التحقق من مدى توافق القوانين واللوائح التي أقرتها السلطة التشريعية أو التنفيذية مع الدستور وفقا لمبدأ سيادة الدستور على سائر القوانين والأحكام القضائية. فالدستور هو أعلى وأسمى القواعد في المؤسسات القانونية، ولعلّ الهدف من الأحكام المصدرة بعدم الدستورية هو إيقاف عملية الإصدار إذا كان القانون أو التشريع لم يتم إصداره، أو من أجل القيام بإجراءات الإلغاء أو الامتناع عن تطبيقها إذا ما كانت تلك القوانين قد تم إصدارها بالفعل، وعليه فآثار الأحكام المصدرة بعدم الدستورية ما هي إلا وسيلة يكفل بها واضعو الدستور في البلاد ضمان الاحترام الكامل لجميع بنوده وقواعده سواء من قبل السلطة التشريعية و التنفيذية والقضائية على حد سواء في العراق وتم التعبير عن مشكلة البحث في الإجابة على السؤال الرئيسي: ما هي الأحكام المصدرة بعدم دستوريتها؟ وبمنهج البحث الوصفي والتحليلي المقارن تبين أنه يجب أن يصدر الحكم المخالف للدستور من محكمة تابعة للسلطة القضائية العليا وفقا للقانون المنظم، ونظرا لعدم الالتزام بالدستور والقانون في بعض الأحكام والإجراءات فالقاضي يكمل مهمته بإصداره حكم بعدم الدستورية، لذا ينبغي على المشرع العراقي وضع نصوصاً خاصة حول آثار الإجراء الباطل على الإجراءات السابقة واللاحقة وكيفية الالتزام بها في هذا اعتبار فصل خاص وكذلك ضرورة التوسع في تصحيح الأحكام الباطلة المخالفة للدستور وإقرارها في القوانين المتغيرة في العراق.

But with the spread of the Corona pandemic that struck the world، the e-learning system has become a reality that imposes itself on the educational process in various parts of the world، as this system has become the only solution to the continuity of the educational process، which prompted all countries، including the Republic of Iraq، to rely on e-learning.
After the growth of this new educational system، and its transition from a mere idea to a system that has been adopted in various countries of the world، there has become an urgent need to legislate the necessary laws to address the e-learning system، so that there is legal protection that guarantees the quality of the educational process. Our research came to study the regulatory and legal framework for e-learning، because e-learning from our point of view is not a temporary solution that ends with the end of the Corona virus، but it is a curriculum and a modern educational system.

بعد ان كان التعليم الالكتروني عبارة عن ظاهرة من الظواهر التي افرزتها ثورة الاتصالات والتقدم الهائل في مجال التكنولوجيا، والتي تنامت في الآونة الأخيرة بشكل كبير، إلا أن هذه الظاهرة لم يتم تطبيقها والاعتراف بها في كثير من الدول ومنها العراق.
ولكن مع انتشار جائحة كورونا التي ضربت العالم، اصبح نظام التعليم الالكتروني واقع يفرض نفسه على العملية التعليمة في مختلف ارجاء العالم، إذ بات هذا النظام هو الحل الوحيد لاستمرار ديمومة العملية التعليمية، وهو ما دفع جميع الدول ومنها جمهورية العراق، للاعتماد على التعليم الالكتروني.
وبعد نمو هذا النظام التعليمي الجديد، وانتقاله من مجرد فكرة إلى نظام تم تبنيه في مختلف دول العالم، أصبحت الحاجة ملحة إلى تشريع القوانين اللازمة لمعالجة نظام التعليم الالكتروني، بحيث تكون هناك حماية قانونية تضمن جودة العملية التعليمية. وقد جاء بحثنا ليدرس الاطار التنظيمي والقانوني للتعليم الإلكتروني؛ وذلك لأن التعليم الالكتروني من وجهة نظرناً ليس حل مؤقت ينتهي بانتهاء فايروس كورونا، إنما هو منهج ونظام تعليمي حديث.

Abstract

The operations of trading in the stock market are no longer limited to trading traditional securities. Rather, the need for financing, achieving profits, and making financial and in-kind assets free from investment risks, this matter made more vulnerable to development; As a result, innovative products appeared in response to the need of investors, and among these products are financial derivative contracts, and the idea of these contracts is that their value depends on the value of the assets from which they are derived.
This study aims to clarify the legal regulation of financial derivative contracts with the help of presenting the positions of the legislations that regulated these contracts in light of the absence of legal regulation in the Iraqi legislation. For this reason, we divided this study into two sections. In the first topic, we dealt with the legal scope of financial derivative contracts, and the second topic explained the legal provisions for financial derivative contracts in terms of the legal nature and mechanism of implementation.
As we reached several conclusions, the most important of which is that financial derivative contracts have their own legal nature, and cannot fall under one of the well-known laws, and the implementation of financial derivative contracts is characterized by a different mechanism. As the implementation of the contract may result in either the contract being settled definitively, or it may be settled by concluding an opposite deal. Consequently, controlling financial derivative contracts must be regulated by legislation; The legislator is called to keep abreast of what is happening in the stock market, and this can only be done by updating its laws, providing an atmosphere that suits the investor’s aspirations in the market and providing him with protection.

إنَّ عمليات التداول في سوق الأوراق المالية لم تعد مقتصرة على تداول الاوراق المالية التقليدية, بل إنَّ الحاجة إلى التمويل, وتحقيق الارباح, وجعل الاصول المالية والعينية بمنأى عن مخاطر الاستثمار, هذا الامر جعلَ أكثر عرضة للتطور؛ ونتيجة لذلك, ظهرت منتجات مبتكرة تمثل استجابةً لحاجة المستثمرين, ومن هذه المنتجات, هي عقود المشتقات المالية , وفكرة هذه العقود إنَّها تعتمد في قيمتها على قيمة الاصول التي تُشتق منها.
تهدف هذه الدراسة إلى بيان التنظيم القانوني لعقود المشتقات المالية بالاستعانة بعرض مواقف التشريعات التي نظمت هذه العقود في ظل غياب التنظيم القانوني في التشريع العراقي؛ ولأجل ذلك, قسمنا هذه الدراسة الى مبحثين, تناولنا في المبحث الأول, النطاق القانوني لعقود المشتقات المالية, والمبحث الثاني بيّنا فيه, الاحكام القانون لعقود المشتقات المالية من حيث الطبيعة القانونية وآلية التنفيذ.
حيث توصلنا إلى نتائج عدة, من اهمها, إنَّ عقود المشتقات المالية لها طبيعتها القانونية الخاصة, ولا يمكن أن تنضوي تحت إحدى القوانين المعروفة, كما إن تنفيذ عقود المشتقات المالية تتميز بآلية مختلفة؛ إذ قد ينتج عن تنفيذ العقد إما تسوية العقد بصورة نهائية, او يتم تسويته بإبرام صفقة معاكسة. بالتالي, إنَّ ضبط عقود المشتقات المالية لا بد من تنظيمها تشريعيًا؛ فالمشرع مدعوٍ إلى مواكبة الحاصل في سوق الأوراق المالية وهذا لا يتم إلا بتحديث قوانينه, وتوفير المناخ الذي يتلاءم وتطلعات المستثمر في السوق وتوفير الحماية له.

Abstract

After Saddam Hussein's regime was overthrown in 2003, the US decided to pursue its interests in the Middle East (ME) despite the interests of the ME countries. This strategic vision became evident in the strategy that guided US policy toward the region.
By examining the rationale behind these programs and their outcomes, we hope to examine the key components of US policy in the ME, particularly in Iraq. In order to further their objectives, the US imposed hegemony on the ME countries and subsequently on the global system during the occupation of Iraq, setting a new precedent for US relations with the region's nations.
The purpose of the study is to analyze America's strategy in the ME, especially the case of Iraq (Starting from the stage of the military invasion of Iraq in 2003 until 2011), also the direct and indirect motives for the America's occupation in Iraq, and the America's strategy followed in Iraq after 2003, as for the decisions it took in Dissolving the Iraqi Army (DIA) and the Ba'ath Party (BP), the consequences of which were disastrous for the Iraqi state. Despite the US ability to change and amend strategies, it was unable to achieve the stated goals that it invoked when it invaded Iraq, and its military strategy ended in failure.

ومن خلال دراسة الأساس المنطقي لهذه البرامج ونتائجها، ستتناول هذه الورقة البحثية المكونات الرئيسية لسياسة الولايات المتحدة في الشرق الأوسط، خاصة في العراق. ومن أجل تحقيق أهدافها، فرضت الولايات المتحدة هيمنتها على دول الشرق الأوسط، وبالتالي على النظام العالمي المحتل في العراق، مما شكل سابقة جديدة في العلاقة بين الولايات المتحدة ودول الشرق الأوسط.
والهدف من هذه الدراسة هو تحليل الاستراتيجية الأمريكية في الشرق الأوسط وخاصة في حالة العراق (ابتداءاً من مرحلة الغزو العسكري للعراق عام و٢٠٠٣ لغاية عام ٢٠١١ )، وذلك للتعرف على الدوافع المباشرة وغير المباشرة للاحتلال الأمريكي للعراق والاستراتيجية الأمريكية التي أعقبته في العراق بعد عام 2003، حيث تم تفكيك الجيش العراقي وحزب البعث. الذي كانت نتائجه كارثية على الدولة العراقية. وعلى الرغم من قدرة الولايات المتحدة على تغيير وتعديل استراتيجيتها، إلا أنها فشلت في تحقيق الأهداف التي رسمتها من غزو العراق وكانت استراتيجيتها العسكرية فاشلة.

When a person utters the word of monotheism, he will be among the saved and victorious, and he utters the word of disbelief, then he will be among the losers. He utters in front of the guardian and witnesses, saying, “The girl’s guardian, marry me your daughter, or your sister,” and he says to him. : Your wife...so this girl becomes his wife, from whom he can learn from her what is not permissible for a father or mother to know, and this heavy documented contract, the marriage contract, can be broken by the husband pronouncing the word divorce, which is a word that means dissolving the marriage knot, so that marriage is not a prison. Free yourself from him, there is a divorce for the husband and a divorce for the wife, and if they separate, God will enrich each of his ability. What is the matter with some Muslims when they have taken their religion as a mockery and a game, and whenever one of them gets agitated or angry, he finds nothing but this dangerous word to utter? If he is asked, he says that he did not mean it and that his intention was sound. It is better for a Muslim to protect himself and his family from this absurdity, and not to make mistakes. This situation destroys his life and the lives of his wife and children, and this is not the business of rational people. We have no choice but to seek a way out of such a situation. There is divorce used in the form of an oath, and this matter causes confusion for the husband and wife for fear of falling into forbidden sins. Due to the importance of the topic, we divided this research. Into two requirements, the first requirement dealt with the definition of the oath and its legitimacy in Sharia and law. لابد أن يدرك الإنسان أن الكلمة لها خطرها، ينطق بها اللسان فيترتب عليها النجاة أو الهلاك, عندما ينطق الإنسان بكلمة التوحيد فيكون من الناجين الفائزين، واذا نطق بكلمة الكفر فيكون من الهالكين الخاسرين، اما عندما ينطق الرجل أمام الولي والشهود بقوله لولي الفتاة زوجني ابنتك، أو أختك فيقول له: زوجتك.. فتصبح هذه الفتاة زوجة له , وهذا العقد الوثيق الغليظ عقد الزواج الا انه يمكن أن ينفصل هذا العقد عندما ينطق الزوج بكلمة الطلاق, وهي كلمة تعني حل عقدة النكاح, فحتى لا يكون الزواج سجنا" لا مخرج منه شرع للزوج الطلاق وللزوجة الخلع، وإن يتفرقا يغن الله كلا من سعته. فما بال بعض المسلمين وقد اتخذوا دينهم هزوا ولعبا، وكلما ثار الواحد منهم أو غضب لم يجد سوى هذه الكلمة الخطيرة ينطق بها، فإذا ما سئل قال أنه لم يكن يقصد وأن نيته سليمة، فالأولى بالمسلم أن يجنب نفسه وأهل بيته عن هذا العبث، وألا يضع نفسه هذا الموضع فيدمر حياته وحياة زوجته وأبنائه، وليس هذا من شأن العقلاء من الناس، وما كان لنا الا أن نلتمس مخرجا لمثل هذه الحالة فهناك الطلاق المستعمل على صيغة اليمين, وهذا الأمر يسبب ارباكا" لزوج والزوجة خشية الوقوع في الحرام ولأهمية الموضوع قسمنا هذا البحث الى مطلبين تناولت في المطلب الاول تعريف اليمين ومشروعيته شرعا" وقانونا" اما المطلب الثاني تناول انواع اليمين واحكامه شرعا" وقانونا".

Abstract

One of the most important legal issues that has occupied the minds of researchers in the field of law is the issue of protecting the weak party in consumption contracts, which is the consumer, and trying to strike a kind of balance between him and the supplied merchant, who represents the stronger party, as he is an expert and professional in his field of work, which can create a gap between him and the consumer. This balancing act is achieved by obliging the stronger party in the contract (the merchant) to inform the consumer of everything that would enhance consumer satisfaction in terms of the terms and conditions of the contract and product specifications. It is a preventive means to protect consumer satisfaction, which finds its origin within the scope of the civil law, which obliges that the seller must inform the buyer of the item sold and its specifications, especially in the French Civil Code, which derived its provisions from Roman law under what is called (the principle of the right to know about the item sold), as the Roman law sought to eliminate the seller’s fraud and deception regarding hidden defects in the item sold, so it was obligatory for the seller to inform the buyer as it was considered minor. Experience was the best preventive means of protecting the consumer, so consumer legislation stipulated this obligation. The research under review, tagged with “the supplier’s obligation to inform the consumer in consumption contracts - a comparative study between the European directive of 2011 and the Iraqi consumer protection law,” is one of the researches that dealt with this topic. It highlighted many of the problems of the Iraqi legislator’s handling of this issue in the Iraqi Consumer Protection Law No. 1 of 2010, compared to the European directive in this regard for the year 2011, and detailed it in precise detail, given the weakness of the Iraqi consumer culture on the one hand and the shortcomings and confusion contained in our Iraqi consumer legislation. And sometimes a deficiency compared to European guidance.

Abstract

من اهم المسائل القانونية التي شغلت بال الباحثين في مجال القانون مسألة حماية الطرف الضعيف في عقود الاستهلاك والذي يتمثل بالمستهلك ومحاولة اجراء نوع من الموازنة بينه وبين التاجر المجهز الذي يمثل الطرف الأقوى باعتباره خبيرا ومحترفا في مجال عمله ،مما يمكن ان يخلق هوة ما بينه وبين المستهلك ،وتتم هذه الموازنة من خلال الزام الطرف الأقوى في التعاقد (التاجر) بإعلام المستهلك بكل ما من شانه ان يعزز الرضا لدى المستهلك من حيث ظروف التعاقد وشروطه ومواصفات المنتج ،فهو وسيلة وقائية لحماية رضا المستهلك ،والذي يجد منشأه في نطاق القانون المدني الذي اوجب على البائع ان يعلم المشتري بالمبيع ومواصفاته ، وخاصة في القانون المدني الفرنسي الذي استقى احكامه من القانون الروماني تحت ما يسمى (مبدا حق العلم بالمبيع ) حيث كان القانون لروماني يسعى للقضاء على غش وتدليس البائع للعيوب الخفية في المبيع ،فكان لزاما على البائع اعلام المشتري باعتباره قليل الخبرة ،فكانت افضل وسيلة وقائية لحماية المستهلك لذلك نصت التشريعات الخاصة بالمستهلك على هذا الالتزام ، ويعد البحث محل المراجعة والموسوم ب " التزام المجهز بإعلام المستهلك في عقود الاستهلاك -دراسة مقارنة بين التوجيه الأوربي لعام 2011 وقانون حماية المستهلك العراقي" من البحوث التي تناولت هذا الموضوع وسلطت الضوء على الكثير من إشكاليات معالجة المشرع العراقي لهذا الموضوع في قانون حماية المستهلك العراقي رقم 1 لسنة 2010 بالمقارنة مع التوجيه الأوربي بهذا الصدد لعام 2011 وفصلت فيه تفصيلا دقيقا ، نظرا لضعف ثقافة المستهلك العراقي من جهة وما ينطوي عليه تشريعنا العراقي المتعلق بالمستهلك من قصور ولغط ونقص في بعض الأحيان بالمقارنة مع التوجيه الأوربي .

Abstract

The 2013 agreement regulating navigation in Khor Abdullah is legally enforceable for both Iraq and Kuwait unless it is modified or canceled by either party. Therefore, the actions of the internal authorities of both nations cannot nullify this agreement from an international perspective, affecting both parties involved. It's parties must implement the agreement in good faith, and local law cannot be used as a justification for not executing its provisions.

تعد اتفاقية تنظيم الملاحة في خور عبد الله لعام 2013 هي اتفاقية نافذة وملزمة للطرفين ما دام لم يتم تعديلها او انهاءها من لدّن العراق والكويت، ويترتب على هذا ان تصرفات السلطات الداخلية لكلا الدولتين لا يمكن ان تلغى هذه الاتفاقية من الناحية الدولية، ومن ثم على اطرافها تنفيذها بحسن نية ولا يمكن الاحتجاج بالقانون الداخلي كمسوغ لعدم تنفيذ احكام تلك الاتفاقية.
