Abstract: The central seizure administrations, the local the institutions and the security services practice their roles to counter-terrorism in Iraq, and to maintain the public security according to the Iraq Republic, constitution of 2005 in force and the internal legislation, that is done through a collection of legal mechanisms and means representing the regularity resolution and the individual decisions which are oriented towards the individuals and the legal acts that are characterized by the protective characteristic ,moreover, the boundaries of the seizure administration of counter terrorism and maintaining the public security , are extended and stricture in the normal circumstances more than the exceptional ones, since the exceptional circumstances need more strict and quick procedures and measures to be taken, to force such circumstances do because seizure procedures that the administration should take in the normal circumstances do not let the administration control bodies, and thus the administrative control power will be able to issue regulations which can to considered, in the normal circumstances, getting out of the legitimacy, put they can be considered legal, if they are issued in the exceptional circumstances to maiming the public security.
