Abstract

occupied a high position in the hearts of human beings, but they
are a vital necessity without which a human being cannot achieve
a human life in which dignity or honor is one of the highest
human values, if not their names at all. The basics of human
existence and his life were born with him, and there is no life or
richness for one over the other. Therefore, it becomes a guarantee
of rights and freedoms. The public is the sole purpose of all legal
and illegal systems and rules. Therefore, the current era has
prevailed, a philosophical trend that calls for ensuring the greatest
degree of public rights and freedoms for individuals in the face of
administration as the repository and headquarters of authorities.

administration resorts in many countries of the world to the use of
precautionary measures to confront everyone who threatens the
public order with its various elements in the state. The executive
authority relies on it to impose its hegemony in the state under the
pretext of the existence of an exceptional case that requires the
