Abstract
Public office is one of the fundamental pillars upon which the state relies to carry out its tasks in order to provide for the needs of all people. Due to the importance of public office, the criminal legislator has criminalized a set of behaviors and actions that may be committed by an employee while performing his job duties. The criminal legislator used to rely on the Iraqi Penal Code No. 111 of 1969 in criminalizing these actions, but due to the widespread abuse of public office, the Iraqi criminal legislator issued a special law to protect public office in all government institutions from any exploitation and misconduct, which is the Iraqi Integrity Commission Law No. 36 of 2011.
Abstract
يعد الوظيفة العامة من الركائز الأساسية التي تستند إليها الدولة في تنفيذ مهامها من اجل تقديم احتياجات الناس كافة، ولهذه الأهمية التي تتمتع الوظيفة العامة، فقد جرم المشرع الجنائي مجموعة من السلوكيات والأفعال التي قد تصدر من الموظف عند قيامه بمهام وظيفته، إذ أن المشرع الجنائي كان يعتمد على قانون العقوبات العراقي رقم 111 لسنة 1969 في تجريم هذه الأفعال، ولكن لكثرة انتشار الإساءة لاستخدام الوظيفة العامة فقد اصدر المشرع الجنائي العراقي قانوناً خاصاً يحمي الوظيفة العامة في جميع المؤسسات الحكومية من أي استغلال وسوء عمل، وهو قانون هيئة النزاهة العراقي رقم 36 لسنة 2011.
