Abstract
International humanitarian law is defined as linked to the pursuit of humanitarian protection during armed conflicts, because it aims to regulate conflicts and alleviate the suffering of civilians, whether in times of peace or war, and when we apply it to the Gaza Strip, and the security, economic, social and political turmoil it witnessed after October 7/2023, the Israeli war on the Gaza Strip is an example Hail to the intertwining of international humanitarian law and human rights. Israeli practices have led to widespread violations of international laws, raising questions about the effectiveness of these laws and in protecting human rights, as although there are conventions such as the Geneva Conventions and Additional Protocols aimed at protecting civilians and combatants who are no longer able to fight, but adherence to them has been absent in this case. International law has succeeded in some cases in alleviating the suffering of peoples and promoting peace after war, but it faces significant challenges in preventing or ending conflicts due to the lack of political will and strong implementation mechanisms. To achieve lasting peace, international law must be part of a comprehensive approach that encompasses diplomacy, justice and development.Thus, the research aims to identify the concept of international humanitarian law, and the challenges facing it as a result of armed conflicts, as well as to shed light on the humanitarian and legal reality in the Gaza Strip. One of its most important conclusions is: the weak commitment to international humanitarian law, there is a clear failure by the conflicting parties to respect its rules, which leads to serious violations of the rights of civilians, as well as the need for comprehensive solutions to address the challenges of international humanitarian law in Gaza that end the conflict and lay the foundations for a just peace.
