Abstract
إنّ الدساتير هي أداة تنظيم الحياة القانونية، والسياسية في الدولة، ويحدد لكل سلطة من سلطات الدولة اختصاصاتها وصلاحياتها وكذلك يضع الحدود الضابطة لنشاطها بما يؤدي إلى عدم تدخل أي منهما في أعمال الاخرى، ويوجب مبدأ الفصل بين السلطات على كل سلطة احترام السلطات الاخرى وعدم التدخل في شؤونها وأن تستقل كل سلطة من سلطات الدولة بممارسة اختصاصاتها، ومع ذلك ووفقاً لنصوص الدستور فإنّ السلطة التشريعية صاحبة الاختصاص في تنظيم القضاء. وهناك مجموعة من مباديء أو قيود التي وضعها الدستور أو يستخلص من روح الدستور، والذي يجب على سلطة مختصة بالتنظيم ان تأخذها بالاعتبار وتتقيد بها وهي بصدد ممارستها لهذا الاختصاص وعدم التجاوز عليها، ويستلزم استقلال القضاء الدستوري ان يكون له وحده النظر في الدعاوي التي تدخل ضمن اختصاصاتها المحددة في الدستور أو القوانين، أو أن تنفرد بالبت فيها دون تدخل السلطات الاخرى، ويجب أن يكون ذلك قيداً على سلطة المشرع في تنظيم القضاء الدستوري وظيفياً، بحيث لايتمكن من التجاوز على تلك القيود عند ممارسة اختصاصه بهذا الخصوص.
