Abstract
Any administration, when carrying out its duties to serve the public interests,
must set out a system to control the behaviour of individuals within society in
practicing their rights, which is known as administrative control. The function
of administrative control is one of the most important administrative function
that is related to the personal freedom and rights of individuals. Despite all of
the restrictions it places on the freedoms of individuals, administrative control
eventually enables those individuals to maintain public order, which in turn
benefits the society. As the individual interests serves the society interests, it
can be said that administrative control is a blessing for individuals.
Administrative control is the lifeline of the organized movement of public
order. Through administrative control authorities, the State tries to protect the
security and safety of individuals from risks as well as from the risks and
spread of diseases and maintain serenity in urban and public places.
If the administrative control, however, goes beyond the limits set for it by law,
its acts will be illegal. This raises the notion of the administration liability for its
acts, which may be rendered revocable and require compensation in there are
grounds for that

أن الإدارة وهي تؤدي واجباتها في تحقيق الصالح العام لابد لها أن تضع نظاما يضبط سلوك الأفراد داخل المجتمع في ممارستهم لحقوقهم وهو ما يسمى بالضبط الإداري، إذ تعد وظيفة الضبط الإداري من أهم الوظائف الإدارية التي تمس الحرية الشخصية للأفراد وحقوقهم . ورغم كل القيود التي ينفرد بها الضبط الإداري على حريات الأفراد فانه في النهاية يقوم على خدمة هؤلاء الأفراد بالحفاظ على النظام العام الذي تعود فائدته على المجتمع فلما كانت مصلحة الفرد من مصلحة الجماعة هنا يمكن أن نقول أن الضبط الإداري نعمة على الفرد، فالضبط الإداري هو عصب السير المنتظم والحسن للنظام العام، أن الدولة بواسطة سلطات الضبط الإداري تهدف إلى حماية امن الأفراد من المخاطر وسلامة حياتهم، وأيضا تهدف إلى حمايتهم من مخاطر الأمراض وانتشارها والمحافظة على السكينة العامة في المدن والأماكن العامة .فإذا ما خرجت سلطات الضبط الإداري عن الحدود المرسومة لها قانونا فان أعمالها في هذا الشأن تكون غير مشروعة وتثار هنا مسؤولية الإدارة عن أعمالها الضبطية وتكون جديرة بالإلغاء والتعويض أذا كان لذلك مقتضى .
