جسم الإنسان هو عبارة عن مجموعة متكاملة من الأجهزة والأعضاء المختلفة ظاهرة وباطنه، وتقوم هذه الأعضاء بوظائف عديده ومختلفة، والاعتداء الذي يشكل مساساً باستغلال الطفل قد يقع على الجسد ذاته وقد يؤثر في مقدرة الطفل بالاستمرار بالعيش بشكل طبيعي بين اقرانه وقد يؤثر عليه من ناحية ابتزازه وتوريطه في جرائم يتم من خلالها باعتباره مروج او متعاطي للمخدرات مما يضر بأعضاء جسمه فيعطلها عن أداء وظيفتها، والاعتداء يعد بهذه الصورة جريمة فالمساس باستغلال الطفل ليس فقط المساس بمادته، وإنما يعد مساساً بالجسم كل فعل قد يؤثر على مقدرة اعضاء الجسم من أداء وظيفتها، ولو لم يترتب عليه اي اثر مادي ينال جزءاً بعينه من مادة الجسم، لأنه لا قيمة للجسم في ذاته إلا من خلال قدرة أعضائه على أداء وظائفها كاملة.
