في هذا البحث ندرس تحديد مكان الجريمة في التشريع العراقي بشكل عام حيث وجدنا أن هذا التشريع يأخذ بمبدأ اقليمية القانون الجنائي لأنه من مقتضيات سيادة الدولة، فانه الضامن لمصلحة المجتمع والاقدر على تحقيق العدالة وضمان حرية الفرد ورعاية مصلحتة. وذلك لانه مقتضيات سيادة الدولة وذلك لان تطبيق القانون يعتبر مظهرا من مظاهر السيادة للدولة، ولا يمكن للدولة ان تباشر مظاهر سيادتها على غير اقليمها والا تكون قد اعتدت على سلطان الدولة الأخرى.
