Abstract

The present crisis that criminal law is going through on the national and international level, in the face of phenomena that are harmful and dangerous to human life and interests, poses unique challenges due to the fact that of the criminal judge is subject to the principle of criminal legality. The present study investigates the issue of the rigidity of this principle and the extent to which the rules of criminal law are subject to its parameters. Moreover, the present study undertakes an analysis of the compatibility of criminal legality at the international level with its counterpart in national criminal law. The objective of this research is to evaluate judicial attempts to address the legislative deficit. The following research questions will be examined: firstly, what is meant by the concept of criminal legality and how does it differ from the related concept of criminality? Secondly, it is imperative to establish the relationship between international and domestic criminal law. The present discussion encompasses the jurisprudential theories surrounding the aforementioned relationship. The study also identifies the causes of the shortcomings of the rules of criminal legality, particularly international ones, and presents an analysis of how to address the crisis of criminal legislation in the light of the principle of legality in the periods preceding the enactment of the Rome Statute (Statute of the International Criminal Court, 1998) or following this legislation. The study focuses on the various sources that can provide solutions to criminal legality, in addition to written legislation.

Abstract

أن ما يمر به القانون الجنائي على المستويين الوطني والدولي من أزمة حقيقية في مواجهة الظواهر المضرة والخطرة على حياة ومصالح الناس، يشكل تحديات فريدة نظراً لتكبيل القاضي الجنائي بمبدأ المشروعية الجنائية، اذ تناول البحث اشكالية جمود هذا المبدأ ومدى خضوع قواعد القانون الجنائي لمعطياته وتحليل مدى توافق المشروعية الجنائية على المستوى الدولي مع نظيرتها في القوانين الجنائية الوطنية، كما يقيم المحاولات القضائية في مواجهة النقص التشريعي ويستعرض مفهوم وطبيعة مبدأ المشروعية الجنائية وتمييزها عن الشرعية الجنائية، ومدى العلاقة بين القوانين الجنائية الدولية والداخلية ويناقش ما قيل من نظريات فقهية حول هذه العلاقة، كما حدد البحث اسباب النقص في قواعد المشروعية الجنائية وخصوصاً الدولية منها، وقدم تحليلاً لمواجهة ازمة التشريع الجنائي في ضوء مبدأ المشروعية في الفترات التي سبقت تشريع نظام روما (النظام الأساسي للمحكمة الجنائية الدولية 1998) او لاحقت هذا التشريع مع التركيز على المصادر المختلفة التي يمكن لها ان تمد المشروعية الجنائية بالحلول اضافة الى التشريع المكتوب.

Abstract

Civil law is one of the most important laws in all parts of the world, as it regulates the transactions of individuals and society, as well as legal entities. Among the observations, if the expression is correct, are those related to the legislator’s use of terms that do not indicate the true meaning and intent of the legislator, whether within the framework of contracts or privilege rights, which we will discuss in the details of the research. Some of them are within the framework of the organization or the formal and substantive consistency of legislation at the same time, in terms of the sequence and organization of the provisions contained in the legislative code, i.e. the hierarchical form of the provisions, including those related to the provisions and definition of the right of retention for security, in addition to the existence of some contradictions in the substantive provisions that directly affect the substantive legal provisions and have an impact on the legal status of individuals and their rights and obligations, such as the defect in the required capacity of the agent, the prescription of rights resulting from the promise of remuneration, as well as the deviation from justice in voluntary work, which is encouraged by the highest values in society, especially in times of crisis, such as the case of volunteer intervention to ward off public harm.

القانون المدني تشكل احد اهم القوانين على الاطلاق في جميع اصقاع الأرض كونه تنظم المعاملات الافراد المجتمع فضلاً عن الأشخاص المعنوية، فمن الملاحظات ان صح التعبير ما تتعلق باستخدام المشرع للمصطلحات لا يدل على المعنى الحقيقي والقصد المشرع سواء اكان في اطار العقد أو حقوق الامتياز الذي نأتي إليه في تفاصيل البحث، ومنها ما يكون في إطار التنظيم أو التناسق الشكلي والموضوعي في الوقت ذاته للتشريع من حيث تسلسل وتنظيم الاحكام الواردة في المدونة التشريعية أي شكل الهرمي للأحكام منها ما يتعلق بأحكام وتعريف حق الحبس للضمان، فضلاً عن وجود بعض التناقضات في الاحكام الموضوعية الذي تؤثر بشكل مباشر على الاحكام القانونية الموضوعية وله اثر على المراكز القانونية للأشخاص وعلى حقوقهم والتزاماتهم، كما هي الخال في الاهلية المطلوبة للوكيل، والتقادم الحقوق الناجمة عن الوعد بالجعل، وكذلك مجانبة العدالة في الاعمال التطوعية التي يشجع عليه القيم العليا داخل المجتمع لاسيما في أوقات الازمات كحالة تدخل المتطوع لدرء الاضرار العامة.

Abstract

This academic study, entitled "International Intervention to Combat Terrorism and Its Impact on State Sovereignty," examines the nature and justifications of international intervention, the position of international law on it, and its impact on international peace and security, as well as the sovereignty and stability of states. Sovereignty is the core of the traditional structure of international relations and the basis upon which states conduct their relations under international law. Therefore, it is necessary to establish controls to restrict intervention to ensure the principle of state sovereignty, the stability of international relations, and the protection of international peace and security. Perhaps the most prominent conclusion reached by this study is that, in light of current international transformations, national sovereignty has become vulnerable to erosion from the outside due to external pressures and interventions, and from the inside due to international intervention to combat terrorism and its impact on state sovereignty.

Abstract

جاءت هذه الدراسة العلمية بعنوان التدخل الدولي لمكافحة الارهاب وأثره على سيادة الدولة، متناولة ماهية التدخل الدولي ومبرراته، وموقف القانون الدولي منه، وأثره على الأمن والسلم الدوليين، وسيادة الدول واستقرارها. إذ تعد السيادة جوهر البناء التقليدي في العلاقات الدولية، والأساس الذي تمارس عليه الدول علاقتها في ظل القانون الدولي. ومن النتائج التي توصلت لها هذه الدراسة تتمثل في أن السيادة الوطنية في ضوء التحولات الدولية الراهنة أصبحت عرضة للتأكل من الخارج بفعل الضغوطات والتدخلات الخارجية، ومن الداخل بفعل التدخل الدولي لمكافحة الارهاب وأثره على سيادة الدولة.

Criminal Liability Arising from Fraud in Construction Contracting (A Comparative Study)

Abstract

There is no doubt that the significant development witnessed in the construction and building sector, like other sectors of life, has been the most prominent factor driving individuals to rely on construction contracting increasingly. However, this rapid growth and expansion in construction contracting have been accompanied by the emergence of complex legal problems and challenges, which were until recently addressed within the framework of civil and administrative law. These two legal domains have traditionally handled issues arising in this sector and provided appropriate solutions. Nevertheless, the escalation of fraudulent practices in contracting has become a serious threat to individuals' lives and public interest. Such fraud may lead to massive disasters, such as the partial or total collapse of buildings, resulting in human losses like deaths and injuries. This necessitated the intervention of criminal legislators to curb these deviant practices and behaviors by imposing penalties on those who commit such crimes. French and Egyptian legislators have played a major role in this field, while Iraqi legislators have limited themselves to criminalizing specific forms of fraud through general criminalization rules, without covering all its potential forms.

Abstract

لا شك أن التطور الكبير الذي شهده قطاع البناء والإنشاءات كغيرة من قطاعات الحياة، الاثر الابرز في دفع الأفراد إلى الاعتماد على مقاولات البناء؛ إلا أن هذه الزيادة والنمو السريع في مقاولات البناء رافقه ظهور مشكلات وتحديات قانونية كان لوقت قريب تعالج في إطار القانون المدني والإداري فهما اللذان يعالجان ما قد يطرأ على هذا القطاع من مشاكل ويضعان الحلول المناسبة، إلا أن تصاعد حالات الغش في المقاولة بات يشكل تهديداً خطيراً على حياة الأفراد والمصلحة العامة، إذ قد يؤدي هذا الغش إلى كوارث جمه تتمثل في انهيار المباني كلياً أو جزيئاً وما يترتب عن ذلك من خسائر بشرية كالوفيات والإصابات، مما استدعى تدخل المشرع الجنائي لوضع حد لهذه التصرفات والسلوكيات المنحرفة ووضع عقوبات بحق كل من تسول له ارتكاب هذه الجريمة، وكان للمشرع الفرنسي والمصري الدور الكبير في هذه المجال، بينما اقتصر المشرع العراقي على تجريم صور محددة من الغش من خلال القواعد العامة للتجريم، دون تغطية جميع أشكاله المحتملة.

Abstract

A member of parliament is independent in the exercise of his parliamentary function, away from any external influences or pressures. The constitution may grant some privileges and duties to members of parliament that end with the end of their duties. Hence, the constitutions in most representative systems are keen to explicitly stipulate that the representative should devote himself to his membership in Parliament, and this is what It was confirmed by the Iraqi Constitution of 2005. The internal regulations of the House of Representatives, and the parliamentarian was entrusted with some obligations and prohibitions, as well as decided on some rights and duties, which preserve his entity and enable him to perform his parliamentary role entrusted to him.

Abstract

ان عضو البرلمان يكون مستقلا في ممارسته لوظيفته النيابية، بعيدا عن اي مؤثرات او ضغط خارجي، وقد يمنح الدستور بعض الامتيازات والواجبات لأعضاء البرلمان تنتهي بانتهاء مهامهم، لذلك تحرص الدساتير في معظم الأنظمة النيابية على النص صراحة على وجوب تفرغ النائب لعضوية البرلمان، وهذا ما اكد عليه دستور جمهورية العراق لسنة 2005 النافذ؛ واللائحة الداخلية لمجلس النواب، وقد انيطت بالنائب البرلماني بعض الالتزامات والمحظورات كما قرر له بعض الحقوق والواجبات، التي تحفظ له كيانه وتمكنه من اداء دوره البرلماني المعهود اليه.

Employee Commitment to Job Loyalty

Abstract

Job loyalty is undoubtedly a necessary and important condition for the implementation of public office because the last one is a service that needs refers to values, ideals, and virtues that are solely the loyalty of a employee whose loyalty reflects the sincerity and legitimacy of his or her work. Thus, job loyalty is one of the most prominent duties of a public official. However, commitment to it has its limits and increases according to the type of job and the rank of the occupant on the administrative ladder, in addition to the fact that it is an effective job commitment, as what the employee commits to during work is different from what is required after completing his commitment to the job. It has a negative content and does not include the performance of work, even if duties arise from it that involve positive behavior. It means that the employee is committed to avoiding anything that might conflict with the duty of loyalty that he must possess. However, its violation is embodied in material manifestations and the violation results in disciplinary liability or disciplinary and criminal liability or simply the employee’s dismissal from the job.

الولاء الوظيفي بطبيعة الحال شرط ضروري وهام لممارسة الوظيفة العامة، لان الاخيرة هي خدمة تحتاج الى قيم ومثل وفضائل وهذا لا يكون الا بولاء الموظف الذي يعكس بولائه صدقية وشرعية عمله، لذلك يعد الولاء الوظيفي واجبا من ابرز الواجبات التي تقع على عاتق الموظف العام، الا ان الالتزام به تقل حدته وتزداد حسب نوع الوظيفة ودرجة شاغلها في السلم الاداري فضلا عن انه التزام وظيفي متغير فما يلتزم به الموظف اثناء الوظيفة غير ما يلزم به بعد انهاء علاقته بالوظيفة، وهو ذو مضمون سلبي لا يشتمل على اداء عمل وان كان ينبثق عنه واجبات تنطوي على سلوك ايجابي، ومؤداه التزام الموظف بتجنب كل ما من شأنه ان يتعارض وواجب الولاء الذي يجب ان يتحلى به الا ان انتهاكه يتجسد بمظاهر مادية ويترتب على الانتهاك المسؤولية التأديبية او المسؤولية التأديبية والجنائية او مجرد استبعاد الموظف من الوظيفة.

The effectiveness of international arbitration in resolving international commercial licensing contract disputes

Abstract

Some do not differentiate between domestic arbitration and international arbitration on the basis that the will of the parties to the international commercial licensing contract is the basis for arbitration and that the arbitration award is issued according to the choice of the disputing parties. Therefore, arbitration is not considered an act of sovereignty and is not linked to the sovereignty of the state, as arbitration remains neutral, neither national nor international nor domestic. However, as a result of the complexity of international relations and the development of international trade, the arbitration system has developed in these relations, especially in international contracts in which one party is national and the other foreign, to ensure that the latter is not subject to the national law of the other party and for fear of bias, international arbitration has emerged in resolving disputes related to international commercial licensing contracts. Because the commercial licensing contract is predominantly international in nature, as the subject of the contract is the transfer of technical knowledge such as a patent or any trademark, which creates a link that goes beyond the borders of the national economy, several issues arise, including domestic and international arbitration.

هنالك من لا يفرق بين التحكيم الداخلي والتحكيم الدولي على أساس ان ارادة اطراف عقد الترخيص التجاري الدولي هي التي يستند عليها التحكيم وان حكم التحكيم يصدر وفقاً لاختيار الاطراف المتنازعة، لذلك فإن التحكيم لا يعتبر من اعمال السيادة ولا يرتبط بسيادة الدولة حيث يظل التحكيم محايداً ليس بوطني ولا دولي او داخلي، لكن نتيجة تشابك العلاقات الدولية وتطور التجارة الدولية تطور نظام التحكيم في هذه العلاقات خاصة في العقود الدولية التي يكون احد طرفيها وطني والاخر أجنبي لضمان عدم خضوع الاخير للقانون الوطني للطرف الاخر وخوفاً من عدم الحيادية إضافة الى مزايا التحكيم المتمثلة بالسرعة وقلة النفقات والكفاءة المتوفرة لدى المحكمين خاصة في اطار عقود التجارة الدولية هنالك جهات متخصصة برز التحكيم الدولي في فض منازعات عقد الترخيص التجاري الدولي، ولكون عقد الترخيص التجاري تغلب عليه الصفة الدولية حيث يكون محل العقد نقل المعرفة الفنية كبراءة اختراع او اي علامة تجارية بما توجد فيه رابطة تتجاوز حدود الاقتصاد الوطني فتثار عدة مسائل منها التحكيم الداخلي الدولي.

Effects of Registration in the Real Estate Registry

Abstract

The research addressed the topic of the effects of registration in the real estate registry, focusing on the constitutive and purifying effects of registration as two basic pillars of these effects by explaining their concept and the most important consequences of adopting them. It also addressed the most important jurisprudential opinions expressed in this regard, and clarified the position of Iraqi legislation on these effects, while benefiting from the experiences of some Arab and similar legislation, especially Egyptian and Lebanese legislation, with the aim of arriving at the points of similarity and difference between them. The research yielded several results, perhaps the most important of which is that the Iraqi legislator considered registration in the real estate registry a pillar of the legal transaction, contrary to what the legislation in Egypt and Lebanon has adopted. Furthermore, the Iraqi legislator did not adopt the purifying effect of registration and did not give this registration absolute authority, whether it relates to the first registration or the remaining restrictions, unlike the Lebanese legislator.

تناول البحث موضوع آثار القيد في السجل العقاري، حيث ركز على الأثر المنشئ والأثر المطهر للقيد باعتبارهما ركزتين اساسيتين لهذه الآثار من خلال بيان مفهومهما واهم النتائج المترتبة على الاخذ بهما، وكذلك التطرق الى اهم الآراء الفقهية التي قيلت بهذا الصدد، وبيان موقف التشريع العراقي من هذه الآثار مع الاستفادة من تجارب بعض التشريعات العربية والقريبة منه لاسيما التشريع المصري والتشريع اللبناني بغية الوصول الى مواطن التشابه والاختلاف بينهما. ولقد خرج البحث بعدة نتائج لعل اهمها ان المشرع العراقي اعتبر القيد في السجل العقاري ركنا من اركان التصرف القانوني على عكس ما ذهبت اليه التشريعات في مصر ولبنان، كما ان المشرع العراقي لم يأخذ بالأثر المطهر للقيد ولم يضف على هذا القيد حجية مطلقة سواء تعلق الامر بالقيد الاول ام باقي القيود على خلاف المشرع اللبناني.

Abstract

The study of interest in criminal appeals represents a vital topic in Iraqi criminal law due to its significance in ensuring justice and preventing the misuse of the judicial system. Some scholars rightly point out that interest is one of the fundamental conditions for the acceptance of appeals. This condition ensures that an appeal serves as a means of achieving justice rather than prolonging disputes or pursuing unlawful objectives. Given that criminal appeals are essential legal tools that allow the parties involved to review judicial rulings in the pursuit of justice, the interest in criminal appeals has become a cornerstone for the acceptance and effectiveness of such appeals. In this research, I will analyze the concept of interest in criminal appeals, aiming to establish a jurisprudential framework that may serve as a basis for further theoretical development by future researchers.

تمثل دراسة المصلحة في الطعن الجنائي موضوعًا حيويًا في القانون الجنائي العراقي، نظراً لأهميته في ضمان العدالة ومنع إساءة استخدام النظام القضائي، ويشير بعض الفقه – بحق - الى ان المصلحة تعتبر من الشروط الأساسية لقبول الطعون، الذي يضمن أن يكون الطعن وسيلة لتحقيق العدالة وليس لإطالة أمد النزاع أو تحقيق أغراض غير قانونية، وخاصة أن الطعن الجنائي يعد من الأدوات القانونية الهامة التي تتيح للأطراف المعنية مراجعة الأحكام القضائية لتحقيق العدالة، وهذا ما جعل المصلحة في الطعن الجنائي تشكل حجر الزاوية في قبول الطعون وضمان جدواها، وسوف أقوم في هذا البحث إلى تحليل مفهوم المصلحة في الطعن الجنائي محاولاً ان اضع بنياناً فقهياً يصلح لان يتم استكماله نظرياً من قبل الباحثين فيما بعد.

Abstract

The right to reside is considered one of the fundamental human rights that every individual should fully enjoy. It is a primary determinant of a decent living and an adequate standard of life, granting individuals the freedom to exercise their other rights. This right must be protected against infringement and violation by others or by public authorities, as any such encroachment would undermine individual freedom and constitute a violation of other rights associated with the right to housing—except by the law. The international community has paid considerable attention to the right to housing through its conventions, charters, and declarations. Likewise, this right has received significant attention in Iraqi legislation, as reflected in the current Iraqi Constitution and various other legal provisions.

Abstract

يعد الحق في السكن من حقوق الإنسان الجوهرية التي ينبغي أن يتمتع بها كل فرد على أكمل وجه، فهو من محددات العيش الكريم والمستوى المعيشي اللائق والذي يمنح الإنسان الحرية لممارسة حقوقه الأخرى، ويستلزم عدم التعدي والتجاوز على هذا الحق من الغير ومن السلطات العامة لما في ذلك من مساس بحرية الفرد وانتهاكاً لحقوقه الأخرى التي تقترن بحقه في السكن، إلا وفقاً لما يأمر به القانون، وقد نال حق الإنسان في السكن على اهتمام الأسرة الدولية باتفاقياتها ومواثيقها وإعلاناتها، كما حظي هذا الحق باهتمام التشريع العراقي متمثلاً بالدستور العراقي النافذ والتشريعات العراقية المختلفة.

Abstract

The original is that the administrative decision is considered valid and effective from the date of its issuance, and therefore, it is effective against the administration from this date, and any interested party can object to this date against it. However, this decision is not effective against individuals except from the date they become aware of it. If the administrative decision is enforceable against the administration upon its issuance, it is not so against individuals. Therefore, it is necessary for them to become aware of it through one of the legally prescribed media means, which are: announcement for individual administrative decisions, publication for organizational administrative decisions, or by the interested party knowing with certainty the administrative decision, whether individual or organizational.

يُعتبر القرار الإداري صحيحًا ونافذًا اعتبارًا من تاريخ صدوره، مما يجعله ملزمًا للإدارة ابتداءً من هذا التاريخ، ويحق لكل ذي مصلحة الاستناد إليه في مواجهتها، ومع ذلك، لا يُعتبر القرار نافذًا بحق الأفراد إلا من تاريخ علمهم به عبر الوسائل القانونية المقررة للإعلان، وذلك من خلال: الإعلان بالنسبة للقرارات الادارية الفردية، والنشر بالنسبة للقرارات الادارية التنظيمية، أو بعلم صاحب الشأن علمًا يقينيًا بالقرار الاداري سواء كان فرديًا ام تنظيميًا، بينما يسري القرار فور صدوره على الإدارة، يتطلب سريانه تجاه الأفراد إبلاغهم به بشكل قانوني.

Abstract

Identity and eligibility of the electronic contractor are essential elements in any online contracting process, as it is necessary first to verify the identity of the contractor and confirm whether he is the person or entity he claims to be. Various methods can be used, such as verifying the national identity or using online verification services. As well as his legal capacity, he must be legally qualified to enter into a contract, and this means that he is an adult, sane, and not under arrest, as well as verifying that From the use of electronic signature, as it provides a means to confirm the identity of the contracting parties and enhances the credibility of the contract, as well as through the conditions set by the contracting parties that are in a clear and understandable form, which helps the two parties to make appropriate decisions, and to be subject to local and international laws related to electronic commerce and consumer rights in contracting. This enhances confidence between the contracting parties.

إن تحديد هوية واهلية المتعاقد الإلكتروني هو عنصر اساسي في اي عملية تعاقد عبر الانترنت، حيث لابد اولاً من التحقق من هوية المتعاقد والتأكد هل هو الشخص أو الكيان الذي ينتمي اليه المتعاقد، ويمكن استخدام طرق متنوعة مثل التحقق من الهوية الوطنية، أو استخدام خدمات التحقق عبر الانترنت، وكذلك من اهلية القانونية فلا بد أن يكون مؤهلاً قانونياً للدخول في عقد، وهذا يعني إن يكون بالغاً، عاقلاً، وغير محجوز عليه، وكذلك التحقق من استخدام التوقيع الإلكتروني، حيث يوفر وسيلة للتأكد من هوية المتعاقدين ويعزز من مصداقية العقد، وكذلك من خلال الشروط الموضوعة من قبل المتعاقدين التي تكون بصيغة واضحة ومفهومة، مما يساعد الطرفين على اتخاذ القرارات المناسبة، والخضوع للقوانين المحلية والدولية المتعلقة بالتجارة الإلكترونية وحقوق المستهلك في التعاقد مما يعزز الثقة بين الاطراف المتعاقدة.

Abstract

This study aims to reveal the suitability of federalism for the Iraqi society, which suffers from deep ethno-sectarian divisions, by focusing on the nature of the administrative and political decentralized institutionalism. This type of institutionalism has been adopted since the ratification of the 2005 Constitution, which aimed to social stability and integration. However, practically, there has been only one federal subregion—i.e., Kurdistan Regional Government (KRG)—as a natural region that separates Kurds as an ethnic group from the Arab-Iraqis in the rest of the country. That subregion also reflected the historical Kurdish struggle against the Iraqi governments since the independence in 1921. Although the KRG has achieved its semi-independence after the 2005, it has also engaged in many institutional and political tensions as a result the ethnic-based institutions that, as a result, has affected the performance of federalism in the country. Consequently, many legal and political struggles have appeared to the surface, which reached its peak in the referendum of independency from Iraq in 2017. That incident was encountered by the federal government through a limited military action. Therefore, it is required here to achieve both constitutional and political review to make the desired reformation.

تسعى الدراسة الى بيان مدى ملائمة الفدرالية للمجتمع العراقي الذي يعاني من انقسامات شديدة بين الطوائف والقوميات، من خلال التركيز على طبيعة التصميم المؤسسي للامركزية السياسية والإدارية التي اعتمدها الدستور من اجل تحقيق الاستقرار في المجتمع للوصول الى حالة التماسك، الا ان الجانب التطبيقي لم يشهد وحدات فدرالية متعددة بل اقتصرت التجربة على إقليم كردستان وهي لامركزية مبنية على أساس حدود الهوية بين العرب والكرد نظرا لعلاقتهما المتأزمة والصراع شبه المستدام الذي امتد منذ تأسيس الدولة العراقية، ومع ان الإقليم حصل على استقلالية كبيرة بعد عام 2005 الا ان العلاقة مع الحكومة الاتحادية انتابها العديد من الازمات وحالات من عدم الاستقرار وذلك نتيجة امتداد السياسات المبنية على الهوية الى مؤسسات الحكم مما أدى اختلال في عمل الفدرالية، فقد اعتمدت على تلبية الطموحات التي تتعلق بالقومية الكردية والتي يعتبروها عادلة من وجهة نظرهم، مما أدى الى صراع مع الحكومة الاتحادية على اثره اتجهت كردستان الى تنظيم الاستفتاء من اجل الانفصال مما أدى بالحكومة الاتحادية بالتدخل المسلح، وهنا فشلت الفدرالية في تحقيق التماسك مما يتطلب مراجعة سياسية ودستورية من اجل اصلاح للعلاقة اللامركزية بين المستويات المختلفة.

يُعد التغير المناخي مشكلة حقيقية بات يشكلُ هاجساً يؤرق الشعوب والحكومات على حدٍ سواء، لما لهُ من أثر سلبي وتهديداً للحياة البشرية، بسبب تزايد النشاطات البشرية الصناعية من أجل المزيد من الواردات لتلبية الاحتياجات الداخلية مثل المحافظة على مستوى الدخل المرتفع وتنمية الشعوب وغيرها، الا أن ذلك يؤثر سلباً على عناصر الطبيعة ويستنزف مواردها ويؤدي الى احتباس الغازات الدفيئة في الغلاف الجوي المسبب للاحترار العالمي، وهذه المشكلة تتطلب جهوداً دوليةً كبيرة، وجدية حقيقية من أجل مواجهة هذه الظاهرة الخطيرة، الا أن هنالك تبايناً واضحاً في المواقف الجدية لدى الدول الصناعية والنامية في الإيفاء بتعهداتها المبرمة في الاتفاقيات العالمية، وذلك لكون هذه الدول لديها التزامات داخلية في تحقيق الرفاهية لشعوبها، والتزامات خارجية تتمثل في معالجة الانبعاثات التي تنتج عن زيادة النشاط الصناعي.

Abstract

The confrontation between the two opposing poles—the communist pole led by the Soviet Union and the capitalist pole led by the United States—ended with the triumph of liberal values. The international system shifted from a bipolar system to a unipolar system led by the United States. The Soviet Union disintegrated, and faced major dilemmas with the collapse of its institutions and the rise of secessionist movements, which led to Ukraine's independence. As the legitimate heir to the Soviet Union, Russia has striven to maintain cohesion and interconnectedness with the former Soviet republics. This has led to a major debate between East and West over Ukraine, given its strategic location between Russia and the European countries that the United States has used as a tool to undermine Russia's position in its region. This has prompted Russia to focus its attention on Ukraine. Russia is well aware that Ukraine represents the core of Russia's strategic interests, and that its greatest problem lies with what it calls its "near abroad." This explains Russia's fear of the West's reach into its immediate neighborhood, just as Ukraine represents the bulwark separating Russia from the West.

قادت المواجهة بين القطبين المتصارعين، القطب الشيوعي بزعامة الاتحاد السوفيتي والقطب الرأسمالي بزعامة الولايات المتحدة الأمريكية إلى انتصار القيم الليبرالية، والتحول في النظام الدولي من نظام ثنائي القطبية إلى نظام أحادي القطبية بقيادة الولايات المتحدة، وتفكك الاتحاد السوفيتي الذي أصبح يواجه معضلات كبيرة بانهيار مؤسساته، وتزايد الحركات المطالبة بالانفصال التي تمخض عنها استقلال أوكرانيا. وكون روسيا هي الوريث الشرعي للاتحاد السوفيتي، فقد حاولت جاهدة الحفاظ على التماسك والترابط بينها وبين جمهوريات الاتحاد السوفيتي سابقا، وهذا ما جعل العالم يشهد جدلا كبيرا بين الشرق والغرب حول أوكرانيا كونها تحتل موقعا استراتيجيا هاما بين روسيا والدول الأوروبية التي استخدمتها الولايات المتحدة الأمريكية تشكل اداة لزعزعة مكانة روسيا في إقليمها الامر الذي دفع روسيا الى ان تسلط الضوء على اوكرانيا فروسيا تدرك جيدا أن أوكرانيا تمثل جوهر المصالح الاستراتيجية لروسيا، وأن مشكلتها الكبرى مع ما تطلق عليه "الخارج القريب"، وهذا ما يفسر تخوف روسيا من وصول الغرب إلى جوارها القريب كما تمثل أوكرانيا الحصن الذي يفصل روسيا على الغرب.

Abstract

This research aims to address an important topic concerning prohibitions decreed by God Almighty. Temporary prohibitions have an impact on jurisprudential rulings depending on their subjects and categories. When the obstacle is removed or the reason for the prohibition ceases, the ruling returns to its original state without prohibition, allowing it to be applied. One of the areas significantly influenced by this principle is sales transactions. Some sales are permissible for a Muslim to engage in, yet certain circumstances may arise that lead to their temporary prohibition due to a specific reason or a higher wisdom from Islamic legislation. This study examines various issues from different chapters of commercial transactions, illustrating the effect of temporary prohibitions on jurisprudential matters. It also highlights the differences in scholars' perspectives, reasoning, and deductions, as they rely on their understanding and analytical efforts. This discussion fosters intellectual inquiry and jurisprudential interpretation, enabling each scholar to exert effort in deriving conclusions based on their understanding of what is correct.

يهدف هذا البحث الى طرح موضوع مهم من مواضيع النهي التي جاءت من عند الله تعالى، وأن النهي المؤقت له أثر في الأحكام الفقهية على حسب مواضيعها وأبوابها، فإذا زال المانع أو ذهب سبب النهي رجع بلا نهي يجوز الأخذ به وتطبيقه واستعماله، ومن تلك المواضيع الذي له تأثير كبير فيها هي البيوع، فمن البيوع ما يجوز أن يباشرها المكلف المسلم، لكن قد تطرأ عليه ما يمنع من ذلك ويجعله منهي عنه، لسبب أو غاية من الشارع الحكيم، وقد أخذنا مسائل عدة من أبواب مختلفة من البيوع يبين أثر ذلك النهي المؤقت في المسائل الفقهية، واختلاف الفقهاء في وجهات نظرهم في النظر والاستدلال في الباب حسب ما يجتهدون ويتوصلون اليه بنظرهم وفكرهم، وهذا يفتح باب الفكر والاجتهاد حسب جهد كل فقيه وما يراه من حق.

Abstract

The science of the Quran is one of the most esteemed fields of knowledge, and among its noblest aspects is the science of its interpretation and exegesis according to the will of Allah and His Messenger (peace be upon him). This science has a direct relationship with the Holy Quran, as it clarifies its meanings and lofty, noble, and beautiful objectives. For this reason, scholars, both ancient and modern, have hastened, raced, and competed in the field of Tafsir, providing clear and precise interpretations of the Quran, as evident as the sun at noon, without any clouds obscuring it. Who among us does not know the interpretation of Ibn Jarir, or Ibn Kathir, or the "Al-Bahr Al-Muhit" by Ibn Hayyan, or the Tafsir of Al-Baghawi, or other interpretations? Tafsirs continue to emerge and follow one another to this day, whether lengthy, concise, or moderate. I have chosen Ayat Al-Kursi from Surah Al-Baqarah to be the title of my research, hoping that Allah, the Exalted, will assist us in completing it in the best and most complete manner. I have named my research "Ayat Al-Kursi: An Analytical and Foundational Study," and I ask Allah, the Almighty, to benefit me from it in knowledge and action. Our final invocation is that all praise is due to Allah, the Lord of the worlds.

إنَّ من العلوم الرفيعة القدر علم القرآن ومن أشرفها العلم بتفسيرها وتأويلها على حسب مراد الله ورسوله ، فلهذا العلم علاقة مباشرة بالقرآن الكريم، وهي بيان لمعانيه ومقاصده السامية والجليلة الجميلة، ومن أجل ذلك تجد العلماء قديما وحديثاً سارعوا وتسابقوا وتنافسوا في ميدان علم التفسير ففسروا القرآن الكريم تفسيرا دقيقاً واضحاً كالشمس في رابعة النهار ليس دونها سحاب فمن منا لا يعرف تفسير ابن جرير أو تفسير ابن كثير أو البحر المحيط لابن حيان أو تفسير البغوي أو غيرها من التفاسير، وما زالت التفاسير تتوالى وتتابع إلى يوم الناس هذا ما بين مطول ومختصر ومتوسط. وقد اخترت آية الكرسي من سورة البقرة لتكون عنواناً لبحثي راجياً المولى عز وجل أن يعيننا على اتمامها على أكمل وأتم وجه وسميت بحثي (آية الكرسي دراسة تحليلية تأصيلية) وأسال الله تعالى أن ينفعني بها علماً وعملاً وآخر دعوانا أن الحمد لله رب العالمين.

Abstract

This study aims to address an important aspect of the biography of the Prophet Muhammad (peacebeupon him) in his interactions with his noble companions (mayAllah bepleased with them) The Prophet (PBUH) frequently urged his companions to adopt the trait of optimism and to completely avoid pessimism. Optimism became a well-established quality among the companions, as demonstrated in various situations that encompassed all aspects of their daily lives. This is affirmed by historical sources which document numerous instances where optimism and certainty in Allah’s support and victory were clearly evident. These instances spanned spiritual, social, and military dimensions of the Prophet’s life from his blessed mission in Mecca, to his migration and the establishment of his state and leadership in Medina, his city of settlement and noble residence. The impact of optimism was particularly evident during the Prophet’s battles, where he strengthened the resolve of his companions in all circumstances. Their optimism became a positive attribute aligned with the pure guidance of the best of creation (PBUH), reflecting its significance in shaping righteous human behavior. It also granted those who embraced it psychological peace, sound belief, and high motivation, therefore, optimism is seen as the seed of hope and a motivator for ambition and action. It is a clear indicator of a positive outlook for those who embody it. Optimism is a radiant light in times of darkness, a way out of hardship and sorrow, and a means to reduce faults and slips. It is a psychological attitude emphasized by the Messenger of Allah (PBUH), who encouraged his companions (may Allah be pleased with them all) to adopt it. It is inherently linked to faith in Allah and the guidance of His Prophet, as the believer always feels the presence and support of Allah in all aspects of life. These elements will be explored throughout the research.

تهدف دراستنا هذه الى تناول جانب مهم من جوانب سيرة النبي محمد (صلى الله عليه وسلم) مع أصحابه الكرام (رضي الله عنهم) وكان عليه الصلاة والسلام كثيراً ما يوصي أصحابه بالتحلي بصفة التفاؤل، والابتعاد كل البعد عن التشاؤم، وكرست صفة التفاؤل عند الصحابة (رضي الله عنهم) في مواقف عدة شملت جميع جوانب حياتهم اليومية وهذا ما أثبتته المصادر التاريخية التي وردت فيها المواقف التي حصل فيها التفاؤل واليقين بنصر الله وتمكينه وجاءت هذه المواقف لتشمل الجوانب الروحية والاجتماعية والعسكرية في حياة النبي محمد (صلى الله عليه وسلم) منذ مبعثه الشريف في مكة المكرمة وصولاً الى هجرته وتأسيس دولته ومقر سلطته في المدينة المنورة دار استقراره ومقامه الشريف واتضح ذلك في غزواته (صلى الله عليه وسلم) عندما ثبت عزيمة أصحابه في جميع مواقف حياتهم وعد تفاؤلهم صفة إيجابية على الطريقة السوية التي جاء بها خير البرية، لما لها من أهمية تعزيز تصرفات البشرية وتمنح من يتحلى بها سلامة في النفس والعقيدة والهمة العالية، ولهذا يعد التفاؤل بذرة الأمل والتحفيز على الهمة والعمل، تأكيد واضح المعالم في تحقيق الرؤية الإيجابية لمن يتحلى به والتفاؤل هو نور ساطع في الظلمات، ومخرج من الهموم الكربات، وتقليل الخطايا والزلات وهو سلوك نفسي أكد عليه النبي محمد (صلى الله عليه وسلم)، وحث عليه صحابته (عليهم رضوان الله) على اتباع هذا السلوك، فهو مقترن بالإيمان بالله عز وجل وهدي نبيه، لأن المؤمن يستشعر معية الله في جميع مواقف حياته ويستشعر بها، والتي سوف نتطرق إليها في ثنايا البحث.

Furthermore, the research explores a key aspect related to children’s prayer, including their participation, whether it is obligatory for them, and if they receive rewards for performing it. It also addresses the implementation of prayer in schools, shedding light on its benefits, the necessary arrangements for its facilitation, and suggestions for school administrators to ensure its proper observance.

Additionally, it traces the historical relationship between linguistics and criminology, highlighting its role in solving complex and ambiguous cases, identifying terminologies used in criminal contexts along with their meanings, and demonstrating the value of scientific material resulting from the fusion of these two disciplines. One of the key findings is that "forensic linguistics" has recently gained significant space in areas such as text interpretation, plagiarism detection, verbal abuse examination on social media platforms, as well as identifying threats, intimidation, and other forms of verbal aggression. Abstract

This study explores the phenomenon of secularism as one of the most influential intellectual forces that have infiltrated Muslim societies under the guise of modernity and progress. It argues that secularism introduced a radical shift away from the religious framework that traditionally governed both public and private life in the Islamic world. Using a critical analytical approach, the paper traces the Western origins of secularism and its deliberate transfer into Muslim contexts through cultural colonization, especially following the failure of direct military campaigns.
The research then examines the multifaceted impact of secularism on religious, social, moral, cultural, and political levels. It highlights how the enforced separation of religion from daily life did not result in neutrality, but rather led to a disintegration of values, a dilution of identity, and the weakening of the Islamic social and familial structure.
The study concludes that secularism, far from being a mere administrative adjustment, represents a comprehensive attempt to reshape Muslim identity outside its traditional religious foundations. يتناول هذا البحث ظاهرة العلمنة بوصفها واحدة من أخطر الأدوات الفكرية التي تسللت إلى المجتمعات الإسلامية تحت عباءة الحداثة والتقدم، فشكّلت انزياحاً حادًا عن المرجعية الدينية في الحياة العامة والخاصة، ومن خلال منهج تحليلي نقدي، يستعرض البحث جذور العلمانية في السياق الغربي، ويوضح كيف تم تصديرها إلى المجتمعات الإسلامية ضمن مشاريع التغريب الثقافي، لا سيما بعد فشل المواجهات العسكرية المباشرة.
ينتقل البحث إلى تتبّع الآثار التي خلّفتها العلمنة على مختلف الأصعدة: الدينية، والاجتماعية، والأخلاقية، والثقافية، والسياسية، ويوضح أن الفصل القسري بين الدين وشؤون الحياة لم يؤدِ إلى الحياد كما يدّعي أصحابه، بل أدى إلى تفكيك القيم، وتمييع الهوية، وإضعاف البنى الأسرية والاجتماعية التي يشكّل الإسلام أساسها.

Abstract

The study is summarized on the manuscript of the author Ibrahim bin Ismail Abu Rashid Al-Anari, entitled (The Gift of the Beloved in Explaining the Meanings of the Verses of Al-Bayan and Al-Maani by Ibrahim Al-Anari, Study and Investigation). The study was divided into an introduction and a preface, followed by two chapters, the first of which was divided into seven topics in which I dealt with the life of the author, a description of the manuscript, the sources of the manuscript, the methodology of the manuscript, the content of the manuscript, and the objections to the book, with an introduction to rhetorical terms, and then my methodology in the investigation. As for the second, we investigated the texts of the manuscript and untied all the knots that have no evidence of the keys to the doors, since the manuscript followed an incomprehensible methodology and is difficult for the reader to understand, in addition to technical errors centered around the handwriting and its lack of clarification of rhetorical terms. When reading it, the reader feels that these issues are unrelated to the rhetoric sciences. Finally, I dealt with the conclusion, detailing the most prominent results.

This research examines and analyzes the evolution of official US positions and policies toward Taiwan in light of the shifts in US-China relations between 1961 and 1972, across the administrations of John F. Kennedy, Lyndon B. Johnson, and Richard Nixon. By reviewing official US foreign policy documents, intelligence reports, and defense documents, the research demonstrates how US policy progressed from unconditional support for Taiwan to an unprecedented strategic rapprochement with the People's Republic of China, culminating in Nixon's visit to Beijing and the signing of the Shanghai Communique in 1972. The research relies on an in-depth reading of historical facts and the political, military, and strategic backgrounds that shaped the framework for these shifts. Abstract

Outer Mongolia is regarded as one of the greatest Asian societies that maintained a neat and solid class system for long centuries influenced by the nomadic condition, Buddhist mentality, and the imperial military system whose bases were established by Genghis Khan and his successors. This class system included upper categories like nobles who dominated wealth and authority, and Lamas that combined spiritual leadership and social influence in addition to inferior dependent classes like Shav’, Albat, Khamjlaga, and slaves which established the economic base for the feudal and religious system. Studying these classes enables one to realize how traditional authority in Outer Mongolia was formed, and how religion, politics, herding, agriculture, and slavery were intertwined to shape the identity of the individual and their position.

Abstract

The phenomenon of informal housing is one of the biggest challenges facing the government at present. There is no doubt that the problem of informal housing is not simply an environmental-urban one; rather, it concerns population groups whose social and economic characteristics differ from the general appearance of the population. Therefore, shedding light on the reality of the population from a social and economic perspective, and the reasons leading to the emergence of informal settlements in the research area, as well as identifying the geographical variables affecting them and revealing the problems they face, is essential. Given the environmental structure in the research area, many important demographic indicators will be revealed, enabling decision-makers to understand the characteristics of the population and their current situation in informal housing. To cover all aspects of the research, the study adopted a descriptive and analytical approach to explain the phenomenon of informal housing and reveal demographic characteristics. In addition, a field study (questionnaire) was distributed to the research community for a purposive, non-probability sample of (300) questionnaires. (296) questionnaires were adopted, while (4) were discarded due to lack of data. The results of the field research showed that (52%) of the slum residents did not exceed the primary school certificate, and this is a dangerous indicator of the low educational level, in addition to the fact that (63.2%) of the population is below the national poverty line.

تعد ظاهرة السكن العشوائي من أبرز التحديات التي تواجه الحكومة في الوقت الحاضر؛ لا شك في أنّ مشكلة السكن العشوائي ليست مشكلة بيئية – عمرانية؛ وانما تُعنى بمجموعات سكانية متباينة في خصائصها الاجتماعية والاقتصادية عن المظهر العام للسكان، لذا فأنَّ تسليط الضوء عن واقع السكان فيها من النواحي الاجتماعية والاقتصادية، والأسباب المؤدية لقيام العشوائيات في منطقة البحث، فضلًا عن تحديد المتغيرات الجغرافية المؤثرة فيها والكشف عن المشكلات التي تواجهها. في ظل البناء البيئي في منطقة البحث سيكشف الكثير من المؤشرات السكانية المهمة التي تتيح لصانع القرار معرفة خصائص السكان وأوضاعهم الراهنة في السكن العشوائي. وللإحاطة بجميع جزئيات الباحث اعتمد البحث المنهج الوصفي والتحليلي، لبيان ظاهرة السكن العشوائي والكشف عن الخصائص السكانية. فضلًا عن الدراسة الميدانية (استمارة الاستبانة) والتي وزعت على مجتمع البحث لعينة قصدية غير احتمالية لــ (300) استمارة، اعتمدت (296) استمارة وأُهملت (4) منها لنقص البيانات فيها. وخرجت نتائج البحث الميداني إلى انَّ (52%) من سكان العشوائيات لم يتجاوزوا الشهادة الابتدائية وهذا مؤشر خطير في تدني المستوى التعليمي، فضلًا إنَّ (63.2%) من السكان دون خط الفقر الوطني.

Geographical distribution of the metal products industry and the potential for its development in Anbar Governorate

Abstract

The research aimed to study the structure and distribution of metal industry products in Anbar Governorate for the year 2024, which had (2363) establishments employing (7013) workers. The research followed a descriptive and written approach, as well as a regional and analytical approach based on studying and analyzing the structure of metal industrial products in the governorate and demonstrating their distribution across the districts of Anbar Governorate. The aim was to prove the validity of the hypothesis by tracking official statistics and data issued by the Ministry of Industry and Minerals (Industrial Development Department) as well as the Planning Department in Anbar Governorate (Industrial Statistics Division). The research found a discrepancy in the industrial structure of the metal products industry in the governorate, as it included (12) industrial branches, and that all establishments in this sector were small-sized establishments, with the exception of (12) medium-sized establishments, all of which were affiliated with the private sector. The doors and windows industry ranked first in terms of the number of establishments and the number of workers, as this branch accounted for (1323) establishments employing (3998) workers. Furthermore, there was a discrepancy in the geographical distribution. The disparity in the number of workers between districts in the province has resulted in a disparity in the number of workers between districts in the province, with Ramadi, Fallujah and Hit districts occupying the top three positions in terms of structure and distribution. Anbar province also boasts numerous developmental capabilities necessary for the development of the metal products manufacturing sector in the province.

استهدف البحث دراسة بنية وتوزيع منتجات الصناعات المعدنية في محافظة الانبار لسنة 2024 التي بلغ عدد منشآتها (2363) منشأة يعمل فيها(7013) عاملا، اتبع البحث المنهج الوصفي منهجاً كتابياً, كما اتبع المنهج الإقليمي والتحليلي الذي يقوم على دراسة وتحليل بنية المنتجات الصناعية المعدنية في المحافظة وبيان توزيعها على مستوى أقضية محافظة الانبار لغرض التوصل الى إثبات صحة فرضيته من خلال تتبع الإحصائيات والبيانات الرسمية الصادرة من وزارة الصناعة والمعادن (دائرة التنمية الصناعية) فضلا عن دائرة التخطيط في محافظة الانبار(شعبة الاحصاء الصناعي). توصل البحث الى هنالك تبايناً في الهيكل الصناعي الذي تتكون منه صناعة المنتجات المعدنية في المحافظة، إذ اشتمل على (12) فرعا صناعيا، وأن جميع منشآت هذا القطاع هي منشآت صغيرة الحجم باستثناء (12) منشأة متوسطة الحجم جميعها تابعة للقطاع الخاص وفيه احتلت صناعة الأبواب والشبابيك المرتبة الأولى من حيث عدد المنشآت وعدد العاملين، إذ استحوذ هذا الفرع على(1323) منشأة يعمل فيها (3998) عاملا، فضلا عن ان هنالك تبايناً في التوزيع الجغرافي للمنشآت بين قضاء وآخر نتج عنه تباينا في عدد العاملين بين اقضية المحافظة، لتحتل أقضية الرمادي والفلوجة وهيت المراتب الثلاث الأولى من حيث البنية والتوزيع، كما أن محافظة الانبار تزخر بالعديد من الامكانيات التنموية اللازمة لتنمية قطاع صناعة المنتجات المعدنية في المحافظة.

Abstract

Digital addiction is a widespread phenomenon in the era of modern technology, as individuals spend a long time in front of various electronic screens, whether smartphones, computers, or televisions. digital addiction refers to the excessive use of technology and digital content, which leads to negative effects on the lives of individuals and families. the research aims to identify the impact of digital addiction on the family, family relationships, their social upbringing, and their mental health.
the impact of digital addiction on the family lies in reducing social interaction between family members, as individuals prefer to communicate via screens instead of direct meetings, in addition to increasing levels of anxiety and depression as a result of their digital addiction. children have also become victims of this type of addiction through the lack of social interaction with the family as a result of the increased time spent playing on smartphones and video games, which has affected their social and emotional development. preoccupation with digital devices also leads to a decline in the academic performance of children and adolescents, as the time allocated for studying is replaced by digital addiction, while traditional roles within the family change due to digital addiction, as the influence of technology dominates daily decisions. the study reached important results, including that digital addiction negatively affects family relationships as a result of digital devices and addiction to them for long hours, which has caused a kind of social isolation and introversion, in addition to the impact of these digital devices on the health aspect of the family, especially the occurrence of joint and neck pain, poor eyesight, psychological illnesses, lack of sleep, staying up for long hours at night, stress, fatigue, and poor concentration

Abstract

يعتبر الادمان الرقمي ظاهرة واسعة النطاق في عصر التكنولوجيا الحديثة، حيث اصبح الافراد يقضون وقتاً طويلاً امام الشاشات الالكترونية المختلفة، سواء أكانت هواتف ذكية او اجهزة حاسوب او التلفاز، اذ يُشير الادمان الرقمي الى الاستخدام المفرط للتكنولوجيا والمحتوى الرقمي، مما يؤدي الى تأثيرات سلبية على حياة الافراد والاسرة. ويهدف البحث الى التعرف على انعكاس الادمان الرقمي على الاسرة وعلى العلاقات الاسرية وتنشئتهم الاجتماعية وعلى صحتهم النفسية.
ان انعكاسات الادمان الرقمي على الاسرة تكمن في تقليل التفاعل الاجتماعي ما بين افراد الاسرة، حيث يفضل الافراد التواصل عبر الشاشات بدلاً من اللقاءات المباشرة، فضلاً عن زيادة مستويات القلق والاكتئاب نتيجة ادمانهم الرقمي، كما ان الاطفال اصبحوا ضحية هذا النوع من الادمان من خلال قلة التفاعل الاجتماعي مع الاسرة نتيجة زيادة وقت اللعب على الهواتف الذكية والعاب الفيديو مما اثر على تنميتهم الاجتماعية والعاطــفية. كما ان الانشغال بالأجهزة الرقمية يعمل على تراجع الاداء الاكاديمي للأطفال والمراهقين، حيث يتم استبدال الوقت المخصص للدراسة بالإدمان الرقمي، في حين تتغير الادوار التقليدية داخل الاسرة بسبب الادمان الرقمي، حيث يغلب تأثير التكنولوجيا على القرارات اليومية. وقد توصلت الدراسة الى نتائج مهمة منها ان الادمان الرقمي يؤثر سلباً على العلاقات الاسرية نتيجة الاجهزة الرقمية والادمان عليها لساعات طويلة، مما احدث نوعاً من الانعزال الاجتماعي والانطوائية، فضلاً عن تأثير هذه الاجهزة الرقمية على الجانب الصحي للأسرة وخصوصاً حصول الام في المفاصل والرقبة وضعف البصر والامراض النفسية وقلة النوم والسهر لساعات طويلة من الليل والإجهاد والتعب وضعف التركيز.

Abstract

The current research aims to identify the effectiveness of a training program based on contemporary global trends in developing the efficiency of performance among history teachers. To achieve the aims of the research, the researchers developed the appropriate hypotheses, the sample consists of (30) male and female teachers of history in the preparatory stage (16) male teachers and (14) female teachers during the academic year 2023-2024. The research tool was a check list consisted of (48) items in its final form distributed over (3) areas (the field of planning, the field of implementation, and the field of evaluation). After processing the data statistically, the results of the research showed the effectiveness of the training program in developing the efficiency of performance for teachers of history. The researcher presented a set of recommendations and proposed some suggestions.

يهدف هذا البحث الى معرفة مدى فاعلية برنامج تدريبي قائم على الاتجاهات العالمية المعاصرة في تنمية كفاءة الأداء عند مـدرسي مادة التاريخ، ولتحقيق أهداف البحث وضع الباحثان الفرضيات الصفرية المناسبة، بلغت عينة البحث (30) مدرساً ومدرسة لمادة التاريخ في مرحلة الدراسة الإعدادية، بواقع (16) مـدرساً و (14) مـدرسـة للعام الدراسي 2023-2024 ، تكونت أداة البحث من بطاقة ملاحظة مكونة من (48) فقرة بصيغتها النهائية توزعت على (3) مجالات هي (مجال التخطيط، مجال التنفيذ، مجال التقويم)، وبعد معالجة البيانات إحصائياً أظهرت نتائج البحث فاعلية البرنامج التدريبي في تنمية كفاءة الأداء عند مـدرسي مادة التاريخ، وقد أوصى الباحثان مـجـمـوعـة من التوصيات واقترح مـجـمـوعـة من المقترحات.

The Effectiveness of Virtual Reality in Developing Scientific Inference Skills Among Fifth-Grade Students in the Subject of Physics

Abstract

The research aims to assess the impact of using virtual reality in strengthening students ' scientific deduction skills. The study was based on an experimental curriculum that included a sample of 60 students, which was divided into two groups: an experimental group that was subjected to an educational intervention using virtual reality, and a control group that did not receive this intervention. The results showed that the experimental group achieved a clear improvement in performance, which indicates the effectiveness of the method used in enhancing deductive skills. In contrast, the control group showed no significant progress, reflecting that the changes that occurred in the experimental group were the result of educational intervention and not random changes. It was also noted that the performance in the control group was more uneven among the vocabulary, while the results in the experimental group were more homogeneous, reflecting the success of the program in deepening the competence of the majority. Based on these results, the exploitation of virtual reality is an effective tool for the development of scientific deduction skills in education, which enhances the application of new technologies to enrich the learning experience of students, and qualifies them to face modern scientific challenges.

يهدف البحث إلى تقييم تأثير استخدام الواقع الافتراضي في تدعيم مهارات الاستنتاج العلمي لدى الطلاب. اعتمدت الدراسة على المنهج التجريبي شملت عينة مكونة من 60 طالبًا، تم تقسيمها إلى مجموعتين: مجموعة تجريبية تعرضت لتدخل تعليمي باستخدام الواقع الافتراضي، ومجموعة ضابطة لم تتلقَ هذا التدخل. أظهرت النتائج أن المجموعة التجريبية حققت تحسنًا واضحًا في الأداء، مما يدل على فاعلية الطريقة المستخدمة في تعزيز المهارات الاستنتاجية. في المقابل، لم تُظهر مجموعة الضبط أي تقدم يُذكر، مما يعكس أن التغيرات التي حدثت في المجموعة التجريبية كانت نتيجة للتدخل التعليمي وليس تغييرات عشوائية. كما لوحظ أن الأداء في مجموعة التحكم كان أكثر تفاوتًا بين المفردات، في حين كانت النتائج في المجموعة التجريبية أكثر تجانسًا، مما يعكس نجاح البرنامج في تعميق الكفاءة لدى الغالبية. بناءً على هذه النتائج، يُعتبر استخدام الواقع الافتراضي أداة فعّالة لتنمية مهارات الاستنتاج العلمي في التعليم، مما يعزز من تطبيق تقنيات جديدة لإثراء تجربة التعلم للطلاب، وتأهيلهم لمواجهة التحديات العلمية الحديثة.

Abstract

The subject of the research is to know the effectiveness of the strategy of asking facilitated questions in the achievement of physics for fifth-grade students and their tendency towards the subject. The research was conducted on fifth-grade science students in the science subjects of morning secondary schools affiliated with the Anbar Education Directorate for the academic year (2023-2024). Al-Shumoukh Intermediate School for Boys was chosen as a model. The research sample consisted of (35) students. The sample was divided into two groups, experimental and control, randomly. Equivalence was carried out between the two research groups in the following variables: (chronological age, previous information, intelligence, and tendency towards physics). In order to verify the research objective, the researcher relied on an achievement test consisting of (35) multiple-choice items. The validity and reliability of the test were verified, and the discriminating power of its items and the effectiveness of the alternatives were calculated. In addition, a scale was constructed to measure the tendency towards physics for fifth-grade science students, while verifying the validity and reliability of the test, in addition to calculating the discriminating power of its items. After completing the experiment, the two research groups were tested with the aforementioned research tools. After analyzing the data using the t-test, it was found that the students of the experimental group who studied the subject according to the strategy of posing easy questions were superior to the control group who studied the same subject in the usual way in achievement and tendency towards physics. In light of these results, a set of recommendations and proposals was made on the research topic.

أن موضوع البحث هو معرفة فاعلية استراتيجية طرح الأسئلة الميسرة في تحصيل مادة الفيزياء لطلاب الصف الخامس وميلهم نحو المادة، واجرى البحث على طلاب الخامس العلمي المواد العلمية للمدارس الثانوية الصباحية التابعة لمديرية تربية الانبار للعام الدراسي (2023 -2024)، وتم اختيار اعدادية الشموخ للبنين أنموذجاً، وتألفت عينة البحث من (35) طالباً اذ قُسمت العينة إلى مجموعتين تجريبية وضابطة بصوره عشوائية، وتم إجراء التكافؤ بين مجموعتي البحث في المتغيرات الأتية: (العمر الزمني، المعلومات السابقة، الذكاء، والميل نحو مادة الفيزياء). ولغرض التحقق من هدف البحث اعتمد الباحث على اختبار تحصيلي تكون من(35) فقرة بصيغة اختيار من متعدد وتم التحقق من صدق الاختبار وثباته وتم حساب القوة التميزية لفقراته وفعالية البدائل، فضلاً عن بناء مقياس الميل نحو مادة الفيزياء لطلاب الصف الخامس العلمي مع التحقق من صدق الاختبار وثباته بالإضافة الى حساب القوة التميزية لفقراته، وبعد الانتهاء من التجربة اختبرت مجموعتي البحث بأدوات البحث انفة الذكر، وبعد تحليل البيانات باستعمال الاختبار التائي تبين تفوق طلاب المجموعة التجريبية التي درست المادة وفق استراتيجية طرح الأسئلة الميسرة على المجموعة الضابطة التي درست المادة نفسها في الطريقة الاعتيادية في التحصيل والميل نحو مادة الفيزياء وفي ضوء تلك النتائج تم وضع مجموعة من التوصيات والمقترحات حول موضوع البحث.

Abstract

The research aims to analyze the extent of applying resource consumption accounting in the General Company for Electrical and Electronic Industries in Baghdad. The research relied on the quantitative analytical approach to study the impact of resource consumption accounting (RCA) in reducing the costs of industrial companies, by distributing a questionnaire to the accounting, costing and auditing employees in the General Company for Electrical and Electronic Industries in Baghdad. 39 valid questionnaires were analyzed using SPSS v25 to ensure the accuracy of the results, after verifying the validity of the research tool by arbitrating it by specialists in accounting and management. The results showed that the application of the resource consumption accounting system in the General Company for Electrical and Electronic Industries in Baghdad contributes significantly to reducing operating costs, as the system explains 71.9% of the changes in cost reduction. Therefore, it is recommended to expand the application of this system in other industrial companies to enhance the accuracy of costs and improve financial performance. The resource consumption accounting system is an effective accounting tool for analyzing industrial resource consumption, which enhances the accuracy of costs and reduces the gap between estimated and actual costs. The research recommended developing advanced analytical tools within the resource consumption accounting system, such as artificial intelligence techniques and big data analysis, to enhance transparency in cost allocation and improve the administrative decision-making process. And adopting more advanced mechanisms for allocating costs based on the actual use of resources, which reduces the gap between estimated and actual costs, and ensures greater accuracy in preparing financial reports and strategic planning.

يهدف البحث الى تحليل مدى تطبيق محاسبة استهلاك الموارد في الشركة العامة للصناعات الكهربائية والإلكترونية في بغداد. واعتمد البحث على المنهج الكمي التحليلي لدراسة تأثير محاسبة استهلاك الموارد (RCA) في تخفيض تكاليف الشركات الصناعية، وذلك من خلال توزيع استبانة على موظفي الحسابات والتكاليف والتدقيق في الشركة العامة للصناعات الكهربائية والإلكترونية في بغداد. تم تحليل 39 استبانة صالحة باستخدام برنامج SPSS v25 لضمان دقة النتائج، بعد التأكد من صدق الأداة البحثية عبر تحكيمها من قبل مختصين في المحاسبة والإدارة. واظهرت النتائج أن تطبيق نظام محاسبة استهلاك الموارد في الشركة العامة للصناعات الكهربائية والإلكترونية في بغداد يساهم بشكل ملموس في تقليل التكاليف التشغيلية، حيث يفسر النظام 71.9% من التغيرات في تخفيض التكاليف. لذا، يُوصى بتوسيع تطبيق هذا النظام في الشركات الصناعية الأخرى لتعزيز دقة التكاليف وتحسين الأداء المالي. وأن نظام محاسبة استهلاك الموارد يُعد أداة محاسبية فعالة لتحليل استهلاك الموارد الصناعية، مما يعزز دقة التكاليف ويقلل الفجوة بين التكاليف التقديرية والفعلية. واوصى البحث تطوير أدوات تحليلية متقدمة ضمن نظام محاسبة استهلاك الموارد، مثل تقنيات الذكاء الاصطناعي وتحليل البيانات الضخمة، لتعزيز الشفافية في تخصيص التكاليف وتحسين عملية اتخاذ القرار الإداري. واعتماد آليات أكثر تطورًا لتخصيص التكاليف بناءً على الاستخدام الفعلي للموارد، مما يقلل الفجوة بين التكاليف التقديرية والفعلية، ويضمن دقة أكبر في إعداد التقارير المالية والتخطيط الاستراتيجي.

Future prospects for water security in Iraq

Abstract

Water security for any society is of utmost importance, and climate changes on one hand and the modifications made by many countries to international river courses on the other hand may lead to serious alterations in water security in many countries around the world, including Iraq. Therefore, this research aimed to measure some indicators of water security in Iraq and to predict the future of those indicators by analyzing the series of per capita Iraqi water imports for the period 1980-2024 using the ARIMA model. The results of the research indicated that the per capita Iraqi water imports have rapidly declined during the study period, transforming Iraq from a water-rich country to one suffering from water scarcity and water poverty. Forecasts suggest that per capita water imports will reach about 500 m³ annually by 2030.

Abstract

ان الامن المائي لاي مجتمع يعتبر على غاية من الأهمية، وان التغيرات المناخية من جهة والتعديلات التي اخذت بها الكثير من البلدان على مجاري الانهر الدولية من جهة اخرى. قد تكون سببا في احداث تعديلات خطيرة على الامن المائي في الكثير من بلدان العالم ومنها العراق. لذلك استهدف هذا البحث قياس بعض مؤشرات الامن المائي في العراق والتنبؤ بمستقبل تلك المؤشرات من خلال تحليل سلسلة نصيب الفرد العراقي من الواردات المائية العراقية للمدة 1980- 2024 باستخدام نموذج ARIMA . وقد اشارت نتائج البحث بأن نصيب الفرد العراقي من الواردات المائية انحدر بشكل سريع خلال مدة الدراسة ليتحول العراق من بلد وفرة مائية الى بلد يعاني من ندرة مائية وفقر مائي، وتشير التوقعات الى ان نصيب الفرد سيصل الى نحو 500 م3 سنويا عام 2030 .

Estimating the Impact of Monetary Stability on Agricultural Trade Exposure in Iraq for the Period 2004-2022

Abstract

The research aims to measure and analyze the impact of monetary stability on agricultural trade exposure of agricultural goods and live animals in Iraq for the period 2004-2022. The standard model of error correction was used to estimate the relationship between the variables. The results of the model indicate a long-term equilibrium relationship between the monetary stability variable (X) and agricultural trade exposure (Y). There is also a positive and significant relationship of monetary stability on agricultural trade exposure in the long term. The research recommends working on adjusting monetary policy to control cash liquidity (money supply) to address the rising inflation rate, and adopting a long-term strategy by macroeconomic policies targeting increased agricultural production, government material and in-kind support, agricultural credit, and infrastructure, which would reflect on meeting local demand and reducing foreign demand to lessen trade dependency on world economies and achieve independence and food security.

يهدف البحث الى قياس وتحليل أثر الاستقرار النقدي على الانكشاف التجاري الزراعي للسلع الزراعية والحيوانات الحية في العراق للمدة 2004-2022. تم استخدام الانموذج القياسي متجه تصحيح الخطأ لتقدير العلاقة بين المتغيرات. تشير نتائج الانموذج هناك علاقة توازنيه طويلة الاجل بين متغير الاستقرار النقدي (X) والانكشاف التجاري الزراعي (Y). وكلك وجود علاقة طردية ومعنوية للاستقرار النقدي على الانكشاف التجاري الزراعي في الاجل الطويل. يوصي البحث العمل على ضبط السياسية النقدية للسيطرة على السيولة النقدية (عرض النقد) لتحديد ارتفاع معدل التضخم، وتبني استراتيجية طويلة المدى من قبل السياسات الاقتصادية الكلية على ان تستهدف زيادة الإنتاج الزراعي والدعم المادي والعيني الحكومي والائتمان الزراعي والبنى التحتية لينعكس على تغطية الطلب المحلي وخفض الطلب من الخارج للتقليل من التبعية التجارية نحو اقتصادات العالم وتحقيق الاستقلالية والامن الغذائي.

Measuring the Impact of the Parallel Market Exchange Rate on Agricultural Exports in Iraq During the Period 2004–2022

Abstract

This study aimed to measure the impact of the parallel exchange rate on agricultural exports in Iraq during the period 2004-2022. The standard vector error correction model (VECM) was used to measure the relationship between the study variables. The results show a long-run equilibrium causal relationship between the parallel exchange rate and agricultural exports, as the error correction term parameter is negative and significant according to the t-test (p < 0.05). There is also a positive direct and significant relationship in the long run, meaning that a one-unit increase in the parallel exchange rate will lead to an increase in agricultural exports by 2305595 units in the long run. The study recommended the need to control exchange rate fluctuations to maintain the general price level of agricultural commodities, to work on reevaluating the exchange rate to make it more favorable to agricultural exports, to support the agricultural sector, to protect local products from competition from low-priced foreign goods, and to stimulate agricultural exports.

هدفت هذه الدراسة الى قياس أثر سعر الصرف الموازي على الصادرات الزراعية في العراق خلال المدة 2004-2022. تم استخدام الانموذج القياسي متجه تصحيح الخطأ لقياس العلاقة بين متغيرات الدراسة. تبين النتائج هناك علاقة سببية توازنية طويلة الاجل بين سعر الصرف الموازي والصادرات الزراعية، وذلك لان معلمة تصحيح الخطأ تأخذ الاشارة السالبة كما انها معنوية حسب اختبار (t) (0.05 >p)، ووجود علاقة إيجابية طردية ومعنوية في الاجل الطويل، أي ان زيادة سعر الصرف الموازي بوحدة واحد ستؤدي الى زيادة الصادرات الزراعية بمقدار (2305595) وحدة في الاجل الطويل. واوصت الدراسة الى ضرورة ضبط التقلبات في سعر الصرف للمحافظة على المستوى العام للأسعار للسلع الزراعية، والعمل على اعادة تقويم سعر الصرف مما يجعله في صالح الصادرات الزراعية، والعمل على دعم القطاع الزراعي وحماية المنتج المحلي من المنافسة السلع الأجنبية ذات السعر المنخفض، وتحفيز الصادرات الزراعية.

Abstract

This study examines the phenomenon of legal shopping within the framework of private international law, with a focus on Iraq. Legal shopping, sometimes known as "forum shopping," is the deliberate choice of a legal system or jurisdiction that is thought to be best suited for a particular issue. This study examines the variables that encourage legal shopping, such as jurisdictional flexibility, regional variations in court rulings, and procedural or financial incentives that make particular jurisdictions alluring to litigants. Using a doctrinal approach, this paper examines Iraqi legislation pertaining to private international law, paying particular attention to jurisdictional standards, choice of law principles, and the adoption and application of foreign judgments. In order to determine how Iraqi law handles these concerns and where inconsistencies or ambiguity could unintentionally encourage legal shopping, comparative examination encompassing Middle Eastern and other foreign nations as well as case law is helpful. The study argues that legal shopping may jeopardize judicial consistency, fairness, and efficiency within Iraq's legal system, despite providing options for those seeking equitable outcomes. In order to maintain Iraq's private international law system's stability and equity in the face of expanding cross-border ties, the paper concludes with suggestions for legislative changes and increased judicial supervision that strike a balance between party autonomy and jurisdictional integrity.

يعد التسوق القانوني احد اهم المفاهيم التي ثارت الجدل في العلاقات الخاصة الدولية ، والذي يشير الى سلوك يقوم به احد اطراف العلاقة في النزاع الدولي الخاص حيث يقدم على اختيار القانون او المحكمة التي تتماشى مع مصالحه الشخصية من بين مجموعة من القوانين او المحاكم المختصة بالنظر في النزاع المطروح وهذا قد يؤدي الى إشكاليات قد يتضرر على اثرها اطراف النزاع الاخرين مما يقوض العدالة الدولية فقد يعمد احد اطراف النزاع الى اختيار قانون معين يكون الحكم فيه اكثر تسهيلا او اسرع من ناحية التنفيذ او اقل من باب الكلفة او عكس ما ذكر وقد بينت هذه الدراسة مفهوم التسوق القانوني والدوافع التي تؤدي اليه والاثار السلبية والإيجابية له والموقف القانوني والقضائي له كما بينت الوسائل الوقائية منه والعلاجية بعد وقوعه والضوابط المقترحة للحد من حالات التسوق القانوني التي قد تؤدي الى المساس بالعدالة الدولية والاضرار بأحد اطراف النزاع حيث انها ظاهره معقدة قد تؤدي الى المساس بجوهر العدالة في المنازعات ذات الطابع الدولي وقد بينا في نهاية البحث النتائج والتوصيات التي يؤدي الاخذ بها الى الوصول الى حالة التوازن بين احترام إرادة اطراف العلاقة الخاصة الدولية من جهة ومنع التحايل على القانون من جهة أخرى وبالتالي الوصول الى الحفاظ على عدالة النظام القانوني في قواعد القانون الدولي الخاص.

Abstract

The Iraqi government has given great importance to the wheat crop and singled it out for support programs more than other crops because of its link to food security, and despite the attention paid to the wheat crop, the costs of wheat production in sweat are still high. Therefore, the study aimed to study the impact of the irrigation method on the comparative advantage of wheat production in Anbar province based on the method of analyzing the agricultural policy matrix according to the irrigation system. This is based on data collected from samples of wheat farmers under different irrigation systems to prepare the farm budget and then the elements of the policy analysis matrix that are used to calculate agricultural policy indicators. She pointed out that the wheat cultivation system is supported in terms of production and inputs. The effective protection coefficients were 1.97 for pivot sprinkler, 1.92 for stationary sprinkler and 1.98 for conventional irrigation. The local resource cost factor of 0.71 for pivot sprinkler indicated 0.93 for fixed sprinkler and 1.29 for conventional irrigation. Pivotal spraying has a greater comparative advantage than fixed spraying, while wheat production under conventional irrigation in Anbar does not have a relative balance. Therefore, it is necessary to switch to wheat production under axial spraying.

Abstract

ان الحكومة العراقية اولت محصول القمح اهمية كبيرة وخصته ببرامج الدعم اكثر من غيره من المحاصيل الاخرى لارتباطه بالأمن الغذائي، ورغم الاهتمام الذي خص محصول القمح فلازالت تكاليف انتاج القمح في العراق مرتفعة. لذلك استهدفت الدراسة دراسة اثر طريقة الري على الميزة النسبية لإنتاج القمح في محافظة الانبار بالاعتماد على اسلوب تحليل مصفوفة السياسة الزراعية بحسب نظام الري. وذلك بالاعتماد على بيانات تم جمعها من عينات من مزارعي القمح تحت انظمة ري مختلفة لإعداد ميزانية المزرعة ومن ثم عناصر مصفوفة تحليل السياسة والتي تستخدم لاحتساب مؤشرات السياسة الزراعية. والتي اشارت الى ان نظام زراعة القمح يحظى بدعم في جانب الانتاج ومدخلاته. اذ بلغت معاملات الحماية الفعالة قيم 1.97 للرش المحوري و 1.92 للرش الثابت و 1.98 للري التقليدي. واشار معامل كلفة المورد المحلي البالغ 0.71 للرش المحوري 0.93 للرش الثابت و 1.29 للري التقليدي. الى امتلاك الرش المحوري ميزة نسبية افضل من الرش الثابت بينما لا يمتلك انتاج القمح تحت الري التقليدي في الانبار ميزة نسبية. لذلك فمن الضروري التحول الى انتاج القمح تحت الرش المحوري.

Abstract

The constitutional judiciary in Iraq issued an interpretive decision according to which the former Iraqi president continued his duties despite the end of his presidential role and a new president was not elected within a period of thirty days. Due to the lack of a quorum for the fifth session of the House of Representatives, the Iraqi President was not re-elected again and his deputy and the Speaker of the House of Representatives were not entitled to take his place. The Federal Supreme Court’s interpretation of these paragraphs according to the provisions of the Constitution was different from the case of the president who is the subject of the decision, just as the solutions mentioned in the Constitution are achieved when the position of the president becomes vacant for known reasons such as his death, resignation, or dismissal, which none of them were achieved in the case of the president. While the Federal Supreme Court, through the possibility of the president remaining in office, created new principles related to the public interest and the continuation of constitutional institutions in their work, even if it was at the expense of temporary constitutional principles, the effect of the higher interest and the continuity of the continuation of the work of institutions exceeds the effect of applying constitutional periods.

Abstract

أصدر القضاء الدستوري في العراق قرارًا تفسيريًا بموجبه استمرّ الرئيس العراقي السابق في مهام عمله على الرغم من انتهاء دوره الرئاسي ولم يتم انتخاب رئيسًا جديدًا خلال مدة ثلاثين يومًا؛ بسبب عدم اكتمال النصاب القانوني لدورة مجلس النواب الخامسة، إذ أنّ الرئيس العراقي لم تتم إعادة انتخابه مرة أخرى ولم يحق لنائبه ورئيس مجلس النواب حلولهما مكانه، إذ أنّ تفسير المحكمة الاتحادية العليا لهذه الفقرات بموجب نصوص الدستور جاء مغايرًا لحالة الرئيس موضوع القرار، كما أنّ الحلول الوارد في الدستور يتحقّق عند خلوّ منصب الرئيس لأسباب معروفه كوفاته أو استقالته أو إقالته وهو ما لم يتحقّق أيّ منها عند حالة الرئيس. بينما أوجدت المحكمة الاتحادية العليا من خلال إمكانية بقاء الرئيس بمنصبه مبادئ جديدة تتعلّق بالمصلحة العامة واستمرار المؤسّسات الدستورية في عملها حتى لو كانت على حساب مبادئ دستورية زمنية، فأثر المصلحة العليا وديمومة استمرار عمل المؤسّسات يفوق أثر تطبيق المدد الدستورية.

Abstract

It is clear through the study of the historical importance of the city of Borsipa (Borsippa), its cultural position in Mesopotamia, a prominent city in southern Mesopotamia, located southwest of Babylon, and it is an important center of religion as a result of the presence of the temple of Ezida (Ezida) of the god Nabu (God of wisdom and writing), and Borsipa is one of the important metropolises in southern Mesopotamia, and the impact of its civilization has extended to neighboring regions, especially in the social and cultural aspects, thanks to its religious and scientific nature. Religious culture can be spread, by virtue of the fact that Borsiba is the center of worship of the god Nabu, its religious influence has extended to neighboring cities, such as Babylon, Kothi and Spar, as the religious rituals and rites associated with Nabu were practiced in other cities, which contributed to the spread of religious and cultural unity between the different Iraqi.

Abstract

يتضح من خلال دراسة الاهمية التاريخية لمدينة بورسيبا الأثرية، مكانتها الحضارية في بلاد الرافدين، وهي مدينة بارزة في جنوب بلاد الرافدين، وتقع جنوب غرب بابل، وهي مركزًا مهمًا للدين نتيجة بوجود معبد ايزيدا الخاص بالإله نابو (إله الحكمة والكتابة)، كما ان بورسيبا واحدة من الحواضر المهمة في جنوب بلاد الرافدين، وقد امتد تأثير حضارتها إلى المناطق المجاورة، خصوصًا في النواحي الاجتماعية والثقافية، بفضل طبيعتها الدينية والعلمية. ويمكن نشر الثقافة الدينية، بحكم كون بورسيبا مركز عبادة الإله نابو، فقد امتد تأثيرها الديني إلى المدن المجاورة، مثل بابل وكوثى وسِبار، اذ كانت الطقوس والشعائر الدينية المرتبطة بنابو تُمارس في مدن أخرى، مما ساهم في نشر وحدة دينية وثقافية بين المجتمعات العراقية المختلفة.
