The deposit is one of the means of guarantee in exchange contracts, as it is a condition in particular for the sale contract, as it is a guarantee with two characteristics, the first related to the validity of the contract, and the second related to its cancellation, and thus the problem of the duality of meaning reflected by the presence of the deposit appears before us, is it on the one hand a condition in the contract itself

Abstract
يعد العربون احدى وسائل الضمان في عقود المعاوضة، حيث يشترط خاصة عقد البيع، فهو ضمان له صفتان، الأولى تتعلق بنفاذ العقد، والثانية ترتبط بنقضه، وبذلك تظهر أمامنا اشكالية إزدواجية الدلالة التي يعكسها وجود العربون، فهل هو من ناحية، شرط في العقد ذاته، أم أَنّه أثر مترتب عليه، ومن ناحية أخرى، يكون هذا الإزدواج مدعاة للخلط في دلالة العربون نفسه, فعندما يدفع العربون يكون العقد باتاً ونهائياً، وعندما يتراجع أحد الطرفين عن العقد، سيكون جزاءً للعدول.
