Abstract
The administration relies on its employees to carry out its various and diverse functions in providing services to individuals within the state. Due to the importance of public employees in the administrative system—as they are the instrument through which the administration expresses its will when engaging in any activity—they have become a focal point of interest for public law scholars.
This interest has led legislators to regulate the public employment relationship by defining the rights and duties of employees in relevant laws. However, when a public employee violates the ethics or conduct of public service, it becomes necessary for the administration to intervene and impose appropriate disciplinary measures. Among these measures are dismissal and removal from office, which are applied in proportion to the severity of the harm caused to the public interest.
Such actions aim to protect the continuity and regularity of public service operations without interruption or obstruction—regardless of the source—be it internal to the administration, from the public employee themselves, or from individuals entrusted with public service

Abstract
أن الإدارة تعتمد على الأشخاص الموظفين العاملين لديها في القيام بوظيفها المختلفة والمتنوعة لتوفر الخدمات المختلفة للأفراد في داخل لدولة ما ، وبسب أهمية الموظف في الوظيفة العامة باعتباره هو الأداة التي تعبر الإدارة عن أرادتها عند ممارسة أي نشاط معين ، مما يترتب عليه جعل الموظف محل نظر واهتمام من قبل فقهاء القانون العام مما نتج عنه قيام المشرع في القوانين ذات العلاقة بالوظيفة العامة إلى تحديد حقوق الموظف وواجباته ، ولكن أذ ما انتهك الموظف العام اخلاقيات أو سلوكيات الوظيفة العامة عندها يتطلب الامر من جهة الإدارة التصدي له والذهاب لردعه من خلال فرض احد العقوبات المحددة قانونا ومنها عقوبتي الفصل والعزل وبما يتناسب مع حجم الضرر الذي أصاب المصلحة العامة في أداء سير المرفق العام بانتظام واطراد ومن دون أي توقف او عرقلة من أي جهة مهما كانت ومن ضمنها الموظف العام أو المكلف بخدمة عامة .
