The contribution of the Iraqi Constitution Of 2005 to the right to social security

Abstract

The current Iraqi Constitution of 2005 explicitly and statutorily addressed many of the fundamental rights of the individual and the family, including the right to social security, taking into account children, women, and the status of individuals in old age, illness, incapacity to work, homelessness, orphanhood, and unemployment. Article (30) of the current Iraqi Constitution placed the right to social security among the constitutionally protected rights. We also found that many constitutional tributaries were established to provide protection for such rights, including the independence of the judiciary, the oversight of the constitutionality of laws, the principle of legality, and the principle of separation of powers. These elements and principles combined do not provide a real and effective guarantee for the implementation of the right to social security for the Iraqi individual, provided that government institutions consider the objective aspect before the formal aspect in demonstrating the rationale behind the Iraqi constitutional legislator's constitutional allocation of the right to social security. In doing so, the legislator took into account the importance of this right and, at the same time, the size of the social segment affected by this right in a country like Iraq.

لقد تناول الدستور العراقي النافذ لسنة 2005 بالنص والتنظيم العديد من الحقوق الاساسية للفرد والاسرة ومن ذلك الحق في الضمان الاجتماعي وراعا في ذلك الطفل والمرأة وحالة الشخص في حالة الشيخوخة والمرض والعجز عن العمل والتشرد واليتم والبطالة وذلك حينما عملت المادة (30) من الدستور العراقي النافذ على وضع الحق في الضمان الاجتماعي ضمن الحقوق المحمية دستوريا. كذلك وجدنا بان هناك الكثير من الروافد الدستورية وضعت لتوفير الحماية لهكذا حقوق ومن ذلك عنصر استقل ال السلطة القضائية وعنصر الرقابة على دستورية القوانين كذلك مبدأ المشروعية ومبدأ الفصل بين السلطات. حيث لا توفر هذه العناصر والمبادئ مجتمعة ضمانة حقيقية وفاعلي لضمان نفاذ الحق في الضمان الاجتماعي للفرد العراقي شريطة ان تراعي المؤسسات الحكومية الجانب الموضوعية قبل الشكلية في اظهار العلة التي كان يقف خلفها المشرع الدستوري العراقي حينما عمل على تخصيص الحق في الضمان الاجتماعي دستوريا. حيث انه راعا في ذلك اهمية هذا الحق وفي نفس الوقت راعا ايضا حجم الشريحة الاجتماعية التي يلامسها هذا الحق في بلد مثل العراق.

Abstract

The contracts concluded by the state, referred to as governmental contracts, and are the means by which the state acquires its needs for materials, machinery, and other constructions. Since the state is the legitimate representative of the people, and public funds are constitutionally owned by the people, their protection becomes a duty for those responsible for managing them. Therefore, Iraqi legislation has outlined procedures and methods to prevent misuse and exploitation of these funds through the processes and mechanisms involved in concluding these contracts, ensuring that public interest is served and adopting the principle of transparency, which allows easy and flexible access to information.

Abstract

أن التعاقدات التي تبرمها الدولة والتي يطلق عليها بالعقود الحكومية هي الوسيلة لاستحصال احتياجات الدولة من المواد والآلات والانشاءات الاخرى وباعتبار أن الدولة هي الممثل الشرعي للشعب وأن الاموال العامة هي اموال مملوكة للشعب دستورياً لذا فأن حمايتها واجب على القائمين بإدارتها لذلك رسمت التشريعات في العراق طرق واساليب من أجل منع العبث بهذه الأموال ومنع استغلالها من خلال الاجراءات والاليات التي يتم بها ابرام هذه التعاقدات بما يحقق المصلحة العامة واعتماد مبدأ الشفافية الذي يتيح الحصول على المعلومات بكل سهولة ومرونة.

Abstract

Under the principle of autonomous autonomy for regions, each region has the right to have its own constitution under which the structure of legislative, executive, and judicial authorities is regulated. Another manifestation of this principle is the financial independence of the regions.
The Kurdistan Region, with its official institutions, including the legislative authority, emerged as a de facto after the uprising of the Kurdish people in 1991, and was then officially recognized as a federal region in the State Administration Law for the Transitional Period and then the Iraqi Permanent Constitution of 2005.
Under the Permanent Constitution of Iraq for the year 2005, both the federal authority and the regional authority legislate within the limits of their constitutional powers. According to the Iraqi Constitution, there are exclusive powers for the federal government and it has the freedom to legislate whatever it wants, and here priority is given to federal laws. With regard to the shared jurisdictions between the federal authority and the regional authority, which are the subject of overlap between two authorities, in the event of a conflict of laws, regional laws take precedence, and the regions can amend the application of federal laws in the region. This case includes all matters that do not fall within the exclusive jurisdictions of the federal government.
The permanent Iraqi constitution also includes a set of provisions and principles to protect the autonomous autonomy of the regions, including recognition of the entity of the region, the principle of participation and constitutional judicial oversight, but in terms of process and in reality, some of these provisions are ؟ well as different and contradictory interpretations of these provisions in particular. On the part of the Federal Supreme Court, this led to a violation of these provisions and principles and their ineffectiveness in protecting the autonomy of the regions.

بموجب مبدأ الإستقلال الذاتي للأقاليم يحق لكل إقليم أن له دستور خاص به ينظم بموجبه هيكل السلطات التشريعية والتنفيذية والقضائية وأيضا مظهر أخرى لهذا المبدأ هو الإستقلال المالي للأقاليم.
ظهرت إقليم كوردستان بمؤسساته الرسمية ومن ضمنها السلطة التشريعية كأمر واقع بعد انتفاضة شعب الكوردي في عام 1991 ومن ثم أقرت به كإقليم فدرالي بشكل الرسمي في قانون إدارة الدولة للمرحلة الإنتقالية وبعدها الدستور الدائم العراقي لسنة 2005.
بموجب دستور العراق الدائم لسنة 2005 كل من سلطة الإتحادية وسلطة الأقاليم يقومون بالتشريع في حدود اختصاصاتهم الدستورية وطبقا للدستور العراق هناك الإختصاصات الحصرية للحكومة الفدرالية ولها حرية أن تشرع فيه ما تشاء وهنا الأولوية يكون للقوانين الإتحادية. بالنسبة للاختصاصات المشتركة بين سلطة الإتحادية وسلطة الأقاليم التي تكون محل تداخل بين سلطتين وفي حالة تنازع القوانين يكون الأولوية للقوانين الأقاليم ويمكن للأقاليم تعديل تطبيق القوانين الإتحادي في الإقليم وهذه الحالة تشمل كل المسائل التي لا تدخل في الإختصاصات الحصرية للحكومة الفدرالية.
كما أن الدستور العراقي الدائم يتضمن مجموعة من أحكام ومبادئ لحماية الإستقلال الذاتي للأقاليم ومنها إقرار بكيان الإقليم، مبدأ المشاركة والرقابة القضائية الدستورية، لكن من ناحية العملية وفي الواقع عدم تطبيق بعض من هذا الأحكام وكذلك تفسيرات مختلفة ومتناقضة لهذا الأحكام بالأخص من جانب المحكمة الإتحادية العليا أدت إلى إخلال هذا الأحكام والمبادئ وعدم فاعليتهم في حماية الإستقلال الذاتي للأقاليم.

Analogical Reasoning in the Interpretation of International Treaties

Abstract

This study aims to analyze the role of analogical reasoning in the interpretation of international treaties, with a focus on the theoretical foundations underpinning it within the legal framework, its practical manifestations in judicial systems, and the challenges posed by its diverse applications. The study further seeks to elucidate the extent to which the method of reasoning by analogy contributes to enhancing the logical coherence of the international legal system and its capacity to accommodate emerging developments driven by shifts in international relations. Employing a critical analytical methodology, the study examines the provisions of the 1969 Vienna Convention on the Law of Treaties, particularly Articles 31 and 32 thereof, alongside an in-depth analysis of pertinent judicial precedents. The study concludes that analogical reasoning serves as an essential tool for addressing legislative gaps by applying established legal principles to unregulated cases, contingent upon the existence of a substantive analogy between such cases and those governed by existing legal norms. However, the study also underscores that while analogical reasoning holds significant practical value, it necessitates the establishment of precise methodological controls to strike a balance between the flexibility required for legal interpretation and the imperative of legal stability, provided such controls do not compromise the fundamental principles of international law. The findings of this study carry particular significance in advancing the development of judicial mechanisms for treaty interpretation, ensuring they align with contemporary challenges while safeguarding the integrity of the international legal architecture.

Abstract

تهدف هذه الدراسة إلى تحليل الدور الذي يضطلع به الاستدلال بالقياس في تفسير المعاهدات الدولية، مع التركيز على الأسس النظرية التي يستند إليها في الإطار القانوني، والتجليات العملية لتطبيقه في المنظومة القضائية، فضلاً عن الصعوبات التي تثيرها توظيفاته المختلفة. كما تسعى الدراسة إلى بيان مدى إسهام اسلوب الاستدلال بالقياس في تعزيز الانسجام المنطقي للنظام القانوني الدولي، وقدرته على استيعاب المستجدات التي تفرضها تحولات العلاقات الدولية. وقد اعتمدت الدراسة منهجية تحليلية نقدية تقوم على فحص الأحكام الواردة في اتفاقية فيينا لقانون المعاهدات لعام 1969 سيما المادتين (31 و32) منها، مع استقراءٍ معمقٍ للاجتهادات القضائية ذات العلاقة. وقد توصلت الدراسة إلى أن الاستدلال بالقياس يُعد أداةً جوهريةً لمعالجة الفراغات التشريعية، عبر تطبيق المبادئ القانونية الراسخة على وقائع غير منصوص عليها، مع اشتراط وجود تناظرٍ جوهري بينها وبين الحالات المنظمة قانوناً. كما ان الدراسة خلصت أيضاً إلى أن الاستدلال بالقياس، رغم ما يتمتع به من أهمية عملية، يتطلب وضع ضوابط منهجية دقيقة لضمان تحقيق التوازن بين ضرورة مرونة التفسير القانوني ومتطلبات الاستقرار القانوني، شريطة ألا يفضي ذلك إلى المساس بالمبادئ الأساسية التي يقوم عليها القانون الدولي. هذا، وقد اتسمت النتائج التي انتهت إليها الدراسة بأهمية خاصة في إطار السعي نحو تطوير آليات التفسير القضائي للمعاهدات، بما يواكب التحديات المعاصرة ويحفظ في الوقت ذاته سلامة البنية القانونية الدولية.

Abstract

This research deals with the study of administrative delegation and its impact on judicial oversight, highlighting the vital role that delegation plays in improving the efficiency of public administration through distributing powers to different levels in administrative bodies, The legal provisions regulating the delegation process and their impact on government performance were reviewed, with a focus on the importance of administrative judiciary oversight in ensuring that delegation is carried out within the framework of the law and in accordance with the established objectives, The legal challenges faced by the judiciary in this context were also analysed, especially with regard to the difficulty of defining the limits of authorization and practices that may exceed the permissible legal framework, The research also shows that administrative delegation can be an effective tool if it is carefully organized and legislated, while ensuring the presence of effective judicial oversight that protects rights and ensures that authority is not compromised or the law is exceeded.
On the other hand, the research addressed the impact of the discretionary authority granted to the delegates on the ability of the administrative judiciary to intervene when abuses or abuse of power occur. The research indicated the need for flexible judicial standards that allow the judiciary to deal with administrative delegation effectively, which ensures the protection of individual rights on the one hand, On the other hand, it allows the public administration to take appropriate decisions. He also stressed the importance of updating legislation related to administrative delegation to keep pace with contemporary challenges, and to ensure the existence of a legal framework regulating these processes, Thus, this research is an important attempt to understand the relationship between administrative delegation and judicial oversight in the administrative system, and proposes realistic solutions to enhance the effectiveness of judicial oversight of administrative delegations in legal systems.

يتناول هذا البحث دراسة التفويض الإداري وأثره على الرقابة القضائية، مسلطًا الضوء على الدور الحيوي الذي يلعبه التفويض في تحسين كفاءة الإدارة العامة من خلال توزيع الصلاحيات على مستويات مختلفة في الهيئات الإدارية، وقد تم استعراض الأحكام القانونية التي تنظم عملية التفويض وأثرها على الأداء الحكومي، مع التركيز على أهمية رقابة القضاء الإداري في التأكد من أن التفويض يتم في إطار القانون ووفقًا للأهداف المقررة، كما تم تحليل التحديات القانونية التي يواجهها القضاء في هذا السياق، ولا سيما فيما يتعلق بصعوبة تحديد حدود التفويض والممارسات التي قد تتجاوز الإطار القانوني المسموح به، كما يوضح البحث أن التفويض الإداري يمكن أن يكون أداة فعالة إذا تم تنظيمه وتشريعه بشكل دقيق، مع ضمان وجود رقابة قضائية فعالة تحمي الحقوق وتضمن عدم التفريط في السلطة أو تجاوز القانون.
من جانب آخر، تناول البحث تأثير السلطة التقديرية التي يتم منحها للمفوض إليهم على قدرة القضاء الإداري في التدخل عند حدوث تجاوزات أو تعسف في استخدام السلطة، وقد أشار البحث إلى ضرورة وجود معايير قضائية مرنة تتيح للقضاء التعامل مع التفويض الإداري بفعالية، مما يضمن حماية الحقوق الفردية من جهة، ويسمح للإدارة العامة باتخاذ القرارات المناسبة من جهة أخرى، كما شدد على أهمية تحديث التشريعات ذات الصلة بالتفويض الإداري لتواكب التحديات المعاصرة، وضمان وجود إطار قانوني منظم لهذه العمليات، وبذلك يعد هذا البحث محاولة هامة لفهم العلاقة بين التفويض الإداري والرقابة القضائية في النظام الإداري، ويطرح حلولًا واقعية لتعزيز فعالية الرقابة القضائية على التفويضات الإدارية في الأنظمة القانونية.

Abstract

The subject of the right in international law is one of the subjects that occupies a distinct importance in international law, which many people interested in international law avoid delving into due to its accuracy, first, and the difficulties surrounding the subject, second, due to the problem of conflict with some of the interests of states that they are keen to defend, regardless of whether they are consistent with the idea of the right or not. The problem of the study arises in an attempt to formulate a special theory of the right in international law, due to the special nature of international law, which is subject, as a general principle, to international decentralization and the freedom of states in their international actions, except with an explicit restriction. The research was divided into two sections, the first of which dealt with the right in domestic and international law, while the second section dealt with models of the right in international law, namely recognition and the right to self-determination.

يعدّ موضوع الحق في القانون الدولي من الموضوعات التي تحتل أهمية مميّزة في القانون الدولي والتي يتجنب العديد من المهتمين في القانون الدولي الخوض فيه لدقته أولاً وللصعوبات التي تكتنف الموضوع ثانياً لما يثيره من إشكال التعارض مع بعض مصالح الدول والتي تحرص على الدفاع عنها بغض النظر عن انسجامها مع فكرة الحق من عدمه، وتثور إشكالية الدراسة في محاولة التوصل إلى صياغة نظرية خاصة للحق في القانون الدولي، لما يتميز به القانون الدولي من خصوصية قواعده والتي تخضع كأصل عام إلى اللامركزية الدولية وحرية الدول فيما يصدر عنها من تصرفات دولية إلاّ مع وجود قيد صريح، وتم تقسيم البحث الى مبحثين الأول منهما تناولنا فيه الحق في القانون الداخلي والدولي، أما المبحث الثاني فتناولنا فيه نماذج من الحق في القانون الدولي وهما الاعتراف والحق في تقرير المصير.

Abstract

This research revolves around the topic of constitutional deterrence. Through this study, the researcher aimed to understand the reality of achieving constitutional deterrence in light of constitutional texts, as the topic of constitutional deterrence is distinguished by a specificity that distinguishes it from other legal fields, depending on the nature of the field that the constitutional rule seeks to frame by regulating the work of public authorities and the lives of individuals in society. The protection of the constitution and the effectiveness of its texts cannot be justified as fixed data for achieving constitutional and political reform, as they are an indicator that enhances the possibilities of its supremacy, its effectiveness, and its impact on the lives of individuals through the interaction of the structure of the constitution and its compatibility with societal variables only, given that the constitution is static, and that there is supremacy to the constitution from a founding perspective. Rather, there must be means of constitutional deterrence that support the constitution with constitutional texts that include material and legal penalties, in addition to official deterrent institutions that prevent its violation - the constitutional judiciary - capable of exposing violations of the constitution. Regardless of the degree of the mechanisms for achieving supremacy and protection, they remain relative and limited without a sound legal framework for the means of constitutional deterrence.

يدور موضوع هذا البحث، ويرتكز حول موضوع الردع الدستوري، وقد استهدف الباحث من خلال هذه الدراسة الوقوف على حقيقية تحقيق الردع الدستوري في ظل النصوص الدستورية، كون موضوع الردع الدستوري يتميز بخصوصية ينفرد بها عن المجالات القانونية الأخرى، تبعاً لطبيعة المجال الذي تسعى القاعدة الدستورية تأطيره بتنظيم عمل السلطات العامة وحياة الأفراد في المجتمع، ولا يمكن تبرير حماية الدستور وقيام فعالية نصوصه كمعطيات ثابتة لتحقيق الإصلاح الدستوري والسياسي بوصفها مؤشر يعزز ممكنات سموه ونفاذه وتأثيرها في حياة الافراد بتفاعل بنية الدستور وتوافقها مع المتغيرات المجتمعية فقط باعتبار الدستور جامدا، وان هناك سموا للدستور من الناحية التأسيسية، بل لا بد من وجود وسائل للردع الدستوري تساند الدستور بنصوص دستورية تتضمن جزاءات مادية وقانونية الى جانب مؤسسات رسمية رادعة تحول دون انتهاكه – القضاء الدستوري- قادرة على كشف انتهاكات الدستور. اذ مهما بلغت درجة آليات تحقيق سموه وحمايته تضل نسبية ومحدودة من دون التأطير القانوني السليم لوسائل الردع الدستوري.

The administrative judiciary is the authority responsible for safeguarding these rights, allowing individuals to challenge any administrative decision that may undermine their acquired rights, whether through revocation or modification. This protection aims to prevent administrative abuse of power and to ensure the stability of individuals' legal situations, thereby reinforcing the principle of legality and the rule of law. Such protection is a cornerstone of the legal state, as it strengthens the principles of legality and justice, balances the relationship between individuals and the administration, and guarantees respect for individuals' rights, shielding them from any violations or abuses. It would be unjust to disregard acquired rights, as this could erode trust in the legal framework, ultimately leading to instability in legal transactions and situations.

تتعرض العديد من المستشفيات والعاملين فيها للإستهداف العسكري أثناء النزاعات المسلحة وإنتهاكات مستمرة لقواعد القانون الدولي الإنساني، وعلى الرغم من شمولية الإطار القانون الحالي، إلا إنه يواجه صعوبات تطبيقية تؤثر على تحقيق الحماية الفعلية للطاقم الطبي لأسباب كثيرها أهمها التركيز على العوامل التي تؤدي إلى ضعف الإلتزام بقواعد القانون الدولي الإنساني مثل المصالح السياسية والعسكرية لأطراف النزاع، علماً بأن حماية الطاقم الطبي ليست مجرد إلتزام قانوني، بل هي واجب إنساني يعكس القيم الأساسية للقانون الدولي الإنساني في حماية الإنسانية في أصعب الظروف.

Abstract

The investigation is the first stage of the intervention of the competent authorities in order to detect the crime and identify the perpetrators, through which the court can determine criminal responsibility or not, and the parallel investigation is a contemporary means realized by the effectiveness of special penal legislation. ‏يعد التحقيق اولى مراحل تدخل الجهات المختصة من اجل الكشف عن الجريمة وتحديد هوية الجناة، اذ من خلاله يتسنى للمحكمة تقرير المسؤولية الجزائية من عدمها، والتحقيق الموازي وسيلة معاصرة أدركت نجاعتها التشريعات العقابية الخاصة. غير ان التحقيق المالي الموازي يعتبر أحد الإجراءات المستحدثة في إطار البحث والتحري والتيقن من مشروعية الأموال والأصول حين تتولد لدى الجهات المختصة شكوك حول عدم مشروعية أموال أو أرباح قد تكون ناتجة عن المتاجرة بالمخدرات أو السلاح او تلك التي تمتهن تجارة الأعضاء البشرية، ‏علما أنه يجري بمحاذاة التحقيق القضائي العادي وبموازاته ولا يعيق أو يعرقل سبيله فالهدف والغاية المنشودة واحدة، ومن الجدير بالذكر أن التشريعات المعنية بمكافحة غسل الأموال هي التي ابتكرت مؤخرا هذا النوع من التحقيقات عن طريق تعديل التشريع وإضافة النصوص التي تنظم أحكام العمل بالتحقيق الموازي، لما له من أهمية بالغة اذ مُنحت السلطات المختصة للعمل في نطاق التحقيق الموازي صلاحيات واسعة جدا، بلغت مستوى الخروج عن المبادئ العامة في القانون العقابي كإباحة سلوك الموظف المكلف بإجراء التحقيق الموازي حين ينتحل صفة غير صفته الحقيقية من أجل الوصول للمصدر الحقيقي للأموال، غير أن التشريع العراقي لا زال ‏خاليا من النص على هذا الإجراء في حين أن مجلس القضاء الأعلى انتهج واعتمد عليه فيما يتعلق بجرائم غسل الأموال وتمويل الإرهاب.

Criminal Evidence in Preventive Criminalization

Abstract

Preventive criminalization is a modern legal concept that adopts a criminal policy aimed at preventing crimes before any material or actual harm occurs. This approach is based on criminalizing certain actions that are considered potential threats to legally protected interests, such as the human right to life and physical safety. However, there are several challenges facing legislators and criminal justice systems in implementing preventive criminalization. One of the most prominent challenges is that, in some cases, the legal texts governing preventive criminalization may be unclear or overly broad, leading to varying interpretations that could harm the application of justice. Additionally, assessing potential risks and balancing them against personal rights and freedoms is complex, as preventive criminalization may conflict with individual rights and personal freedoms. This is because preventive criminalization requires intervention in individuals\' behaviors before it is proven that they have committed an actual crime, which could lead to unjustified restrictions on personal freedoms. Furthermore, there is the issue of determining criminal intent in preventive crimes, as some legal applications require proving specific intent, making it more complicated and difficult to establish the accused\'s criminal intent. To address these challenges, we propose that the Iraqi legislator enact precise and clear legislation related to preventive criminalization, while ensuring the protection of individual rights. Intervention should only occur in cases that pose a genuine threat to public security, and individual freedoms should not be infringed upon except in necessary circumstances. Additionally, the nature of criminal intent required in preventive crimes should be clearly defined, with a preference for general intent to ensure the effective enforcement of these laws.

التجريم الوقائي هو مفهوم قانوني حديث يتبنى السياسة الجنائية التي تهدف إلى منع وقوع الجرائم قبل حدوث الضرر المادي أو الفعلي ويستند هذا النوع على تجريم بعض الأفعال التي تعتبر تهديدا محتملا للمصالح المحمية قانونا، مثل حق الإنسان في الحياة والسلامة الجسدية إلا أن هنالك مجموعة من التحديات التي تواجه واضعي التجريم الوقائي و أجهزة العدالة الجزائية ومن أبرز هذه التحديات انهُ في بعض الحالات قد تكون النصوص القانونية التي تحكم التجريم الوقائي غير واضحة أو فضفاضة مما قد يؤدي إلى تفسيرات مختلفة قد تكون ضارة في تطبيق العدالة وكذلك التحقيق من الخطر المحتمل والمساس بالحقوق والحريات الشخصية فالتجريم الوقائي قد يتعارض مع حقوق الأفراد وحرياتهم الشخصية لان التجريم الوقائي يتطلب التدخل في سلوكيات الأفراد قبل أن يثبت أنهم ارتكبوا جريمة فعلية مما قد يؤدي إلى تقييد الحريات الشخصية بطريقة غير مبررة وبالإضافة إلى ذلك إشكالية تحديد القصد الجنائي في الجرائم الوقائية لأنه في بعض التطبيقات يتطلب القانون اثبات القصد الخاص حيثُ يصبح اثباتها أكثر تعقيداً وبالتالي من الصعب إثبات وجود القصد الإجرامي لدى الشخص المتهم، من اجل تذليل هذه التحديات اقترحنا على المشرع العراقي على وضع تشريعات دقيقة وواضحة تتعلق بالتجريم الوقائي، مع مراعاة ضرورة الحفاظ على حقوق الأفراد وحمايتها . ويجب أن يتم التدخل في الحالات التي تشكل تهديدا حقيقيا للأمن العام فقط، وعدم المساس بحرية الأفراد إلا في الحالات الضرورية. كما يجب تحديد طبيعة القصد الجنائي المطلوب في الجرائم الوقائية ويفضل استخدام القصد العام، لضمان فعالية التطبيق الجنائي لهذه القوانين.

Abstract

When a constitutional judge rules that a text is unconstitutional, he fills the text by adding something that complements it or replacing the part that violates the constitution with another text that is more compatible with the provisions of the constitution, provided that the constitutional judge does not deviate from the basic goal that the legislator wanted.
Substitutionary rulings are defined as the constitutional judge issuing rulings to cancel and exclude a rule that violates the Constitution and replace it with another rule that is more consistent with its rulings.
The Federal Supreme Court has a pioneering and new experience in following the substitutionary approach in its rulings، as it issues substitutionary rulings by replacing one text with another without ruling that the entire law is unconstitutional.

Abstract

ان القاضي الدستوري عندما يقوم بالحكم بعدم دستورية نص ما، فأنه يقوم بسد النقص بإضافة ما يكمله أو باستبدال الجزء المخالف للدستور بنص أخر أكثر موائمة لأحكام الدستور، على ان لا يبتعد القاضي الدستوري عن الغاية الاساسية التي أرادها المشرع.
وتعرف الاحكام الاستبدالية على انها اصدار القاضي الدستوري احكاماً لإلغاء واقصاء القاعدة المخالفة للدستور واستبدالها بقاعدة اخرى أكثر تناغماً مع أحكامه.
وللمحكمة الاتحادية العليا تجربة رائدة وجديدة في اتباع المنهج الاستبدالي في قراراتها وأحكامها، إذ يقوم القاضي الدستوري بأصدار أحكام استبدالية؛ وذلك من خلال استبدال نص بأخر دون ان تحكم بعدم دستورية النص المطعون بدستوريته.

Abstract

Electronic administrative decision-making is considered one of the latest forms of administration exercising the control authority granted to it by law. It is one of the requirements for enabling the administration to carry out its functions in our modern era so that it can carry out its tasks in a manner that is consistent with the developments that we find in the lives of individuals and the state.

This form of administrative decision did not differ from the traditional decision in its content and legal concept. However, some characteristics were introduced due to the existence of electronic systems and communications networks that carry out the procedures for issuing the electronic administrative decisions instead of the component administration itself, and announce it to those who are addressed, which can be considered a development that affected the external pillars of the administrative decision, and made it somewhat different from the traditional administrative decision that the administration issues on paper and announces using traditional methods. However, it didn’t exempt the administration from adhering to the legal and judicial principles that require legitimacy in the administration\'s legal work, and therefore the decision was not issued. The electronic administrative system is within the scope of the administrative judiciary’s control, and it is not fortified from being appealed in annulment, the condition that the pillars of the decision are met remains a condition for its existence and for it to produce the legal effects that the administration intended to create when issuing it.

يعتبر القرار الإداري الإلكتروني من أحدث أشكال ممارسة الإدارة لسلطة الضبط الممنوحة لها قانوناً، وهو من متطلبات تمكين الإدارة لتقوم بوظائفها في عصرنا الحديث، حتى تتمكن من القيام بمهامها بشكل يتناسب مع التطورات التي تستجد في حياة الفرد والدولة.
لم يختلف هذا الشكل من القرار الإداري عن القرار التقليدي في المضمون ومفهومه القانوني، مع وجود بعض خصائص استحدثت بسبب وجود الأنظمة الإلكترونية وشبكات الإتصالات التي تقوم بإجراءات إصدار القرار الإداري الإلكتروني بدلاً من الإدارة صاحبة الاختصاص نفسها، وتعلنه للمخاطبين به، والتي يمكن أن تعتبر تطوراً أثرت في الأركان الخارجية للقرار الإداري، وجعلته مختلفاً بعض الشيء عن القرار الإداري التقليدي الذي تصدره الإدارة على الورق وتعلنه بأساليب تقليدية، إلا أنه لم يعفي الإدارة من الالتزام بالمبادئ القانونية والقضائية التي توجب المشروعية في أعمال الإدارة القانونية، وعليه لا يخرج القرار الإداري الإلكتروني من نطاق رقابة القضاء الإداري ولم يحصنه من الطعن فيه إلغاءً، فيبقى شرط توافر أركان القرار فيها شرطاً لوجوده ولإحداث الأثار القانونية التي استهدفت الإدارة إحداثها من إصداره.

Abstract

The research discusses the impact of the problem of artificial intelligence on public international law, through the concepts, challenges and risks facing international law and human rights law as branches of the principles of public international law, with regard to the risks of autonomous weapons, and the risks that concern human rights to life, privacy and others. The selection plan was chosen to select a number of topics, as we discussed in the first topic the conceptual framework of artificial intelligence, its forms and applications, In the second section, we discussed the problems of artificial intelligence facing international law within the framework of international humanitarian law and human rights law and the mechanisms of international law in confronting these problems. We concluded the research with a conclusion that included the results we reached and the recommendations in light of that, and we reached a main conclusion, which is that the rules of international law are no longer able to keep pace with the rapid development of artificial intelligence and its actual and potential risks, which requires a radical development to put an end to the risks of artificial intelligence.

يناقش البحث تأثير إشكاليات الذكاء الإصطناعي على قواعد القانون الدولي العام، من ناحية التحديات والمخاطر التي تواجه القانون الدولي الإنساني وقانون حقوق الإنسان كفرعين من فروع القانون الدولي العام، وذلك فيما يتعلق خصوصا بمخاطر أسلحة التشغيل الذاتي، والمخاطر التي تهدد حقوق الإنسان في الحياة والخصوصية وغير ذلك. وقد تمت مناقشة الموضوع وفق خطة تضمنت مبحثين وعدد من المطالب، تناولنا في المبحث الأول الإطار المفاهيمي للذكاء الإصطناعي، وأشكاله وتطبيقاته، وتناولنا في المبحث الثاني إشكاليات الذكاء الإصطناعي التي يواجهها القانون الدولي في إطار القانون الدولي الإنساني وقانون حقوق الإنسان وآليات القانون الدولي في مواجهة هذه الإشكاليات. وأنهينا البحث بخاتمة تضمنت النتائج التي توصلنا إليها والتوصيات في ضوء ذلك، وقد تمثّلت النتيجة الرئيسة بأن قواعد القانون الدولي لم تعد قادرة على مجاراة تطور الذكاء الإصطناعي المتسارع ومخاطرة الواقعة والمحتملة، ما يتطلب تطويراً جذرياً لوضع حدّ لمخاطر الذكاء الإصطناعي.

The role of international humanitarian law in protecting food security

Armed conflicts have devastating consequences on food security, as they disrupt supply chains, destroy agricultural infrastructure, and hinder civilians’ access to essential food resources. International humanitarian law (IHL) plays a crucial role in mitigating these effects by establishing legal frameworks that protect civilian food sources and prohibit the use of starvation as a method of warfare. This research examines the conceptual dimensions of food security, highlighting its different forms and key challenges, while also analyzing IHL mechanisms aimed at preventing food insecurity during armed conflicts. It explores the prohibition of indiscriminate attacks on food-related infrastructure and the legal provisions that safeguard civilians' access to sustenance. By analyzing international treaties, customary laws, and case studies, this study underscores the importance of enforcing IHL to enhance global food security and protect vulnerable populations in conflict zones.

Controls on Criminal Liability for Murder Using Drone Technology -An Analytical Study

Abstract

This research addresses a modern legal problem related to the attribution of criminal liability for killings by drones that carry out crimes remotely. It discusses the philosophical challenge posed by the absence of a direct relationship between the perpetrator and the criminal act, which necessitates a reconsideration of the concept of intent and individual responsibility, as well as a discussion of the technical dimensions that create multiple actors (the programmer, the operator, the commander). It questions the classical rules of the perpetrator and the accomplice. It compares legal systems (Iraqi, French, and American) in their treatment of technical acts and the elements of the crime, highlighting legislative disparities. This demonstrates that traditional law is in need of philosophical and methodological modernization to address the development of automated cybercrimes. It focuses on the need to redefine the moral element to include the intent of technical control, not just manual action. It raises a philosophical question about the limits of criminal acts: Who actually kills? The machine, or the human who commands it? It highlights the absence of explicit legislative texts regulating crimes committed through modern technological means. It calls for the development of an expanded theory of liability based on the expected consequences of technological action. It concludes by emphasizing the need to adapt criminal jurisprudence to the reality of contemporary crime to ensure effective justice.

يتناول البحث إشكالية قانونية حديثة تتعلق بإسناد المسؤولية الجنائية عن القتل عبر طائرات مسيرة تُنفذ الجريمة عن بُعد، يناقش التحدي الفلسفي المتمثل في غياب العلاقة المباشرة بين الفاعل والفعل الجرمي، الامر الذي يستلزم إعادة النظر بمفهوم النية والمسؤولية الفردية ومناقشة الأبعاد التقنية التي تخلق فاعلين متعددين (المبرمج، المشغل، الآمر)، ويُسائل القواعد الكلاسيكية للفاعل والشريك. ويُقارن بين أنظمة قانونية (العراقية، الفرنسية، الأمريكية) في معالجة الفعل التقني وعناصر الجريمة، مع إبراز التفاوت التشريعي، مما يظهر أن القانون التقليدي بحاجة لتحديث فلسفي ومنهجي لمواجهة تطور الجرائم السيبرانية المؤتمنة. ويركز على الحاجة لإعادة تعريف الركن المعنوي ليشمل نية السيطرة التقنية لا الفعل اليدوي فقط، ويطرح تساؤلاً فلسفيًا حول حدود الفعل الإجرامي، من يقتل فعليًا؟ الآلة، أم الإنسان الذي أمرها؟ يسلط الضوء على غياب نصوص تشريعية صريحة تنظم الجرائم عبر الوسائط التقنية الحديثة، ويدعو إلى تطوير نظرية موسعة للمسؤولية تعتمد على النتائج المتوقعة من الفعل التقني، كما يختم بتأكيد ضرورة تكييف الفقه الجنائي مع واقع الجريمة المعاصرة لضمان العدالة الفعالة.

Criminals are subject to criminal accountability for their crimes. Community justice requires a balanced and rational approach that combines punishment, deterrence and rehabilitation of criminals. "The Legal Framework of Tax Deposits"

Abstract

Tax deposits are considered one of the fundamental legal and financial instruments adopted by states to ensure tax collection and reduce tax evasion. They represent financial amounts temporarily withheld or collected from taxpayers and deposited into special government accounts as a guarantee for fulfilling their tax obligations until they are settled or refunded in accordance with the applicable legislation. In Iraq, this system is based on clear constitutional and legislative foundations, most notably the 2005 Iraqi Constitution, the Income Tax Law, the Customs Law, and the Financial Management Law, in addition to the instructions of the General Commission for Taxes, all reinforced by oversight from the Federal Board of Supreme Audit and the Integrity Commission. It has been found that the absence of precise legal provisions regulating the mechanisms for withholding and refunding tax deposits, along with weak technical infrastructure, increases the risks of manipulation, corruption, and bureaucracy, which negatively affects taxpayers' rights and weakens confidence in the tax system. Moreover, the lack of clear timeframes for refunding tax deposits contributes to delaying taxpayers' financial entitlements and turns these deposits into an illegitimate temporary resource for the state.

تُعد الأمانات الضريبية من الأدوات القانونية والمالية الأساسية التي تعتمدها الدول لضمان تحصيل الضرائب والحد من التهرب الضريبي إذ تمثل مبالغ مالية تُستقطع مؤقتاً من المكلفين أو تُحصّل منهم وتُودع في حسابات حكومية خاصة كضمانة لتنفيذ الالتزامات الضريبية المستحقة عليهم حتى يتم تسويتها أو استردادها وفقاً للتشريعات النافذة ويستند هذا النظام في العراق إلى أسس دستورية وتشريعية واضحة أبرزها الدستور العراقي لعام 2005، وقوانين ضريبة الدخل، والكمارك، والإدارة المالية، إلى جانب تعليمات الهيئة العامة للضرائب، معزَّزاً بجوانب الرقابة من قبل ديوان الرقابة المالية وهيئة النزاهة وقد تبين أن غياب نصوص قانونية تنظم آليات استقطاع ورد الأمانات الضريبية بدقة، وضعف البنى التحتية التقنية يؤديان إلى تزايد مخاطر التلاعب والفساد والبيروقراطية مما يؤثر سلباً على حقوق المكلفين ويُضعف الثقة بالنظام الضريبي كما أن غياب السقوف الزمنية الواضحة لرد الأمانات يسهم في تعطيل استحقاق المكلفين المالي ويحول الأمانات إلى مورد مؤقت غير مشروع للدولة.

Abstract

Administrative and political corruption is a prominent issue that has its roots throughout history, as it has spread in our current societies, whether developing or advanced, and has appeared in all political systems. Corruption expresses the illegal actions carried out by officials, such as exploiting powers, influence, and extortion to achieve their personal interests.
Iraq is one of the countries that witnessed major political transformations and many phenomena emerged after the political change in 2003, the most prominent of which is the phenomenon of corruption, and the issue of political corruption has become a subject of controversy. Iraq is considered one of the countries that has faced and continues to face major challenges due to administrative and political corruption, which has become a widespread phenomenon in many state institutions. Administrative corruption in Iraq has reached dangerous levels, posing a real threat to the future of state building. Despite the existence of oversight institutions aimed at strengthening the rule of law and institutions and combating corruption, these efforts have not achieved the desired results so far.
This research focuses on studying the legal methods for combating political and administrative corruption in Iraq, with a focus on combating and combating corruption through specialized institutions to combat corruption and adopting transparency in managing government affairs at all levels. Through this study, we try to identify the reasons that contributed to the spread of political and administrative corruption in Iraq and the effectiveness of specialized agencies to combat political and administrative corruption in Iraq, especially in government institutions, and to review and analyze the legal methods used to combat corruption in Iraq and evaluate the effectiveness of current legislation in achieving this goal. يعد العراق من الدول التي شهدت تحولات سياسية كبيرة وظهرت العديد من الظواهر بعد التغيير السياسي عام 2003 ومن أبرزها ظاهرة الفساد، وباتت قضية الفساد السياسي محل جدل. يُعتبر العراق من الدول التي واجهت ولا تزال تواجه تحديات كبيرة بسبب الفساد الإداري والسياسي، الذي أصبح ظاهرة متفشية في العديد من مؤسسات الدولة. لقد بلغ الفساد الإداري في العراق مستويات خطيرة، مما يشكل تهديداً حقيقياً لمستقبل بناء الدولة. ورغم وجود مؤسسات رقابية تهدف إلى تعزيز دولة القانون والمؤسسات ومكافحة الفساد، إلا أن هذه الجهود لم تحقق النتائج المرجوة حتى الآن.
ويركز هذا البحث على دراسة الطرق القانونية لمكافحة الفساد السياسي والإداري في العراق مع التركيز على محاربة الفساد ومكافحته من خلال مؤسسات متخصصة لمكافحة الفساد واعتماد الشفافية في إدارة شؤون الحكم على كافة المستويات. ومن خلال هذه الدراسة نحاول معرفة الأسباب التي ساهمت في انتشار الفساد السياسي والإداري في العراق ومدى فاعلية الأجهزة المتخصصة لمكافحة الفساد السياسي والإداري في العراق وخاصة في المؤسسات الحكومية، واستعراض وتحليل الطرق القانونية المستخدمة لمكافحة الفساد في العراق وتقييم فعالية التشريعات الحالية في تحقيق هذا الهدف.

Abstract

One of the most prominent human activities that has been flourishing in recent times and has been rapidly spreading is sports activities. These activities have come to be practiced on a very broad scale, not only among young people but also across all age groups and genders. Consequently, in order to regulate this human activity, those responsible for it, as well as the national legislator, have intervened by establishing a set of laws and rules governing and organizing this activity. These include professional sports laws, sports federation laws, sports club laws, as well as regulations and statutes known as the laws or rules of sports games.
Thus, what is known as sports law has emerged, gradually acquiring a degree of autonomy, even though it is not entirely independent from other branches of law. Nevertheless, it has developed into a distinct and specialized legal field. These laws and regulations are binding and must be followed by all participants in sports activities, even if they are not athletes themselves. In fact, these legal provisions are mandatory for national courts in general, as well as for arbitration bodies and legal committees with judicial authority within sports federations that handle sports-related disputes, whether at the national or international level.
As a result, judges and arbitrators find themselves obligated to adhere to these laws and regulations, even though they are not always issued by the competent legislative authority of a given country. In many cases, such rules are formulated by private individuals involved in the sport, whether as athletes or organizers, at the national level through what is known as the national (local) sports federation or at the international level through what is referred to as the international sports federation. The legal basis for the binding force of these sports legal rules stems from two main sources. First, legislative delegation, whereby the national legislator grants these sports bodies the authority to establish such legal rules. Second, the legislator’s recognition of these rules by incorporating them into national legislation, thereby mandating compliance with them for all participants in sports activities. Through these two mechanisms, sports legal rules acquire their binding force and find their legal foundation in this obligation.

ان من ابرز الانشطة الانسانية التي بدأت تزدهر في الوقت الحاضر واخذت تنتشر انتشارا سريعا هو الانشطة الرياضية والتي اصبحت تمارس على مستوى واسع جدا ليس بين فئات الشباب وحسب بس تمارس من قبل كافة المستويات العمرية ومن كافة الاجناس وبالتالي فان ذلك تطلب ومن اجل ضبط هذا النشاط الانساني تدخل القائمين عليه وكذلك المشرع الوطني بوضع مجموعة من القوانين والقواعد التي تحكم وتنظم هذا النشاط مثل قانون الاحتراف وقانون الاتحادات الرياضية وقانون الاندية الرياضية وكذلك القواعد واللوائح التي تسمى بقوانين الالعاب الرياضية او قواعد الالعاب الرياضية.
وهكذا بدأ يظهر ما يعرف بالقانون الرياضي واخذ يتسم بنوع من الاستقلالية وان لم يكن مستقلا بالمعنى الدقيق عن غيره من القوانين الا انه أصبح فرعا خاصا مستقلا بحد ذاته. وهذه القواعد والقوانين تكون واجبة الاتباع وملزمة لكل من يساهم في الأنشطة الرياضية حتى لو لم يكن رياضيا لدرجة ان هذه القواعد والقوانين يكون اتباعها وتطبيقها ملزما للمحاكم الوطنية بشكل عام والهيئات التحكيمية واللجان القانونية ذات الطبيعة القضائية في اتحادات الالعاب الرياضية التي يعرض عليها النزاع الرياضي سواء الوطنية او الدولية.
وبالتالي فان القاضي او المحكم يجد نفسه ملزما باتباع تلك القوانين والقواعد رغم انها لم تصدر جميعها من الجهة التشريعية المختصة في البلد في كثير من الاحيان حيث انها قد تصدر من قبل اشخاص عاديين رياضيين يمارسون تلك اللعبة او قائمين على تنظيمها سواء على المستوى الوطني وهو ما يطلق عليهم باتحاد اللعبة الرياضية الوطني (المحلي) او على المستوى الدولي وهو ما يطلق عليهم بالاتحاد الدولي للعبة. وان الاساس القانوني للقوة الملزمة لهذه القواعد القانونية الرياضية التي تحكم النشاط الرياضي يأتي عن طريقين اولهما عن طريق التفويض التشريعي الذي منحه المشرع الوطني لهذه للهيئات والجهات الرياضية بوضع هذه القواعد القانونية الرياضية. وثانيهما اعتراف المشرع بهذه القواعد والنص على ذلك من خلال التشريعات القانونية الصادرة عن المشرع الوطني، اذ الزم جميع المساهمين في النشاط الرياضي بضرورة الالتزام بها ومراعاتها عند ممارستهم للنشاط الرياضي. وبهذين الطريقين تكتسب القواعد القانونية الرياضية قوتها الملزمة وتجد اساسها القانوني في هذا الالزام.

Patents are an important legal concept in the field of industrial property, requiring legal and international protection for patents. Intellectual property is an important field due to its vital and effective role in developing countries' economies. The technological and economic development experienced by most developed countries requires focusing the study on the field of patents, which calls for inventors to obtain patent rights in exchange for their intellectual, industrial, and technical production. This right may be subject to infringement by other parties from different countries, which may result in a conflict between the laws of countries, ultimately determining which law should be applied to patents. In response to this progress and development, the need for the emergence and increase of patents has increased, potentially making them vulnerable to exploitation, infringement, and distortion. This has prompted many countries to devote their efforts, both domestically and internationally, to surrounding these patents with protective rules that define the applicable law by stipulating specific assignment rules. International agreements also stipulate strict legal provisions, starting with the Paris Convention of 1883, which constitutes the basis for international patent protection. This Convention provides comprehensive international provisions and principles that define the applicable law to patents. All of these protective rules are merely solutions to conflicts of laws in the field of patents.

Electronic litigation may negatively affect the principle of public litigation because the public trial is what gives confidence to litigants towards the judicial authority, as it also allows opponents to confront all papers and discuss, and this is one of the most important points that guarantee the integrity of the issuance of the ruling, and all of this is not achieved in electronic litigation, so it has a negative impact on the loss of confidence in judges and judicial rulings, as they were made in secret and not in the presence of the public and facing opponents.

أن التقاضي بالوسائل الإلكترونية الحديثة في ظل عالم يعيش ثورة معلوماتية هائلة لم نعد بحاجة إلى أن نستخدم الوسائل التقليدية للتقاضي طالما يمكننا من أن نستبدلها بالوسائل الإلكترونية ولكن يشترط لذلك عدم تأثر علانية التقاضي الذي يعد ضمانه للمتقاضين بكل ذلك التطور.
فالتقاضي الالكتروني قد يؤثر بشكل سلبي على مبدأ علانية التقاضي لأن المحاكمة العلنية هي التي تعطي الثقة للمتقاضين تجاه السلطة القضائية حيث أنها تُتيح للخصوم أيضاً المواجهة بكل الأوراق والمناقشة وهذا من أهم النقاط التي تضمن نزاهة أصدار الحكم وكل ذلك لا يتحقق في التقاضي الالكتروني لذلك له تأثير سلبي في فقدان الثقة في القضاة والأحكام القضائية حيث أنها تمت في الخفاء وليس في حضور الجمهور ومواجهة الخصوم.

Abstract

The significance of our research lies in the importance of international commercial arbitration as a means of resolving disputes between commercial parties, where arbitration is considered an effective alternative to traditional courts. Our study discusses the losses resulting from the unilateral termination of contracts by the state, which may negatively impact the rights of other parties involved.
Our research addresses the importance of the contracting parties' adherence to the terms of commercial contracts and other agreements alike, with a complete commitment to the notion that a contract serves as a binding law for the contractors—as established by legal scholars thereby affecting the nature of the relationship between the Iraqi state and its contracting entities. We aim to distinguish between administrative contracts concluded by the state domestically and those entered into with foreign investment entities, elucidating the different
legal aspects of each type of contract.
Our study focuses on how to terminate international trade contracts by mutual agreement of the parties, rather than through unilateral termination, and the impact this has on foreign investment. This mutual agreement among contracting parties can contribute to resolving disputes amicably, as opposed to the losses incurred by Iraq—as seen in the case of the Ministry of Transport and Egyptian Horus Airlines—and recourse to established legal grounds that we have outlined in this research, such as: contract termination through a judge or international arbitrator, consensual termination or explicit resolutory condition, raising the defense of non-performance, and finally, resorting to arbitration as a means to resolve international commercial disputes, thus helping to avoid crises related to arbitration or judicial disputes.

Abstract

Some banks face difficulties in fulfilling their financial obligations to depositors, as a result of their mismanagement. This matter constitutes a lack of confidence among depositors and investors in the banking system, which prompts the Central Bank to take a series of necessary measures to rehabilitate the troubled bank, including establishing a transitional bank to address the financial distress of the bank placed under guardianship. However, the ambiguity in the texts regulating the transitional bank in the Iraqi Banking Law No. (94) Of 2004 is an existing problem facing the Central Bank of Iraq when resorting to establishing a transitional bank to rehabilitate the financially troubled bank, which requires removing obstacles before the Central Bank to register and grant legal personality to the transitional bank by reviewing the texts regulating the transitional bank.

تُواجه بعض المصارف تعثر في الإيفاء بالتزاماتها المالية المستحقة للمودعين، نتيجة سوء إدارتها وهذا الامر يُشكل ضعف ثقة المودعين والمستثمرين بالنظام المصرفي، مما يدفع البنك المركزي الى أتخاذ سلسلة من الإجراءات الضرورية لإعادة تأهيل المصـــرف المعســــر، من هـــــــــذه الإجراءات أنشاء مصرف مرحلي لمعـــــــــالـجة الفشـــــــــل المــــالي للمصرف الموضـــــوع تحــــــت الـــوصـــاية، إلا أن غـــموض الــــموجود في نصوص المنظمة للمصرف المرحلي في قــــــــــانون المصــارف العــراقي رقم (94) لسنة 2004، تعد مشكلة قائمة تواجه البنــــــــك المـــــركزي العراقــــي عند اللجوء الى أنشاء مصـــــرف مرحلي لإعادة تأهيل المصرف المــــــعسر مالياً، ممــا يتطلب تذليل الـــــــمعوقات امام البنك المركزي لتسجيل ومنح الشــــخصــية القانونية للمصرف المرحلي من خـــــــلال إعادة النظر في نصــــــــوص قانــــــون الـــــمصارف.

Abstract

"Technological transformations in the field of devices, software and communications" have led to the imposition of new forms of transactions related to the economy and information, the most prominent of which are "electronic transactions", which are "the implementation of everything related to the purchase and sale of goods, services and information via the Internet and other commercial networks", and through the electronic exchange of data, as well as "transcending time and space boundaries". Electronic banking is one of the things that resulted from the tremendous technical progress in the field of communications, as new methods of performance were created that are appropriate to the nature and requirements of digital transactions, and the customer can now benefit from banking services such as paying bills for goods and services via telephone and electronic communication. Electronic banking transactions have provided a number of advantages for customers, as well as providing "new marketing opportunities", widespread distribution, and "improving the quality of banking services". However, on the other hand, the emergence of these operations was accompanied by the exploitation of some parties, whether from outside the workers in those "financial institutions" or even from those working in them, exploiting the existence of some technical, administrative or regulatory loopholes or investors who enabled them in aspects related to information security, and thus what is the position? Abstract

In the 1980s, the field of sport witnessed a remarkable development in sports' legal relations, as the latter were not limited to competition in games, but had shown them a significant place in national and international trade. This has led to the complexity of those relationships that led to the emergence of sporting disputes, which, like any other disputes, require a judicial or administrative authority to adjudicate upon them when they occur between clubs and players, as the power-bearer State was initially required to consider and settle such disputes but in a manner that does not meet the expectations of the parties, his solutions were unsatisfactory to athletes and sports institutions, because the ordinary judiciary did not know the specificities of sports relationships. This has led to an attempt to seek another alternative to the state's judiciary whose task is to settle sports disputes in a way that safeguards the expectations of the parties and ensures legal security, such as sports settlement and arbitration centers.

The marriage contract is distinguished from other contracts in that it has a specificity that differs in the way it is concluded. The marriage contract is one of the contracts that requires an introduction, and this introduction is the engagement, which may be long or short depending on the circumstances. One of the parties may change their mind about the engagement, which may cause harm to the other party, whether this harm is material or moral, and thus gives the other party the right to claim compensation due to this harm. This requires the intervention of the judiciary to resolve such matters, which often rely on the more detailed texts of the Civil Code for matters related to compensation.

Abstract

This study deals with the implications of the responsibility of the guardian of things in both Islamic law and jurisprudence, with an analysis of the position of jurisprudence and the judiciary on this responsibility. The study reviews the concept of guardianship of things and the basis of responsibility in positive laws, with a focus on the rules regulating it, such as the theory of presumed error or objective responsibility. It also examines the concept of guardianship in Islamic jurisprudence and the extent of its compatibility or disagreement with modern legal concepts.
The study sheds light on the effects of this responsibility in terms of compensation, transfer of the burden of proof, and other legal effects resulting from the establishment or denial of responsibility, with a review of the position of the judiciary on its various applications. It also discusses the jurisprudential trends in adapting the responsibility of the guardian of things according to the general jurisprudential rules such as the rule of "guarantee by transgression" and the rule of "loss by gain".
The study concluded with a set of results and recommendations that enhance the understanding of this responsibility and help in developing legal and jurisprudential rules in line with the developments of the era.

Saudi Arabia has emerged as one of the leading countries in this domain, making the development of its cyber capabilities a strategic priority, especially after the major cyberattack that targeted Saudi Aramco in 2012, causing significant material damage. Organized crime is a cross-border phenomenon characterized by hierarchical organization and well-planned planning. These crimes include many activities, including drugs, human trafficking, money laundering, terrorism, and many crimes that negatively affect the stability of countries in several ways, including increasing rates of violence and corruption, undermining the rule of law and social order. It also leads to economic deterioration and lack of trust in the government, which affects sustainable development and hinders efforts to build a prosperous society. In Iraq, the country suffers from the negative effects of organized crime, as it includes illegal activities such as oil smuggling and arms smuggling. In Mexico, the country is facing major challenges as a result of the spread of organized crime linked to drug trafficking and violence, which negatively affects the stability and development of the country. As for how to reduce organized crime, there must be comprehensive and multi-faceted strategies, including enhancing international cooperation, improving criminal justice systems, enhancing transparency and combating corruption, and promoting economic and social development to reduce the causes of the spread of organized crime and its negative impact on the stability of countries.

Iraqi Food Security (Reality and Challenges)

Abstract

This study aimed to explore the state of food security in Iraq and its challenges. The research reviewed the economic risks, particularly global challenges related to food security. A descriptive survey method was employed, and the study covered nine Iraqi provinces: Karbala, Wasit, Salah al-Din, Najaf, Diwaniyah, Muthanna, Dhi Qar, Maysan, and Basra. The key findings indicated a noticeable decline in self-sufficiency in grain production from 52% in the 1970s to around 20% by the end of the 1990s. Notably, Nineveh province accounts for approximately 30% of the total arable land, highlighting a disparity in food security among other provinces. The study recommended improving food distribution systems and enhancing local Iraqi production. It also suggested forming food institutions in collaboration with the Iraqi Ministry of Economy and Planning, focusing on nutritional elements, and monitoring prices and consumption trends over past decades. Additionally, emphasis was placed on agricultural products, ensuring quality in their export and import processes to enhance dietary diversity and compensate for years of decline.

هدف البحث في التعرف على واقع الامن الغذائي العراقي وتحدياته وقد استعرض البحث المخاطر الاقتصادية المتمثلة في التحديات العالمية للأمن الغذائي على وجه التحديد وقد استخدم البحث المنهج الوصفي المسحي وقد أجرى البحث على (9) محافظات عراقية وهي (كربلاء، واسط، صلاح الدين، النجف، الديوانية، المثنى، ذي قار، ميسان، البصرة) وقد خرج البحث بأهم النتائج و لوحظ بارتفاع نسبة الاكتفاء الذاتي من الحبوب من 52% في عقد السبعينيات إلى نحو 20% في نهاية عقد التسعينات، حيث تحتل محافظة نينوى ما نسبته(30% ) من إجمالي المساحة القابلة للزراعة ما يعني ان المحافظات الأخرى تعاني من عجز في الامن الغذائي مقارنة بالمحافظات الأخرى وقد اوصى البحث بالعمل على تحسين نظم توزيع الغذاء والعمل على تعزيز الإنتاج المحلي العراقي، فيما جاء اهم تشكيل مؤسسات غذائية بالشراكة مع وزارة الاقتصاد والتخطيط العراقية والاهتمام بالعناصر الغذائية ومتابعة اسعارها واستهلاكها على مدار العقود الماضية مع العمل على التركيز على المنتجات الزراعية والعمل على جودة تصديرها واستيرادها بهدف تحسين التنوع الغذائي مع العمل على تعويض سنوات الانخفاض.

Abstract

From ancient times to the present day, religious identity has remained a fundamental driver in igniting political conflicts and prolonging their duration. While religious differences may not appear as a primary factor in contemporary political disputes, they often serve as an underlying foundation in most of them—even those arising within a single religious framework. In the context of the Palestinian-Israeli conflict, religious identity further complicates achieving a political settlement or reconciliation, transforming the idea of a two-state solution into an idealistic goal that is difficult to realize amid ongoing identity-based competition rooted in religion. This complexity is exacerbated by the tendency of political movements—both secular and religious—to leverage religious discourse to bolster their political influence and gain popular legitimacy. This deepens the divide between the Islamic/Palestinian and Jewish/Israeli identities, transforms the conflict into a more violent religious-political confrontation, and gradually distances both sides from any political solution based on peaceful coexistence between two neighboring states.

منذ العصور القديمة وحتى اليوم، ظلّت الهوية الدينية محركًا أساسيًا في إشعال الصراعات السياسية وإطالة أمدها، فمع أن الاختلافات الدينية قد لا تبدو كعامل رئيسي في النزاعات السياسية المعاصرة، إلا أنها تظل خلفيةً جوهريةً في معظمها، حتى تلك التي تنشأ داخل الإطار الديني الواحد. وفي سياق الصراع الفلسطيني الإسرائيلي، تزيد الهوية الدينية من تعقيد تحقيق تسوية سياسية أو مصالحة، إذ تحول فكرة حل الدولتين إلى هدفٍ مثالي يصعب تحقيقه وسط استمرار التنافس الهوياتي القائم على الدين. وتُفاقم هذا التعقيد ميولُ التيارات السياسية (سواء العلمانية أو الدينية) إلى استغلال الخطاب الديني لتعزيز نفوذها السياسي وكسب الشرعية الشعبية، وهذا ما يعمّق الانقسام بين الهويتين الإسلامية/الفلسطينية واليهودية/الإسرائيلية، ويحول الصراع إلى مواجهة دينية-سياسية أكثر عنفًا، ويبعد الطرفين تدريجيًا عن أي حلٍ سياسي قائم على التعايش السلمي لدولتين متجاورتين.

The study dealt with the importance of the federal structure in general and then the foundations of the federal structure in Iraq according to the permanent Iraqi constitution of 2005, in particular. After the period following 2003 and the change that occurred in Iraq, the process of actual application of federalism began, and thus Iraq transformed from the framework of a simple state to the framework of a complex state, through what was stipulated in the State Administration Law for the Transitional Period and the Permanent Iraqi Constitution of 2005. The permanent constitution did not differ much from the State Administration Law for the Transitional Period in the matter of its interest in federalism and providing some important details about it, as the permanent constitution relied in many of its articles on the State Administration Law for the Transitional Period.

The Issue of Ethnic Diversity in Sudan After 2011

Abstract

Sudan is a country characterized by significant ethnic diversity, which has played a positive role in enriching its culture and arts. However, it has also been a factor in political and social conflicts. Since Sudan’s independence in 1956, the country has experienced a series of coups and civil wars due to poor management of this diversity, especially under colonial policies that deepened ethnic divisions. During the rule of former President Omar al-Bashir (1989-2019), repressive policies were implemented to impose an Arab and Islamic identity on the country, leading to the suppression of non-Arab and non-Muslim minorities. The Comprehensive Peace Agreement of 2005 aimed to address these crises but failed to achieve the desired outcomes, culminating in the secession of South Sudan in 2011, after the popular revolution in 2019, the Constitutional Document acknowledged diversity and emphasized the need to achieve equal citizenship. The Juba Peace Agreement was signed in 2020, marking an important step toward managing diversity. However, it has not resolved all challenges related to identity and religion. Despite these efforts, Sudan continues to face significant difficulties in achieving stability. The ethnic and religious gap remains a barrier to comprehensive development, making it essential to focus on strengthening national unity through inclusive dialogues, legislative reforms, empowering women and minorities, and achieving balanced economic development.

Abstract

يعتبر السودان من الدول التي تتميز بتنوع عرقي كبير، لعب هذا التنوع دورًا إيجابيًا في إثراء الثقافة والفنون، لكنه أيضًا كان عاملًا للصراعات السياسية والاجتماعية، فمنذ استقلال السودان عام 1956، تعرضت البلاد لسلسلة من الانقلابات والنزاعات الأهلية، نتيجة لإدارة سيئة لهذا التنوع، خاصة في ظل السياسات الاستعمارية السابقة التي عمقت الانقسامات العرقية، ففي فترة حكم الرئيس الأسبق عمر البشير (1989-2019)، طُبقت سياسات قمعية تستهدف فرض هوية عربية وإسلامية على البلاد، مما أدى إلى قمع الأقليات غير العربية وغير المسلمة، وكانت اتفاقية السلام الشامل لعام 2005 هدفت إلى معالجة هذه الأزمات لكنها لم تحقق النتائج المرجوة، وانتهت بانفصال جنوب السودان عام 2011، وبعد الثورة الشعبية في 2019، جاءت الوثيقة الدستورية لتعترف بالتنوع وتؤكد على ضرورة تحقيق المواطنة المتساوية، وتم توقيع اتفاقية جوبا للسلام عام 2020، التي تعد خطوة مهمة نحو إدارة التنوع، لكنها لم تحل كل التحديات المرتبطة بالهوية والدين، ورغم هذه الجهود، لا يزال السودان يواجه صعوبات كبيرة في تحقيق الاستقرار، وأن الفجوة العرقية والدينية تظل عائقًا أمام التنمية الشاملة، لذلك من الضروري التركيز على تعزيز الوحدة الوطنية من خلال حوارات شاملة، وإصلاحات تشريعية، وتمكين المرأة والأقليات، وتحقيق التنمية الاقتصادية المتوازنة.

Abstract

U.S. policy toward Saudi Arabia has undergone significant shifts amid regional transformations in the Middle East. The U.S. approach seeks to balance strategic interests—such as ensuring energy market stability, enhancing security cooperation, and countering Iranian influence—with its promotion of democratic values and human rights, The study highlights that U.S.-Saudi relations have been shaped by various factors, including changes in U.S. administrations, geopolitical developments like the Yemen conflict, the normalization of ties between some Arab states and Israel, and growing tensions with Iran. Human rights concerns, particularly after the killing of journalist Jamal Khashoggi, have also led some U.S. administrations to reassess the depth of their engagement with the kingdom, despite challenges, U.S.-Saudi relations remain rooted in mutual interests, with Saudi Arabia playing a crucial role in energy and regional security. Additionally, U.S. competition with China and Russia pushes Washington to maintain its alliance with Riyadh while applying diplomatic pressure to align Saudi policies more closely with American strategic objectives.

شهدت السياسة الأمريكية تجاه المملكة العربية السعودية تحولات كبيرة في ظل التغيرات الإقليمية التي شهدتها منطقة الشرق الأوسط، ويعتمد نهج الولايات المتحدة على تحقيق التوازن بين مصالحها الاستراتيجية، مثل ضمان استقرار أسواق الطاقة، وتعزيز التعاون الأمني، ومواجهة النفوذ الإيراني، وبين القيم التي تروج لها مثل الديمقراطية وحقوق الإنسان، وأن العلاقات بين الولايات المتحدة الامريكية والمملكة العربية السعودية تـأثرت بعدد من العوامل، أبرزها التغيرات في الإدارات الأمريكية، والتطورات الجيوسياسية مثل الصراع في اليمن، وتطبيع العلاقات بين بعض الدول العربية و"إسرائيل"، إضافة إلى التوترات المتزايدة مع إيران، كما لعبت قضايا حقوق الإنسان دورًا في توتر العلاقات، خاصة بعد مقتل الصحفي جمال خاشقجي، مما دفع بعض الإدارات الأمريكية إلى إعادة تقييم مستوى التعاون مع المملكة على الرغم من التحديات، تبقى العلاقات الأمريكية-السعودية قائمة على المصالح المتبادلة، حيث تظل المملكة شريكًا رئيسيًا في قضايا الطاقة والأمن الإقليمي، كما أن التنافس مع الصين وروسيا يدفع الولايات المتحدة للحفاظ على تحالفها مع المملكة العربية السعودية، مع محاولة فرض ضغوط دبلوماسية لتوجيه السياسات المملكة العربية السعودية نحو توافق أكبر مع التوجهات الأمريكية.

Abstract

Iraqi-Japanese relations have witnessed gradual development after 2003 despite the challenges of the U.S, occupation. Japan has strengthened its support for Iraq politically, humanitarianly, and economically by providing aid in reconstruction, healthcare, and education, as well as deploying non-combat forces in 2004 to contribute to rebuilding efforts. Economic cooperation has also seen significant growth, particularly in the energy and infrastructure sectors, through signed agreements and developmental projects ,Despite security challenges, Japan has continued to provide financial assistance, and its support for Iraq is expected to persist as conditions improve, This research highlights Iraqi-Japanese relations as a model of international cooperation in post-conflict situations, analyzing their development, security challenges, and future prospects ,The study concludes that Japan has played a crucial role in supporting Iraq politically and humanitarianly through aid and reconstruction, Economic cooperation has expanded, particularly in energy and infrastructure, with ongoing financial support despite security concerns, making Iraqi-Japanese relations a prominent example of international collaboration in post-conflict recovery.

شهدت العلاقات العراقية اليابانية تطوراً تدريجياً بعد عام 2003 رغم تحديات الاحتلال الأمريكي، عززت اليابان دعمها للعراق سياسياً، إنسانياً، واقتصادياً من خلال تقديم مساعدات في إعادة الإعمار، الصحة، والتعليم، وإرسال قوات غير قتالية عام 2004 للمساهمة في جهود إعادة البناء، كما شهد التعاون الاقتصادي نمواً واضحاً، خاصة في مجالات الطاقة والبنية التحتية عبر توقيع اتفاقيات ومشاريع تنموية، ورغم التحديات الأمنية، استمرت اليابان في تقديم المساعدات المالية، ومن المتوقع استمرار دعمها للعراق مع تحسن الأوضاع، يبرز البحث العلاقات العراقية اليابانية كنموذج للتعاون الدولي بعد النزاعات، محللاً تطورها وتأثير التحديات الأمنية عليها، ومستشرفاً آفاق التعاون المستقبلي، توصل البحث إلى أن اليابان لعبت دوراً مهماً في دعم العراق سياسيًا وإنسانيًا من خلال المساعدات وإعادة الإعمار، كما تعزز التعاون الاقتصادي، خاصة في مجالي الطاقة والبنية التحتية، مع استمرار الدعم المالي رغم التحديات الأمنية، مما يجعل العلاقات العراقية اليابانية إنموذجاً بارزاً للتعاون الدولي في مرحلة ما بعد النزاعات.

Abstract

The study of border problems of studies of important studies and its importance comes from knowing the causes of conflict between countries and knowing the ways to settle these disputes, which are carried out in two ways, namely the international judiciary represented by the International Court of Justice and international arbitration who are chosen by the conflicting parties in pursuit of achieving the rule of law instead of the rule of force, and the border dispute erupts between countries with common borders, which has an impact on disturbing friendly relations between neighboring countries.

تعد دراسة المشاكل الحدودية من الدراسات المهمة وتأتي أهميته من معرفة أسباب النزاع بين الدول ومعرفة طرق تسوية هذه النزعات والتي تتم بطريقتين وهما القضاء الدولي المتمثل في محكمة العدل الدولية والتحكيم الدولي الذين يتم اختيارهم من قبل الأطراف المتنازعة سعياً وراء تحقيق سيادة القانون بدلاً من سيادة القوة، كما ان نزاع الحدود ينشب بين دول ذات حدود مشتركة مما يكن له أثر في تعكير صفو العلاقات الودية بين دول الجوار.

Abstract

The Nagorno-Karabakh conflict is a very complex conflict. It involves many regional and international parties that played an influential role in shaping its path. The roots of the conflict go back to the beginning of the nineties after the collapse of the Soviet Union and the acquisition of independence by Armenia and Azerbaijan. The two countries entered into a war between the years (1992-1994), and a ceasefire was concluded after negotiations conducted by the Minsk group responsible for managing the conflict. However, that conflict did not end, but was only frozen, as clashes between the two parties to the conflict renewed from time to time, as in 2016, and more severely in 2020, which ended with Russian mediation and with limited gains for Azerbaijan.
The war between the two parties was renewed in 2022, until Russia was able to mediate to stop the fighting. Then there were clashes in 2023, when Azerbaijan began a military offensive against the self-declared separatist Artsakh. The attack took place in the disputed Nagorno-Karabakh region, which is internationally recognized as part of Azerbaijan and inhabited by Armenians, but an agreement was reached on a complete cessation of hostilities in the region. Mediated by the Russian peacekeeping command.
The Turkish position towards the conflict in Nagorno-Karabakh has been characterized by declared official support for Azerbaijan against Armenia (politically, diplomatically and militarily). The Turkish position on this issue during the first war between the years (1992-1994) revolved mainly around political and diplomatic support for Azerbaijan, in contrast to the full support -which includes significant military support- that Turkey provided to Azerbaijan in its war against Armenia in 2020, the clashes in 2022, and the clashes in 2023.

يُعَدّ نزاع إقليم ناغورنو قره باغ من النزاعات شديدة التعقيد؛ إذ تتداخل فيه العديد من الأطراف الإقليمية والدولية التي لعبت دورًا مؤثرًا في تشكيل مساره. وتعود جذور النزاع إلى بداية التسعينيات بعد انهيار الاتحاد السوفيتي، وحصول كل من أرمينيا وأذربيجان على الاستقلال، إذ دخلت الدولتان في حرب بين عامي (1992-1994)، وتم وقف إطلاق النار بعد مفاوضات قامت بها مجموعة (مينسك) المسؤولة عن إدارة الصراع. إلا أن ذلك النزاع لم ينته ولكن تم تجميده فقط، حيث تجددت الاشتباكات بين طرفي النزاع من وقتٍ لآخر، كما في عام 2016، وبصورة أشد في 2020 والتي انتهت بوساطة روسية وبمكاسب محدودة لأذربيجان.
تجددت الحرب بين الطرفين في عام 2022، إلى أن تمكنت روسيا من الوساطة لوقف القتال. ثم وقعت اشتباكات عام 2023، عندما بدأت أذربيجان هجومًا عسكريًا ضد آرتساخ الانفصالية المعلنة ذاتيًا، ووقع الهجوم في منطقة ناغورنو قره باغ المتنازع عليها، والتي يُعترف بها دوليًا كجزء من أذربيجان، ويسكنها الأرمن، ولكن جرى التوصل إلى اتفاق بشأن وقف كامل للأعمال العدائية في المنطقة بوساطة قيادة حفظ السلام الروسية.
أتسم الموقف التركي تجاه النزاع في إقليم ناغورنو قره باغ بالدعم الرسمي المُعلن لأذربيجان ضد أرمينيا (سياسيًا ودبلوماسيًا وعسكريًا). وكان الموقف التركي من هذه القضية إبان الحرب الأولى بين عامي (1992–1994) يتمحور أساسًا حول الدعم السياسي والدبلوماسي لأذربيجان، بخلاف الدعم الكامل -الذي يتضمن دعمًا عسكريًا كبيرًا- والذي قدمته تركيا لأذربيجان في حربها ضد أرمينيا عام 2020 واشتباكات عام 2022 واشتباكات عام 2023.

Abstract

The Middle East region holds a prominent position in the strategic minds of major and superpowers. Therefore, these countries have always had a direct or indirect presence through political, economic, military or cultural fields with the countries of the region, through treaties or strategic partnerships. This interest stems from the region’s uniqueness as a transportation hub between the three continents (Europe, Asia, Africa), in addition to the presence of many and varied natural resources, most notably energy (oil and gas). China and Russia’s interest stems from the convergence of their common interests and goals towards the Middle East region, and at the same time their competition with the United States over these resources.

منطقة الشرق الأوسط وما تحمله من مكانة بارزه في العقل الاستراتيجي للدول الكبرى والعظمى، لذا دأبت هذه الدول أن تكون لها وجود مباشر أو غير مباشر عبر المجالات السياسية أو الاقتصادية، أو العسكرية أو الثقافية مع دول المنطقة وعبر معاهدات، أو شراكات استراتيجية، وهذا الاهتمام نابع من خصوصية المنطقة باعتبارها عقدة المواصلات بين القارات الثلاثة (اوربا، اسيا، افريقيا)، فضلاً عن وجود موارد طبيعية كثيرة، ومتنوعة أبرزها الطاقة(النفط والغاز)، فالصين وروسيا اهتمامهما بقضايا المنطقة جاءت نتيجة لتقارب مصالحهم واهدافهم المشتركة اتجاه منطقة الشرق الأوسط، وفي الوقت نفسه تنافسهم مع الولايات المتحدة على هذه الموارد.
