Abstract
The commitment of the parties to attend court on the scheduled dates for their cases is one of the most important reasons for resolving a case as quickly as possible, as it ensures the application of the principle of confrontation and the freedom of defense, without which justice cannot be realized, and due to its impact on the nature of the judgment and the timing of appeals. Therefore, the researcher chose to address this topic. In this research, the researcher followed the comparative analytical method and divided the study into two sections. In the first section, the concept of the parties was discussed linguistically and technically, by clarifying the concept of the parties. In the second section, the study dealt with the rules of attendance and absence, by explaining the provisions of absence and attendance in Iraqi law, and absence and attendance in Palestinian law, and clarifying the similarities and differences between the two laws.
Abstract
يُعدّ التزام الأطراف المعنية بالحضور إلى المحكمة وفقًا للاتفاق عنصرًا أساسيًا في سرعة حلّ النزاع. ولا يمكن تحقيق العدالة دون مبادئ النزاع وحرية الدفاع، وهذا يضمن تطبيقها. كما يؤثر ذلك على طبيعة الحكم وفترة الاستئناف. لذا، اختار الباحث دراسة هذا الموضوع باستخدام منهج التحليل المقارن. تتألف الدراسة من جزأين: في الجزء الأول، نُعرّف المتقاضين ثم نحلل مفهومهم من منظور لغوي وتقني. أما الجزء الثاني، فيُقارن بين النظامين القانونيين في العراق وفلسطين فيما يتعلق باللوائح المنظمة للحضور والغياب، مُسلطًا الضوء على أوجه التشابه والاختلاف بينهما.
