Abstract

Introduction to the Topic: The Algerian narcotics law, Law No. 04-18, as amended by Law No. 23-05, considers the offender's status an aggravating factor for sentencing. This is because such a status makes it easier to commit the crime when the perpetrator abuses their authority, the trust placed in them by society, or the victim’s vulnerability, which prevents resistance. The Algerian legislature explicitly includes the status of a public official in Law No. 04-18, as amended and supplemented, related to the prevention of narcotics and psychotropic substances and the suppression of their illegal use and trafficking. Significance of the Topic: The importance of this topic lies in how the Algerian legislator approaches establishing an aggravating factor for sentencing when the offender is a public official. This has led to the classification of drug-related offenses from misdemeanors to felonies, resulting in severe and strict penalties. The legislator has therefore implemented the aggravating sentencing provision based on the offender’s status. Objectives of the Study: The study aims to highlight the position of the Algerian legislator as reflected in the enactment of a new law on narcotics, which defines drug-related crimes and their associated penalties. This aligns with modern criminal policies that emphasize the importance of adopting preventive and therapeutic measures to address this issue. Methodology: The study adopts a descriptive and analytical approach by determining who qualifies as a public official under Law No. 05-23 on narcotics and analyzing the penalties related to that status.

Abstract

لقد اعتد القانون الجزائري المتعلق بالمخدرات رقم 04-18، المعدل بالقانون رقم 23-05 بظرف الصفة في تشديد العقاب، لما لها من تسهيل في تنفيذ الجريمة عند استغلالها من طرف الفاعل لسلطة أو ائتمان وضعها المجتمع فيه، أو لضعف في الضحية لا يستطيع بسببه المقاومة. فقد أخذ المشرع الجزائري بصفة الموظف العمومي في القانون رقم 04-18 المعدل والمتمم والمتعلق بالوقاية من المخدرات والمؤثرات العقلية وقمع الاستغلال والاتجار غير المشروعين بها. تبرز أهمية الموضوع في اتجاه المشرع الجزائري إلى إقرار ظرف تشدد العقاب من طرف القاضي إذا تعلق الأمر بموظف عمومي، وأخرج العقوبة من طابعها الجنحي إلى طابعها الجنائي حيث رصد لها عقوبات قاسية وصارمة، وأعمل الظرف المشدد للعقاب الناتج عن صفة الفاعل. يهدف الموضوع إلى إبراز موقف المشرع الجزائري الظاهر من خلال سنّه لقانون جديد متعلق بالمخدرات وأورد فيه جرائم المخدرات والعقوبات المقررة بها، وهذا تماشيا مع السياسة الجنائية الحديثة التي تؤكد على ضرورة إتباع تدابير وقائية وعلاجية لمواجهة هذه الظاهرة. تمت دراسة الموضوع بإتباع المنهج الوصفي والتحليلي من خلال تحديد من هو الموظف المقصود في القانون رقم 23-05 المتعلق بالمخدرات، وكذلك العقوبات المرافقة لصفة الموظف.
