Abstract
The study entitled “Simulating the Jurisprudential Perspective with the Intellectual Perspective on the Issue of Cosmetic Surgery” analyzes the Islamic legal regulations governing cosmetic procedures, distinguishing between the “reconstructive” type—permitted for the removal of harm—and the “enhancement” type, which is restricted by the prohibition of altering God’s creation. The research reveals that the criterion of “medical and psychological necessity” is the decisive factor in determining the jurisprudential ruling, particularly when facing the pressures of false modern beauty standards. It further discusses the impact of consumer culture and social media platforms in distorting the concept of “self-acceptance,” thereby necessitating the establishment of an ethical charter that integrates medicine and Sharia. The findings emphasize the obligation of surgeons to uphold both medical and religious responsibility, avoiding procedures that involve deception or health risks outweighing the expected benefits. The study recommends the creation of joint advisory committees between jurists and physicians to evaluate emerging cases, ensuring the realization of Sharia objectives in preserving life and permissible beauty.

يحلل البحث الموسم بـ: (محاكاة المنظور الفقهي للمنظور الفكري في مسألة عمليات التجميل) الضوابط الشرعية لجراحات التجميل، مفرقاً بين النوع "الترميمي" المباح لإزالة الضرر، والنوع "التحسيني" المقيد بضوابط عدم تغيير خلق الله، فقد كشفت الدراسة أن معيار "الحاجة الطبية والنفسية" هو الفاصل في تكييف الحكم الفقهي، خاصة عند مواجهة ضغوط معايير الجمال العصرية الزائفة، وناقش البحث أثر الثقافة الاستهلاكية ومنصات التواصل في تزييف مفهوم "الرضا عن الذات"، مما يوجب وضع ميثاق أخلاقي يجمع بين الطب والشرع، وأكدت النتائج على ضرورة التزام الجراحين بالمسؤولية الطبية والشرعية، وتجنب العمليات التي تنطوي على تدليس أو ضرر صحي يفوق المنفعة المتوقعة، وتوصي الدراسة بإنشاء لجان استشارية مشتركة بين الفقهاء والأطباء لتقييم الحالات المستجدة، ضماناً لتحقيق مقاصد الشريعة في حفظ النفس والجمال المأذون.
